SAN DIEGO (KGTV) - A former North County contractor who pleaded guilty to several charges, including grand theft, received a five-year sentence on Monday.Prosecutors said Marc Morningstar owes thousands of dollars to more than a dozen former customers. Team 10 first exposed Morningstar in early 2017 after several people contacted Team 10 about his questionable business practices. Morningstar pleaded guilty to failure to file a tax return, two counts of grand theft of personal property, and using personal identifying information of another person. He also admitted to two misdemeanors—failure to secure payment of compensation and contracting without a license.The judge sentenced him to local custody. He will receive credit for the time he has already served, which was more than 200 days. He also owes 13 victims nearly ,000, according to deputy district attorney Amy Lafer.During the hearing, Morningstar’s girlfriend Maria Meeuwisse requested to address the court. She said she is a victim of Morningstar as well.“He will not be living with me when he gets out, whenever he does get out. He has used my social security number,” she told the judge. Meeuwisse previously pleaded guilty to her role in the scheme, which included a misdemeanor of contracting without a license and failure to secure payment of compensation.Judge Timothy Walsh said that Morningstar has to “rethink the way he approaches his life.” 1430

SAN DIEGO (KGTV) -- A fourth suspect has been arrested in connection with the murder of a 44-year-old in Bay Terraces back in June.San Diego Police say 27-year-old Leaoaisemativa Sandoval was arrested on Dec. 19 and charged with the murder of Sean Nixon. Prosecutors say on June 6, Nixon was strangled with a strap from a marijuana grow tent inside a home on Freed Manor Lane.SDPD officers have also arrested Glenn Montano, Alfredo Sales Montano Jr., and Joshua Barnum. All were booked into County Jail for murder.The District Attorney’s Office says that Glen Montano wrapped the strap around the victim’s neck, while Alfredo Montano struck Nixon multiple times and kicked him while he was being strangled.Two of the suspects, who are brothers, were allegedly running an illegal gambling den and cannabis grow operation at the home. 840

SAN DIEGO (KGTV) — A California couple who operated a charity that claimed to provide goods to San Diegans in need has been sentenced to prison.Geraldine Hill and Clayton Hill pleaded guilty to the charges of conspiracy to commit mail fraud and tax evasion in June, according to the U.S. Attorney for the Southern District of California. Geraldine has been sentenced to 15 months in prison while Clayton was sentenced to 9 months in prison.The couple operated On Your Feet, also known as Family Resource Center. From 2011 to 2016, the pair obtained more than .35 million in donated clothing and other items and claimed the items would be given to the needy, according to prosecutors. The items were supposed to benefit low-income families in San Diego.“While fraud is always wrong, the theft of charitable donations that were to be used to help San Diego’s low income families is particularly disheartening,” said Acting FBI Special Agent in Charge Omer Meisel. “This type of fraud and deceit for personal gain simply cannot be tolerated. The FBI is committed to ensuring that white collar predators don’t prevent those less fortunate from receiving all the benefits that generous donors provide to seemingly legitimate non-profit organizations.”The Hills only donated about ,000 in charitable donations and sold the remaining items, using the proceeds to support themselves, their family, and lavish spending, prosecutors say. Between January 2011 and February 2017, the couple spent nearly 0,000 from personal and charity bank accounts on luxury retail, vacations, entertainment, and vehicles. The Hills then filed false charitable tax returns and did not pay taxes or file personal tax returns for 2013 and 2014, prosecutors added.“Geraldine and Clayton Hill lied to unsuspecting donors about the direction of charitable contributions and engaged in tax fraud to cover their trail,” said Jim Lee, Chief of IRS Criminal Investigation. “Unfortunately, the donors were well-meaning organizations interested in helping the needy and this fraud prevented real people in need from receiving assistance."The couple has also been ordered to serve three years of supervised release and pay ,933 in restitution 2222

SAN DIEGO (KGTV) - A group of Hillcrest residents are fighting a proposed housing tower they say would take the sunshine out of their neighborhood and add traffic. Greystar Development wants to build a seven-story, 111 unit mixed-use housing complex near 7th and Robinson, not far from Whole Foods. The complex would replace the parking lot AT&T employees currently use for the company's building across the street. The lot borders a neighborhood filled with Spanish-style homes. The city gave Greystar a density bonus because it includes nine very low-income units. It also determined the developer would not have to do a costly and time-consuming environmental impact report."Housing, housing, housing is the only thing they're going to consider. And they're not going to consider the impact on the neighborhood that's there," said Tom Mullaney, who heads a group called Uptown United, which is appealing the project. Uptown United is fighting the city's determination that Greystar doesn't have to do an environmental impact report. That goes before the City Council April 23.Mullaney said Uptown United also wants the project scaled back. Jim Ivory, Greystar's senior director of development, said in a statement that company included community input in designing the project, which has the backing of the city's Uptown Community Planning group."We are proud of the design that has evolved in the last 18 months," he said. "Staff and community input has been incorporated along the way for the betterment of the project."Some in the neighborhood also welcome the project. Herbert Ross, who lives down the street, says the AT&T lot has become a public nuisance."The hangout that it's become for people who are homeless who don't clean up after themselves, I think anything would be an improvement to the area," he said. But Michael Bayless says the project would take away the direct sunlight he gets in his home office."I just came from Seattle to escape the lack of sun," he said. "It would be depressing."Greystar's development would also include retail at street level, and a 190 spot parking garage. There are no criminal charges at this time.The two violations CSLB is investigating are a departure from trade standards or specs and willful or fraudulent act.On Wednesday a spokesperson for the CSLB told Team 10 the company notified state officials it plans to shut down and cancel Quality Painting SoCal's license. 1947
