SAN DIEGO (AP) - A military judge has released a Navy SEAL from custody in advance of his murder trial in the death of an Islamic State prisoner. Capt. Aaron Rugh said Thursday that he was freeing Special Operations Chief Edward Gallagher as a remedy for interference by prosecutors. Defense lawyers accuse the prosecutors of misconduct for an effort to track defense lawyers' emails that they say violated attorney-client privilege. RELATED: Attorneys fight to free Navy SEAL in MCAS Miramar brig before trialRugh said Thursday he knew Navy investigators were trying to find the source of leaked court documents, but did not know of or approve any email tracking. Defense lawyers say the move amounted to prosecutorial misconduct and they want charges against Gallagher dismissed or prosecutors removed from the case. A military prosecutor downplayed the tracking effort, saying it did nothing more than record information on where and when emails were opened by recipients. RELATED: Rep. Duncan Hunter rallies support for accused Navy SEAL on Capitol HillDefense lawyer Tim Parlatore withdrew his motion to have the judge removed from the case after learning Rugh was kept in the dark about what prosecutors did. Gallagher will be freed as his lawyers continue to argue that the case be dismissed. He is scheduled to face trial June 10. There were gasps in the courtroom as Rugh made the announcement. Gallagher's wife put her head in her hands and burst into tears. 1476

SAN BERNARDINO, Calif. (AP) — Jury deliberations have resumed in the trial of a Southern California man charged with killing a family of four and burying their bodies in the desert.Jurors last Thursday got the case brought by San Bernardino County prosecutors against 62-year-old Charles "Chase" Merritt. The jury was off Friday and deliberations started again Monday.Merritt's business associate Joseph McStay, McStay's wife Summer and the couple's 3- and 4-year-old sons vanished from their San Diego County home in 2010. Three years later, their bodies were found in shallow desert graves more than 100 miles (161 kilometers) away.Merritt was arrested in 2014. Authorities said they traced his cellphone to the gravesite area and to a call seeking to close McStay's online bookkeeping account. If Merritt is convicted, prosecutors will seek the death penalty. 869

SAN DIEGO — Sisters Pizza on the edge of Hillcrest just celebrated its one-year anniversary. The party wasn’t exactly what owner Emily Green Lake had in mind. "We're not constantly doing refills, bringing them condiments the way that we used to,” she said. “Salt and pepper shakers are a thing of the past. I don't know that we'll ever see those again.” About two weeks ago, county restaurants got the green light to once again host guests. While Lake doesn't have to, she is keeping the dining room closed to the public for safety reasons. Instead, she opened eight of the 22 tables on her front patio, spaced out for social distancing. “It's nice to see people back there, but it's sad to think of the opportunities that my business is missing out on,” Lake said. Still, not every restaurant is hosting guests . Some are opting to stay take-out only for the time being. The ones that have opened up, however, are finding limited takers. New reservation data from Open Table shows seated dining in San Diego is down about 80% from this time a year ago. One reason: only about 45 percent of the restaurants in Open Table’s network are even taking reservations. “Just because we've had to open the economy doesn't mean that there is no coronavirus anymore, and I think that's where people are coming from when they don't want to be among the masses,” Lake said. Lake said while delivery is up, overall sales are down 40%. And to make it harder, she's spending 80 cents per order on disposable plates and utensils. Lake said she has been able to keep all of her 14 workers, but that their hours have been cut. Normally, around this time year, Lake would have hired twice as many people. Customers, meanwhile, are now ordering from the front patio. While a server wearing protective gear brings out the food, customers asked to bus their own tables. 1855

(KGTV) -- The two soldiers killed in an aircraft accident on San Clemente Island have been identified, the U.S. Army Special Operations Command said Saturday.According to the news release, 33-year-old Staff Sgt. Vincent P. Marketta of New Jersey and 22-year-old Sgt. Taylor M. Shelton of San Bernardino died on August 27 during an aviation training mishap.Marketta enlisted in the Army in 2011 as a 15T UH-60 Black Hawk Repairer and was assigned to the 160th Special Operations Regiment. While assigned to the unit, Marketta deployed to Afghanistan in support of Operation Enduring Freedom. He also deployed multiple times to Iraq for Operation Inherent Resolve, according to the Army.Shelton enlisted in the Army in 2016 also as a 15T UH-60 Black Hawk Repairer and was assigned to the same unit as Marketta. During his service, Shelton deployed to Afghanistan in support of Operation Enduring Freedom.“The loss of Staff Sgt. Marketta and Sgt. Shelton has left a scar in this Regiment that will never completely heal,” said Col. Andrew R. Graham, commander of the 160th Special Operations Aviation Regiment (Airborne).“Their level of dedication to the 160th SOAR (A) and their exemplary service in the Army is the embodiment of what it means to be a Night Stalker and a Soldier. Our priority now is to ensure the Families of our fallen warriors receive our complete support as we work through this tragedy together. We ask that you keep Staff Sgt. Marketta, Sgt. Shelton, their Families and fellow Night Stalkers in your thoughts and prayers.”The incident comes just weeks after nine servicemembers, eight Marines and one sailor, were killed in an amphibious assault vehicle training accident off the coast of San Clemente Island. 1766
