TRINITY, Fla. — Family and friends of a man who recently suffered a fractured skull are speaking out about delays in care from a Florida hospital they believe made his condition worse.On what was supposed to be a fun night playing softball, Donnie Smith's life changed forever.Smith had just thrown a pitch, when a line drive hit him in the head.“Donnie went immediately to the ground,” said teammate Bryan Williams. “Blood was coming out of his nose. You could already see the swelling.”At that point, they knew it was bad.  Another teammate took him to the nearest emergency room, which was at Medical Center of Trinity, about two miles south of the ballpark.  Donnie got to Trinity at 7:46 p.m. local time“You figure a hospital is a hospital. It's there to take care of emergencies,” said teammate Jimmy Sigmone.But not all emergency rooms can handle all emergencies, as Smith's sister Patti Dermer was about to learn.By the time she arrived, a CT scan showed his injury was potentially life-threatening.By 8:20 p.m., they knew he had a fractured skull and a brain bleed.But doctors at Trinity couldn't perform emergency surgery to relieve the pressure.At 9:16 p.m., a doctor signed a transfer order, and a surgical team was placed on stand-by 13 miles away at the Bayonet Point Trauma Center.“There were ambulances sitting outside the door, and they wouldn't put him in it,” said Deremer.As seconds and minutes ticked by, Smith's condition worsened.“He's going gray, sweating profusely, chills everywhere,” Deremer said.She said she was alone with him in an ER Bay for most of the time they were waiting.He was given an ice pack to hold on his head.  By 10 o'clock, Donnie’s heart rate dropped to under 40 beats a minute.“He wound up throwing up blood all over the room. Blood started gushing out of his nose,” Dermer said.Records indicate the ER staff had called for a helicopter, but it couldn't fly due to weather conditions. “It was the longest night of my life,” Deremer said. “Literally, I was out there screaming at people.”By 10:20 p.m., Donnie’s blood pressure spiked and his pulse was dropping.The ER team rushed him to another room and put him to sleep.  Records show that finally at 10:21 p.m., the first call from Trinity was made to Pasco County EMS for an ambulance.It was two-and-a-half hours after Donnie first arrived at Trinity and more than an hour after a doctor signed the transfer order.Donnie finally got to Bayonet Point at 11:25 p.m., four hours after the softball fractured his skull.Friends wish they'd called 911 from the ball field, so paramedics would have taken him where he needed to go the first time.“You can point a million fingers. But the bottom line is he should have got here hours faster than he did,” said Sigmone.Hospital Corporation of America (HCA) owns both Trinity and Bayonet Point hospitals.HCA spokesperson Kurt Conover issued the following statement: 2943

Two of the former owners of Toys "R" Us have agreed to pay million to help laid-off employees.Bain Capital and KKR, private equity firms that owned part of the toy retailer, set up a severance fund to pay former workers who lost their jobs when the company closed its stores.The third owner, real estate firm Vornado, did not join the fund, and did not immediately respond to request for comment.MORE: How the Toys 'R' Us closures massively impact?the U.S.Toys "R" Us filed for bankruptcy a year ago with plans to stay in business. But in March the company's creditors forced it to go out out of business, and the 31,000 remaining employees did not get severance payments.Some top executives at Toys "R" Us received bonuses as part of the bankruptcy process. The nation's bankruptcy laws place limits on the severance payments that can be made to laid-off employees, and they give priority to repaying creditors of the bankrupt companies.Had the employees been laid off before the bankruptcy, they would have been entitled to severance pay of up to one week of pay for every year of service.The million severance fund does not come from Toys "R" Us.The fund was set up following negotiations between the private equity firms and various public interest groups that organized the employees, including Organization United for Respect, Private Equity Stakeholder Project and Center for Popular Democracy."This Fund begins to ensure the hard-working people who spent their lives building Toys 'R' Us and making children happy are not left out in the cold," said Marilyn Muniz, a New York-based Toys "R" employee for nearly 20 years.The groups are seeking additional contributions to the fund from Vornado as well as two Toys "R" Us lenders, Solus and Angelo Gordon, which pushed the company to shutdown operations rather than stay in business. Solus did not respond to a request for comment and Angelo Gordon declined to comment.Tracy Forbes, a former employee who lost her job, told CNN Business that she had worked for the company for 31 years, making her way up to store manager of a Babies "R" Us store in Tempe, Arizona. At the time of the bankruptcy filing she figured she would get about seven months of severance if her store shut down. She said she was shocked when she learned the promised severance wouldn't be paid."It was very difficult," she said. "Here in Arizona, unemployment is only 0 a week. It's not even minimum wage. It was rough. I only got by with friends and family helping me out."After about four months she found a job as an assistant manager of a Home Goods store, which pays less than Babies "R" Us. She said she's kept in touch with the employees who used to work with her at Babies "R" Us."Just about everyone has found some kind of work, but it generally took three or four months," she said. "Some aren't earning as much. Some of the lower-level employees have actually found better paying jobs."The fund has hired attorney Kenneth Feinberg to come up with a formula to determine who gets how much