SAN DIEGO (KGTV) - Inside an MCAS Miramar courtroom Thursday, the military held a preliminary hearing for a Navy corpsman who's charged in connection with the death of a fellow Navy corpsman, HM3 Michael Vincent De Leon. A corpsman is a type of medic.ABC 10News' cameras were not allowed inside, where accused corpsman HM1 Ryan Dini appeared in his military fatigues alongside his private counsel."A cover-up is what I felt [happened] from the get-go," Jose De Leon told ABC 10News just after the hearing. He has suspected a possible cover-up since his 30-year-old son died on the Twentynine Palms military base last year.At Thursday's hearing, the prosecution argued that HM1 Dini should face additional charges related to negligence. He's already charged in part with dereliction of duty resulting in death and drunk and disorderly conduct. HM1 Dini has 19 years of service with the military.The prosecution stated that HM1 Dini and a handful of others service members including Michael were at a house party on-base where alcohol was flowing, and guns were being dry-fired the night of the death.HM1 Dini's defense denied any wrongdoing."[HM1 Dini] being the most senior individual at this going-away party failed to protect not just Michael but everyone there because they were in danger when these firearms came out," said Jose De Leon. He told us in September, "We know that the firearm was dry-fired at Michael. The firearm was put away and it came out again and according to some statements they were horsing around, and the firearm came out again and that's when Michael was killed."He said that the shooting was first called in as a suicide but ABC 10News then learned from a source with close military ties that the death was being investigated as a homicide.A prosecutor named three other service members in the hearing. Their involvement remains unknown.The prosecution told ABC 10News that in about three weeks a judge will determine whether HM1 Dini's charges will be sustained and whether he'll face additional charges.Naval Criminal Investigative Service wrote to ABC 10News on Thursday that the investigation is still open. 2149

SAN DIEGO (KGTV) — Lego fans will have more to look forward to in 2019, as Legoland California plans new attractions in celebration of its 20th birthday.Among one of the park's 2019 offerings: Free admission for kids 12 and under on their birthday, starting in January."Having a chance to reflect on the last 20 years ahead of next year’s birthday celebration, it’s incredible to think about all we’ve accomplished during that time and the amount of kids we positively impacted through their experiences at the Resort," said park General Manager Peter Ronchetti.RELATED: Southern California theme parks ring in the holiday seasonAmong the new additions for 2019, Legoland said it plans to add new attractions and live shows for visitors to experience.One new addition will be a new attraction inspired by "The Lego Movie." The park will host special "Lego Movie" festivities from Feb. 16 - 17 and 23 - 24 around the park ahead of the attraction's opening.The park's resort is also getting a special zone geared toward toddlers modeled after Duplo. The play town will add an express train in the park and kids will be able to ride, slide, and hide in the interactive area.Also being added is a "Lego 4D-Officer in Pursuit" film that will play at the park's theater and new live character shows at the Miniland Stage.It's not exactly clear when the new additions would be opened to guests in 2019. 1458

  

SAN DIEGO (KGTV) - It's a nervewracking place: on stage, behind the mic, looking out at a sea of people waiting for your punch line.The Comedy Palace in Kearny Mesa sees many comedians but not like the one who performed Friday night."It was something I thought about even in college but lacked the courage to do it," said Michael Schmid. "I always loved to make people laugh."Schmid always had the passion, but it was a recent visit to the doctor that gave him the courage he had been lacking."If not now, when," Schmid said.Three years ago, he was diagnosed with primary lateral sclerosis, a condition similar to ALS."It had spread to my upper body and becoming more quadriplegic," Schmid said.One month ago, he made the toughest decision of his life."The most difficult thing I ever had to do in my life was to talk to my children about ending my life."Schmid says he will end his life on December 27, citing severe pain. He shared the date with one of his favorite comedians, along with a dream and a request for help."My initial response was 'We're going to make this happen,'" said Lisa Alvarado.Alvarado talked with some friends in the industry to see if they'd help make Schmid's dream of performing come true."I'm talking comics with Netflix specials, Comedy Central specials," Alvarado said.In one month, the group developed a 15-minute standup comedy routine for Schmid to deliver Friday night. Many of the professional comedians were in the audience as Schmid performed in his wheelchair with Alvarado holding his microphone.After the performance, Schmid's father made his way to the stage to give his son a hug."I never expected him to do that and show the world we're close," said Schmid.Schmid's ex-wife and his four children were also in the audience."No matter how crappy of a hand he's been dealt, he's taken it with a joke," said Schmid's son Joshua.Schmid is grateful he had a chance to laugh."I want my friends and family to have at least that memory when I'm gone," Schmid said. "Do not just give up where you're at...always strive and reach for something else.""Even if it is the end of your life, you can be more than you are right now." 2188

  

SAN DIEGO (KGTV) -- Looking around Barrio Logan, you can't miss the shopping carts, tents and camps belonging to the homeless. Residents of the San Diego neighborhood say the city is turning their community into a "homeless ghetto" - and it's time for it to stop. Tuesday night a group gathered outside the Our Lady of Guadalupe Church, calling on the city to provide "fair distribution of homeless services across San Diego.""It's unbelievable what the mayor and the City Council are doing to this area," said Father John Auther. The priest pointed to a map, asking why a nearly 370 square mile city is putting most of the homeless services in a one-quarter square mile. Father Auther says the concentration of services goes beyond the residents of Barrio Logan. It's bad for the homeless community, too. The area was hit hard by the hepatitis A outbreak.RELATED: Health officials reminding San Diegans about hepatitis A shot "Many of the homeless as we know suffer from addiction problems, alcoholism, mental illness, and what the city has decided to do is put all of them together," Father Auther said. "How will anyone get well?"Right now, city crews are working on a transitional homeless facility in the neighborhood. The facility is going up just 15 feet away from a school playground. A playground closed because of the homeless issue. "We can no longer feel comfortable, feel safe with our students down here on this playground," said Noel Bishop, principal of Our Lady's School San Diego.10News asked a few people in the homeless community two questions: 1.
