"I am the happiest man in the world to be the first human to run under two hours and I can tell people that no human is limited. VISTA, Calif. (KGTV) - Prosecutors presented evidence Thursday against a man suspected of killing his girlfriend in Cardiff in an effort to send the case to trial. Late in the day, a judge decided there was enough evidence for the case to move forward.Henry Cowen is charged with murder in the death of 43-year-old Sabrina Lukosky. During his preliminary hearing in Vista court, attorneys heard from multiple witnesses, including a DNA expert who tied Cowen to the crime scene. Lukosky’s mother requested a welfare check in October 2019 after not hearing from her daughter for several days. A search warrant was executed a few days later, and led to the discovery of Lukosky’s body. Police said there were signs of a violent struggle in the couple’s bedroom. "There was a broken stick, a bottle that had been broken, some amount of blood, and the victim had a 1.5-inch vertical gash to her forehead," said Deputy District Attorney Marnie Layon. The San Diego County Medical Examiner’s office later determined Lukosky died of blunt force trauma and strangulation. Prosecutors believe Cowen left San Diego County and traveled to Los Angeles, then took a Lyft to Riverside County. VISTA, Calif. (KGTV) -- A Vista judge has dropped two charges against Gerardo Martinez Sr., a father arrested last week by San Diego County Sheriff's deputies. Martinez Sr. was facing two charges, felony resisting arrest, and lynching of an officer. The video surfaced last week. Martinez Sr. and his son, Gerardo Martinez Jr., arrested by five deputies. The family says the deputies used excessive force and that the two men were compliant and already in handcuffs. On Monday, the family demanded the department release body cam video and conduct an independent investigation. They also want to see the deputies involved prosecuted. The sheriff's department says they were called for a domestic dispute and that Martinez Jr. was armed with a knife. Deputies were also called to the home in late April for another incident involving Martinez Jr. The family's legal team did not address any questions about what lead up to the video but said Martinez Jr. has an issue with mental illness. They plan on filing civil lawsuits at the end of the week. The deputies in the video are on administrative duty as the investigation continues.   1186

VISTA (CNS) - A homeless man accused of fatally stabbing a fellow transient outside an Escondido fast-food restaurant was ordered today to stand trial on a murder charge.John Christopher Burns, 48, is accused of stabbing Jose De Jesus Martinez in the neck shortly before 6:30 p.m. on Jan. 27, outside the Burger King on West Valley Parkway.According to preliminary hearing testimony, witnesses said Burns made statements indicating he believed the 32-year-old victim was trying to steal his bicycle, which had been left outside the restaurant.Martinez was taken to Palomar Medical Center, where he was pronounced dead, according to the Escondido Police Department.Burns was arrested by San Diego County sheriff's deputies at the Pala Casino one day after Martinez's death.He's due back in court Sept. 2 for a Superior Court arraignment. 844
