A hearing is set to take place one week after the election regarding whether the law can be struck down. Essentially, Republicans from around the country believe that the only reason the Supreme Court upheld the law in 2012 was because the opinion said Congress has the power to tax. Since that time, however, Trump has removed the tax penalty for not having health insurance. The thinking from some conservatives is that since the tax penalty is gone, the entire law can be struck down now, too. WHERE THE COURT STANDS Prior to Ginsburg's death, the general thinking was that the law would still stand. It faced a challenged in 2012, but Chief Justice John Roberts sided with four liberal justices to uphold it. With Ginsburg's passing, there are only three liberal justices on the court. If Roberts joins the liberal justices it would create a 4-4 tie. "If there is a 4-4 split on the court, then no precedent is set and whatever the lower court decided stands," Professor Paul Schiff Berman with George Washington University said. That would mean parts of the Affordable Care Act can be struck down since lower courts have already ruled in that way. If Trump is able to get another nominee on the court before the hearing, it would only make the court more conservative. Berman cautioned though that other conservatives could potentially join the liberals on this case since the lawsuit's legal standing is murky. Comey and House Democrats said the interview was a waste of time consumed with questions about Hillary Clinton's emails.The transcript was released as part of a compromise struck by Comey and House Judiciary Chairman Bob Goodlatte, R-Virginia, who had initially subpoenaed Comey to appear behind closed doors.Comey fought the subpoena in court, saying he would only testify if the proceedings were held in public. But he later backed down, agreeing to appear behind closed doors on the conditions that the transcript would be released as soon as possible and he would be free to speak about the interview afterward.Comey was interviewed as part of the Republican-led investigation into FBI's investigations into Clinton and Donald Trump and Russia in 2016. The police chief in Columbia, S.C. announced on Thursday that Master Police Officer David Hurt has been suspended for five days without pay and removed from the K-9 unit after the dog he was handling, Turbo, died after Hurt left Turbo in a police car for eight hours, The State newspaper reported. Hurt was participating in all-day training and left the air conditioning running and the windows down in his police car. He also reportedly had deactivated a heat sensor in the vehicle, which could have warned him to the car's rising temperatures. Hurt reportedly had an officer check on Turbo at 11:30 a.m. on July 26, which was four hours into the training. When Hurt returned to the vehicle at 3:30 p.m., he found Turbo was panting heavily, foaming at the mouth and unsteady on his feet, The State reported. Hurt then took Turbo to a veterinarian, where the 2-year-old dog was euthanized. Turbo's official cause of death was organ failure from prolonged heat exposure. In addition to his unpaid suspension and removal from the K-9 unit, Hurt will also be removed from the Columbia Police's bomb squad for six months. Last month's incident has also prompted the Columbia Police to make institutional changes to how it cares for K-9s.
