SAN DIEGO (KGTV) – A verdict has been reached in the trial of a former Yuma Police officer accused of raping his then-wife's cousin in 2017.Jurors found 34-year-old Jared Elkins guilty of four felony counts, including forcible rape and sexual penetration by force. Elkins was found not guilty, however, on four similar counts involving an intoxicated victim."I'm extremely pleased with this jury and their verdicts," said Deputy District Attorney Lisa Fox."The fact that he was a law enforcement officer and carried a weapon was significant for the victim in this case she believed that he would carry through with these threats and why she was so afraid of him," argued Fox.Elkins was taken into custody without bail following the reading of the verdict. The group had been out to dinner, then watched a movie while drinking beer and wine at the home. That night a 23-year-old woman, related by marriage, says Elkins forced her to have sex while other family members were asleep in the house. Elkins claimed during testimony this month that the sex was consensual and the rape charges were made out of guilt.Following the encounter, the woman says she ran to her mother's room and both escaped out of a window. SAN DIEGO (KGTV) - A transgender San Diegan is calling for change when it comes to blood donation.Currently, the FDA’s recommendation to blood establishments is that in the context of the donor history questionnaire, male or female gender should be self-identified and self-reported for blood donation.Van Levy of Pacific Beach is non-binary transgender, meaning Van does not identify as male or female. Van goes by gender-neutral pronouns like 'they', 'them', 'their', or just Van.Van tells 10News when they reached out to the San Diego Blood Bank, they were told they would not be able to donate if they could not fully complete the donor history questionnaire, which has two gender-specific questions. Van was told if they cannot fill out 'male' or 'female' on the questionnaire they would not be able to donate blood. “It was really hurtful and painful, it reminded me we haven’t progressed as much as a lot of us like to believe we have, it just hurt," said Van. The two gender-specific questions are, in the past 12 months, have you:Male Donors: Had sexual contact with another male?Female donors: Had sexual contact with a male who had sexual contact with another male in the past 12 months?Helen Bixenman is Vice President of Quality and Regulatory Affairs at the San Diego Blood Bank. She's in charge of making sure blood from the San Diego Blood Bank is safe and pure, free from transfusion-transmitted infections. “It’s important for people to understand we have a wide range of questions, and these questions pertain to the safety of the donor as well as the safety of the blood products. They include medications, how you’re feeling, travel, risk behaviors," said Bixenman.She says they must adhere to the strict regulations and requirements of the FDA and AABB. She says if anyone fails to fill out the entire donor history questionnaire they will be turned away from donating blood.Van wants to see this regulation changed and believes it marginalizes a group of people who only want to help their community. “I definitely understand the rules and regulations that they have to adhere too and I think that there's ways to remove gender from the questions to get to same answers they’re seeking to protect people receiving blood," said Van. Bixenman says the San Diego Blood Bank does not want to turn people away from blood donation. She says this is the first time they've encountered the situation and that she would consider bringing the issue up to advocacy groups and the FDA. 2505

SAN DIEGO (KGTV) -- A warning for all homeowners after what looked like a yard sale turned out to be an elaborate theft. Several men staying in a vacation rental near La Jolla pulled up in a moving truck, stealing everything inside. Surveillance cameras caught men moving things through a Birdrock-area garage and into a truck, but the men aren’t movers. They were reportedly staying in the vacation rental, but according to the homeowner had checked in using fake credentials, fake credit cards and fake IDs. "As soon as I found out I went and told all of my employees, and will definitely spread the word that there is a crew going around doing something like this,” said Tyler Trowbridge, a contractor at Trowbridge Custom Floors.Trowbridge is a contractor working in the neighborhood. He’s had tools stolen while working at home and knows how the homeowner is feeling. "You don't wish it upon anybody, it's their personal belongings and their home was invaded. It's a breach of privacy and an invasion in your world."In this case, it wasn’t small belongings either. The owner says the men cleared the place out, taking everything from furniture and TVs to the stove. "When I talked to the actual owner, it was a lot more intense than I thought."What’s more, the owner says meth was left inside. "The fact that there were drugs in the house too, leads me to believe that it might happen again too."La Jolla Vacation Rentals is the property manager. 10News asked them for an interview, but they wouldn’t do it. The homeowner and a contractor warning the neighborhood to watch out. "It's just sad that there are people out there that take advantage of these situations." 1680

SAN DIEGO (KGTV) - A thief struck an ugly chord with residents in a Del Cerro neighborhood, after zeroing in on a porch and warming up his pipes.    Just off College Avenue, Katherine - who asked us not to reveal her full name - says the first feeling was confusion when she and her husband returned home from Julian on Saturday night.  On their porch, the couple says they found an opened letter addressed to a man in El Cajon. When they looked at the surveillance video, they saw him:  a casually dressed man pulls up in a pickup truck.            "He is holding the letter so he has a plan, a story if anybody stops him," said Katherine.On the video, the man heads right for the package at the front door and swipes it.  He throws the package in the truck, tosses the letter and as gets back into the truck, he appears to belt out a note.  As he backs out of the driveway, he keeps on singing."The singing clearly shows he's completely comfortable, really cocky...just going to his next gig.  I think it's his weekend job," said Katherine.Katherine can't help but smile about the likely sour note he experienced once he looked inside and found - a dog brush and mug.  Now she's hoping the video will lead to an arrest."He's clearly done this before.  No doubt he's out doing this again," said Katherine. 1414