money. Feinberg has made a career deciding distribution to victims of events, such as the terrorist attacks on September 11, 2001, and the BP Deepwater Horizon oil spill. He has proposed that payments go to workers who had been with the company at least a year and who made between ,000 and 0,000 in annual income."In order to maximize the impact of available funds, key eligibility requirements and payment parameters had to be instituted," said Feinberg. Payments are expected to start soon after December 15 and be completed by April.The million fund will not cover a full severance plan for the workers. The employee groups estimate that would take million.The proposed payment schedule provides at least 0 to anyone eligible for payments and as much as ,800 to the top earning employees -- those earning more than 0,000 a year who had been with the company for more than 25 years. U.K. police have appealed for witnesses after a passenger on a European airline made racist remarks about another passenger that were caught on video.The man had threatened to "push" an elderly black woman onto another seat.A crew member of the Ryanair flight from Barcelona, Spain, to London intervened, but the flight took off on Friday with at least one passenger wanting the unidentified man who made the remarks to be booted off the flight.In the footage, a man in a window seat was heard saying he refused to sit next to an elderly woman seated in an aisle seat. The man hurled insults at the woman and called her an "ugly black bastard" before the flight took off, according to a cell phone video recorded by London-based musician David Lawrence.Lawrence posted the footage on social media on Friday."This incident, which we were made aware of yesterday morning, is believed to have taken place on a plane at Barcelona Airport," said the police force in charge of the region round London Stansted airport, where the flight landed."Essex Police takes prejudice-based crime seriously and we want all incidents to be reported. VALLEY CENTER, Calif. (KGTV) - A major San Diego County horse rescue is under fire for how it handles its horses and donations. The founder of Valley Center’s HiCaliber Horse Rescue is accused, in part, of raising thousands of dollars to rescue horses from slaughter, only to euthanize them by gunshot.The controversial nonprofit was just investigated by county officials and now state officials are looking into it.Michelle Cochran founded and runs the rescue, which has more than 150 horses on its property. She is the self-described “bad girl of rescue”, an edgy, foul-mouthed woman with purple streaks in her hair and facial piercings.Her rescue has more than 50,000 followers on Facebook. It’s where she posts videos of her trips to horse auctions, where she begs for money to buy livestock that she says would otherwise be shipped to slaughterhouses in Mexico. She also posts photos of malnourished and injured horses she says she hopes to rescue.Once donations come in, she and her volunteers and the purchased horses return to the Valley Center property. Some of the horses get rehabilitated. Some get shot.“You’re accused of buying horses that can’t be saved, raising money to save them and then shooting them,” we tell Cochran.She responds, “It costs money to save them. It costs money to diagnose them. It costs money to haul them. It costs money to get their [bodies] removed.”She tells us she knows that some of the horses will be euthanized when she purchases them. She calls them “compassion pulls”, horses she says are too sick to rehabilitate, but deserve a more dignified death than slaughter.Her veterinarian is Dr. William Talbot.He explains, “It’s not a pleasant thing but it is done properly and it’s a humane method of euthanasia.”Cochran adds that gunshot euthanasia is safer and faster than lethal injection, which can cause horses to thrash with fear, jeopardizing horse handlers' safety.10News independently verified that gunshot euthanasia for horses is legal in California. On their various social media platforms, Cochran’s critics express their negative feelings about this method, but their real problem is with the horses' living conditions and fundraising practices.“I think she needs to step away,” says Abby Kogler. She’s a professional horse trainer and horse owner who says she’s been on the rescue’s property. “The piles of poop are as big as my house. It’s a pest fest,” she says.Kogler believes money is Cochran’s motivator, adding, “We’re against buying really harmed horses from the abusers and then taking trusting people’s money [when they think] they’re saving horses from nonexistent slaughter pipelines and then [the horses are] just put down.”San Diego County officials tell us there’s no signs of abuse or neglect. That’s according to a recent investigation that was conducted by a contracted third party, since Cochran used to work for the county as an animal control officer.The nonprofit admits it purchased 17 “compassion pulls” last year. It reports it euthanized another 54 that could not be rehabilitated, but that’s out of a total of more than 400 horses it reportedly rescued. It reports it adopted out more than 150 horses.HiCaliber has not filed its 2016 taxes, citing getting an extension after an administrator had a family emergency. We found the rescue's 2015 IRS records, which showed it totaled more than 0,000 in revenue with only about ,000 going to management expenses. The rescue claims it spends up to ,000 a month on operations costs.Cochran acknowledges that she should reduce the number of horses on the rescue’s property and says she’s working on that with the county.The California Veterinary Medical Board is investigating the nonprofit. The California Attorney General’s Office will neither confirm nor deny whether its opened an investigation.HiCaliber reports incoming donations have dropped by 60 percent since it recently came under attack.
