NEW YORK -- A suspended NYPD officer is now facing criminal charges after using an apparent chokehold during a now-viral arrest in Queens last Sunday.Officer David Afanador has been charged with attempted aggravated strangulation and strangulation in the second degree, Queens District Attorney Melinda Katz said Thursday.The 39-year-old cop, who has a history of complaints against him, was arrested and booked at his own Queens precinct just after 9 a.m. Thursday, according to police.If convicted, Afanador faces up to seven years in prison, the DA's office said.DA Katz acknowledged that body-camera footage shows the officers being cursed at and badgered before the incident. "Everyday, however, police officers find themselves in circumstances that require them to exercise restraint and are charged with de-escalating potentially volatile conflicts," the district attorney said."Even under the most difficult of circumstances...this kind of action is exactly the kind of police conduct that the NYPD has banned and our State Legislature criminalized," Katz added.Afanador was suspended without pay Monday, just a day after being caught on video pinning 35-year-old Ricky Bellevue to the ground and apparently putting him in a banned chokehold in the confrontation on the Rockaway Beach boardwalk.Mayor Bill de Blasio said at the time it was the fastest he'd ever seen the NYPD discipline an officer.The NYPD released the body-cam video of the arrest almost immediately after bystander video of the incident went viral.Prosecutors opened the investigation into Afanador’s actions Monday, saying at the time "there must be zero tolerance for police misconduct."Afanador was acquitted in a prior case stemming from allegations he pistol-whipped a Bronx teenage suspect and broke two teeth in 2014.The officer has had eight Civilian Complaint Review Board complaints filed against him, including use of excessive force and denying medical attention, since he joined the force in 2005.The use of excessive force by police has sparked weeks of protests and rallies in New York City and nationwide.The outcries for police reform prompted Commissioner Shea to shake up leadership at the NYPD. NEW YORK (AP) — New York’s Democratic attorney general asked a court to enforce subpoenas into an investigation into whether President Donald Trump and his businesses inflated assets on financial statements.Attorney General Letitia James filed a petition Monday in state trial court in New York City naming the Trump Organization, an umbrella group for the Republican president’s holdings. It also included other business entities.The filing also named Eric Trump and Seven Springs, a New York estate owned by the Trump family.“I took action to force the Trump Organization, and specifically EVP Eric Trump, to comply with my office’s ongoing investigation into its financial dealings,” wrote James on Twitter on Monday. “For months, the Trump Organization has failed to fully comply with our subpoenas in this investigation.”The attorney general’s office is investigating whether the Trump Organization and the president improperly inflated the value of assets to secure loans and obtain economic and tax benefits.James says their investigation began after Michael Cohen, the president’s former lawyer, testified before Congress that Trump’s annual financial statements inflated the values of his assets to obtain favorable terms for loans and insurance coverage, while also deflating the value of other assets to reduce real estate taxes.“We are seeking thousands of documents and testimony from multiple witnesses regarding several Trump Organization properties and transactions, including from Eric Trump, who was intimately involved in one or more transactions under review,” wrote James. 1601

(KGTV) -- Supporters are defending The San Diego Police Department after a controversial email detailing an incentive-based program was released to Team 10.RELATED:  San Diego Police Chief launches internal investigation into "rewards for arrests" emailTasha Williamson says she is a civil rights activist. She organized the protest outside the Southern Division in Nestor Monday night, but she was far outnumbered by residents and business owners who showed up to support the officers and thank them for their service. RELATED:  Protest planned over controversial San Diego Police Department email"You hear words like quota and you get a little nervous, but I don't, and knowing these police officers, I don't believe for a minute that any of this was racially motivated or supposed to be directed at communities of color. I've been a person of color, I've seen things, they're not happening here," said Jason Wells. Williamson and a handful of other people at the protest are upset about an email sent by a police sergeant to the 90 officers at the Southern Division suggesting a reward based program for drug arrests. Team 10 obtained the email from an officer who wished to remain anonymous out of fears for his job.  According to the email, the officer with the most points would be rewarded with the opportunity to work in a specialized unit for up to a month. The goal was to motivate officers, increase experience and target high-crime areas.  It stated the program was being instituted in Southern Division and is strictly voluntary. It also stated that the program runs from March 1 (retroactive) to April 14.Williamson said the fact the whistleblower felt the need to go to the media, not a supervisor, is another red flag."I'm also concerned that no one else stepped forward out of the 90 officers, only one, and I'm concerned about the culture in the department in how they are really an open door policy," said Williamson.  The anonymous officer told Team 10, other officers were concerned but allowed him to speak for them. Protesters also say "quota systems" breed corruption and target low-income neighborhoods with fewer resources to fight drug problems."I'm concerned that incentive-based programs within internally with the police department would cause corruption and the incentive-based program in low-income communities for drug arrests have primarily been discriminatory," said Williamson.  "Policing should not be a game. It's not fun to arrest people if you want to do a quota, do it on something that can't be transferred from one pocket to another during a stop," said another protester. San Diego's new Police Chief David Nisleit told 10News the program was never authorized or carried out. Chief Nisleit said the email was sent by mistake and retracted within days.
