INDIANAPOLIS (WRTV) -- Police say two women climbed in the drive-thru window at an Indianapolis McDonald's and assaulted an employee because they didn't get their chicken McNuggets. Police were called to the restaurant just after 3 a.m. local time Friday morning.The manager told police he was working the drive-thru window when two women pulled up complaining they did not receive their chicken McNuggets. When the manager told the women they didn't order McNuggets or pay for them, even printing out a receipt to show them, the pair tried to order some at the window. The manager told the women they would have to drive back around and order at the signboard and said, "Have a nice day," before turning his back on them to fill other customer orders, according to police. The women then began pounding on the window and honking their car horn, claiming they had been disrespected. INDIANAPOLIS – A veteran and retired postal worker missed his funeral after his remains were lost in the mail delivery process.The ashes of Richard Nelson, who once served in the Navy, remain missing.Years after leaving the military, Nelson headed for Arizona and left specific instructions to his family on how he wanted services handled following his death.In July, the funeral home in Arizona mailed Nelson’s remains on August 1, and the tracking number stated it was to arrive in Indianapolis on August 2.Nelson’s nephew, Scott Hare, had plans to drive the ashes to Michigan for services – but he never received the package.The memorial service went on as scheduled and the cemetery plot next to his parents had to be refilled until further notice."I have to keep telling people I don't know anything, there's no closure,” said Hare.Hare said his moments of sorrow were overcome with pride.“At some point, I had to laugh,” said Hare. “He retired from the post office and was lost at the post office. In the summer of 2013, Aimee Stephens sent her employer a letter explaining she was about to change her life. She was a transgender woman, and she intended to start dressing as such at work.She never expected then that she was about to enter into a yearslong legal dispute, one that might soon become a litmus test for lesbian, gay and transgender rights before the next US Supreme Court.Stephens had spent months drafting the message to management at R&G and G&R Harris Funeral Homes, a family-owned business in the Detroit area, she says. She was 52 years old at the time, and she had spent her entire life fighting the knowledge she was a transgender woman, to the point that she had considered ending her life.Now that she was coming out at work, she hoped her nearly six years of positive performance reviews, which had earned her regular raises, would count in her favor.But her boss, a devout Christian, told her the situation was "not going to work out," according to court documents. Thomas Rost offered her a severance package when she was fired, but she declined to accept it.She filed a complaint with the Equal Employment Opportunity Commission, the Department of Labor's enforcement agency, and the government sued the funeral home. The department accused the funeral home of firing Stephens for being transgender and for her refusal to conform to sex-based stereotypes.A district court agreed with the funeral home that the federal workplace discrimination law known as Title VII did not protect transgender people. But it found that the funeral home did discriminate against Stephens for her refusal to conform to its "preferences, expectations, or stereotypes" for women. The EEOC appealed.The 6th Circuit Court of Appeals ruled in favor of Stephens and the EEOC in March. The funeral home's lawyers accused the court of exceeding its authority by expanding the definition of sex in a way that threatens to "shift" what it means to be a man or a woman.In July, lawyers representing the funeral home asked the Supreme Court to take up the case to determine if transgender individuals are protected under Title VII's sex-based provisions. If the court takes up the case, it could have broader implications for the definition of sex-based discrimination. And it could impact case law that precludes firing anyone -- gay, straight or cisgender -- for not adhering to sex-based stereotypes."The stakes don't get much higher than being able to keep your job," said Harper Jean Tobin, director of policy for the National Center for Transgender Equality. "Harris Funeral Homes is a stark example of the job discrimination that so many transgender people face."Advocates say it's one of the most important current civil rights issues for the transgender community, along with similar considerations in education and health care. And they say it has been settled by years of case law. In the past two decades, numerous federal courts have ruled that federal sex discrimination laws apply to transgender and gender-nonconforming people, including Title VII, the Title IX education law, and Section 1557 of the Affordable Care Act.But lawyers from the Alliance Defending Freedom, the conservative Christian nonprofit representing the funeral home, say it's far from settled."No court or federal agency has the authority to rewrite a federal statute. That power belongs solely to Congress. Replacing 'sex' with 'gender identity,' as the 6th Circuit and the EEOC have done, is a dramatic change," senior counsel Jim Campbell said in a statement."What it means to be male or female shifts from a biological reality based in anatomy and physiology to a subjective perception. It's no secret that smoking and secondhand smoke are not good for your health. But a new study shows just how detrimental secondhand smoke is for children. "In past studies, we found up to nearly one-in-two children who come to the pediatric emergency department are exposed to tobacco smoke," said Dr. Ashley Merianos, an associate professor in the School of Human Services at the University of Cincinnati. Dr. Merianos led the study, comparing 380 children living with a tobacco smoker with 1,140 children who are not. The ethnically diverse study found that the children exposed to secondhand smoke at home were more likely to be hospitalized."We also found that the children who had been exposed had increased respiratory-related procedures, increased diagnostic testing. So, for example, being tested for the flu and laboratory testing, as well as radiologic testing, including x-rays of the chest and lateral airways," said Dr. Merianos.The children who were exposed to secondhand smoke were also more likely to be prescribed medications like steroids or inhalers. "Our findings highlight the need to universally screen for tobacco smoke exposure during every pediatric healthcare visit and provide interventions to reduce and prevent exposure among patients and their families," said Dr. Merianos.Dr. Merianos says intervention is key since hospital emergency departments mostly treat underserved patients with high tobacco use and limited access to information about quitting."I think right now, with the COVID-19 pandemic, there has never been a better time to quit. And the reason I say that is we know that there is emerging evidence that both smoking and vaping make it more likely that you have COVID and more severe COVID symptoms," said Dr. Susan Walley, the Chair of American Academy of Pediatric's section on Nicotine and Tobacco Prevention and Treatment. Dr. Walley says she's not surprised by the results of the University of Cincinnati's study, adding that secondhand smoke exposure has short-and-long-term health effects on children."Children who have secondhand smoke exposure are more likely to have ear infections, pneumonia, asthma and if they have asthma, more likely to have more severe asthma attacks like we see in this study," said Dr. Walley.Dr. Walley says children exposed to tobacco smoking parents or older siblings are also more likely to smoke themselves as they get older. Doctors hope the study highlights the importance of encouraging parents to quit tobacco use for good, for the sake of their own health and the children they love. 2581
