A former Google engineer is accusing the company of firing him after he spoke out about incidents of racism, sexism and harassment.Tim Chevalier is suing Google for retaliation, wrongful termination and failure to prevent discrimination and harassment, according to a lawsuit filed in San Francisco on Wednesday.Silicon Valley -- and Google in particular -- has been shaken by fierce debates over diversity issues. "The anti-discrimination laws are meant to protect marginalized and underrepresented groups -- not those who attack them."Google spokeswoman Gina Scigliano declined to comment directly on Chevalier's allegations. She said that lively debate is important to Google's culture, but that there are limits."All employees acknowledge our code of conduct and other workplace policies, under which promoting harmful stereotypes based on race or gender is prohibited," Scigliano said in a statement. "This is a very standard expectation that most employers have of their employees. The overwhelming majority of our employees communicate in a way that is consistent with our policies. But when an employee does not, it is something we must take seriously. We always make our decision without any regard to the employee's political views."In the lawsuit, which was first reported by tech news site Gizmodo, Chevalier alleges that some Googlers would call coworkers "immoral" because of their sexual orientation. Employees also questioned the competency of women and minorities on internal message boards, he said."Company social networking forums can be incredibly useful, but employers have an obligation to prevent them from becoming a cesspool of bullying and harassment," David Lowe, an attorney for Chevalier, said in a statement. "Firing the employee who pushed back against the bullies was exactly the wrong step to take."Debates inside Google about diversity issues erupted in August when one of the company's senior engineers at the time, James Damore, published a controversial memo claiming women are underrepresented in technology because of psychological and biological differences, not sexism.In his memo, Damore claimed to "value diversity and inclusion," but he took issue with Google's approach, which he described as overly political and alienating to "non-progressives."Damore, who was fired over the controversy, and another former Google engineer, David Gudeman, are suing the company, alleging that it discriminates against white men and conservatives.Chevalier waded into the internal debates over Damore's memo last summer, according to his lawsuit. A Brooklyn woman whose racist, profanity-laced tirade on the New York subway was captured on video this week has been charged with felony assault after she struck a fellow passenger, authorities said.The dispute between Anna Lushchinskaya, a 40-year-old white woman, and the 24-year-old passenger, a woman of Asian descent, began after Lushchinskaya bumped into the woman early Tuesday, the New York Police Department told CNN.Lushchinskaya yelled profanities at the victim on the northbound D train, hitting her with an umbrella and keys, the NYPD said. On video captured by witnesses, Lushchinskaya can be heard calling the woman a racial slur.Lushchinskaya was apprehended at the 36th Street Station and arrested, the NYPD said.CNN could not reach Lushchinskaya or her attorneys for comment Friday.Lushchinskaya was arraigned in Kings County Criminal Court following the incident, according to Brooklyn District Attorney spokesperson Oren Yaniv. She pleaded not guilty and posted ,000 cash bond, according to court records.She is due back in court January 22.The victim suffered cuts to her face, the NYPD said. One person threatened to call the police.The video shows Lushchinskaya striking the woman several times with her umbrella and her keys and again kicking her."She's not even fighting you back," one person is heard saying.At least two subway riders tried to wrestle the umbrella away.Lushchinskaya is seen spitting in the direction of the victim before yelling more profanity and a racial slur.Juan Ayala, who was filming the incident, said he decided to intervene, but Lushchinskaya lashed out at him. A video posted by another user shows Ayala talking to Lushchinskaya."Do not spit at me," Ayala says in the video, to which Lushchinskaya replies, "What are you, her attorney? A California police officer was charged Wednesday in connection with a fatal shooting at an Oakland-area Walmart store in April.San Leandro Police Officer Jason Fletcher was charged with voluntary manslaughter in connection with an incident where he fatally shot 33-year-old Steven Taylor on April 18.According to the Alameda County District Attorney's office, a security guard at the store called police when Taylor tried to leave San Leandro Walmart with a baseball bat and a tent without paying.Fletcher responded to the call and approached Taylor as he entered the store. The officer tried to grab the baseball bat from Taylor, and when he couldn't get control of the bat he drew his stun gun.After firing the stun gun, Taylor stumbled forward with the bat sitll in his hand. According to body camera footage, Fletcher repeatedly asked Taylor to drop the bat. Fletcher then fired his gun once, a shot that proved to be fatal.In its charging statement, the District Attorney's office, claimed that Taylor "posed no threat of imminent deadly force or serious bodily injury" to the officers or anyone else in the store because he had "clearly experienced the shock of the taser as he was leaning forward over his feet and stumbling forward."Fletcher's lawyer, Michael Rains, told the San Francisco Chronicle that he was "very disappointed" that the officer had been charged and that the charges were "undeserved."The decision to file the criminal complaint was made after an intensive investigation and thorough analysis of the evidence and the current law," Alameda County District Attorney Nancy O'Malley said.Lee Merritt, an attorney for Taylor's family, told NBC News that Taylor was experiencing a mental health crisis at the time of the shooting.Fletcher will be arraigned on Sept. 15 at a county courthouse in Dublin, California. 1845
