Shawn Takeuchi. Those orders banned indoor dining at the time.Takeuchi says whoever created the video was clearly angry over the department's investigation into that incident.The video uses a clip from the 2004 film "Downfall," a German film depicting the final days of Adolf Hitler during World War II. A scene in the film showing an enraged Hitler yelling at military officials is used in various parody videos online.Takeuchi said the video being investigated added subtitles that, "negatively portrays the community and department leadership. The video also makes a homophobic comment regarding the Mayor."Mayor Todd Gloria, who took office this month, is the city's first openly gay mayor.The video surfaced on Saturday and began to circulate. Numerous department members who received the video alerted their supervisors. Internal Affairs was notified and started an investigation.Takeuchi called the video "extremely disturbing and offensive.""At this time, we do not know if this video was made by someone in the department or by someone who does not work at SDPD. We are still investigating to determine who was involved in creating it," said Takeuchi. "The department will not tolerate hateful speech of any kind. If the video was created by a department member, Chief Nisleit will take swift action. This is not who we are as a department. This is not who we are as San Diegans."Gloria responded to the video on Saturday, saying in a statement that, "I regret that this act by an apparently disgruntled individual is now reflecting poorly on our Department. It’s unfair to the many men and women who serve our community with honor and a strong sense of duty. As Mayor, I will not tolerate racism, anti-Semitism, or homophobia in our City. We will swiftly confront these acts of bigotry wherever they are and hold those who are responsible for them accountable." 2292

SAN DIEGO (KGTV) -- San Diego Police are investigating after a man died in custody after reportedly breaking down a fence and walking into someone’s home Tuesday afternoon. Police were called to the 2900 block of Hornet Way around 3:30 p.m. Tuesday afternoon after receiving a call from someone saying a man, later identified as Buddie Thomas Nichols, 40, had entered his home through a rear door. According to police, the man broke down a fence and walked into the home through an open back door. Two of the residents were upstairs while their 9-year-old daughter was asleep downstairs, according to police. Police say one of the residents came downstairs when he heard commotion and confronted Nichols, punching him twice in the face and rendering him unconscious. Police say the suspect woke up and ran out of the house displaying bizarre behavior after the resident kicked him. Witnesses told police they believed the man was on drugs. When police arrived and tried to take the Nichols into custody, officers say he resisted, forcing them to use physical force to get him into handcuffs. After paramedics arrived, police say Nichols became unresponsive and later died after being taken to the hospital. 1215

SAN DIEGO (KGTV) -- San Diego Police have identified the man shot and killed by a Border Patrol agent following a confrontation Friday.According to police, David Angel Villalobos-Baldovinos, 30, was shot by an agent after entering the US illegally.Police say Villalobos-Baldovinos, a Mexican National, tried to enter the US illegally and was confronted by an agent just before 6 p.m. October 23 in San Ysidro.Villalobos-Baldovinos reportedly fought with the agent, who police say received minor injuries during the scuffle. The agent then fired his weapon, hitting the suspect one time in the torso, police say. The man was pronounced dead at the scene. RELATED: Border Patrol says Mexican national shot to death was trying to enter U.S. illegallyAt this time, the agent involved in the shooting hasn’t been identified.“The investigation and review process for an agent-involved shooting are extremely thorough. The U. S. Border Patrol is cooperating with the investigation. SAN DIEGO (KGTV) — San Diego District Attorney Summer Stephan announced Monday a motion to reduce thousands of marijuana convictions.The motion asks the San Diego Superior Court to reduce 25,000 marijuana convictions, ranging from felonies to misdemeanors, and dismiss another 1,000 misdemeanor convictions completely.“We’ve been a leader in the state and pro-active on giving individuals with marijuana convictions the opportunity to move forward with their lives without a conviction that may have been negatively impacting their lives by restricting their employment or housing,” said Stephan. “This latest motion is the continuation of work that began more than two years ago. It’s clear that the law was written to allow this relief, and it’s important that we give full effect to the will of the people.”RELATED: Los Angeles uses tech to wipe out 66,000 old pot convictionsUnder AB 1793, passed in 2018, the DA's office must notify the court of eligible cases by July 1, 2020. But according to the DA's office, officials have actively been reducing or dismissing eligible marijuana cases under 2016's Proposition 64, which legalized recreational cannabis. Since 2016, the DA's office says it has reduced or dismissed more than 1,600 marijuana-related convictions.Under Prop 64, sections regarding cultivation of marijuana, possession for sale of marijuana, and sales and/or transporting marijuana — all felonies — qualify for resentencing. The misdemeanor of possession of marijuana also qualifies.“The Superior Court and Public Defender are critical to this voluminous project and we appreciate that they’ve made it a priority,” Stephan added. 1658
