WASHINGTON (AP) — A federal appeals court said Thursday it plans to review a decision ordering the dismissal of the Justice Department’s case against former Trump national security adviser Michael Flynn.The action by the U.S. Circuit Court of Appeals for the District of Columbia is likely to prolong the fight over Flynn’s fate and represents yet another dramatic development in a case that has taken unexpected twists and turns over the last year and turned Flynn into something of a cause celebre for President Donald Trump and his supporters.Flynn pleaded guilty in 2017 to lying to FBI agents about his conversations with a Russian diplomat ahead of the inauguration of President Donald Trump.The court set arguments for Aug. 11. It did not offer an explanation for its decision in a brief order posted online, saying only "FURTHER ORDERED that oral argument before the en banc court be heard at 9:30 a.m. on Tuesday, August 11, 2020. The parties should be prepared to address whether there are 'no other adequate means to attain the relief' desired."A three-judge panel of the court ruled 2-1 last month that U.S. District Judge Emmet Sullivan had overstepped his bounds by not granting the Justice Department’s request to dismiss the case against Flynn.The Justice Department in May moved to dismiss the case against Flynn, one of the signature prosecutions of special counsel Robert Mueller’s investigation into Russian election interference.The motion followed a review by a U.S. attorney appointed by Attorney General William Barr to scrutinize the case.But rather than immediately dismiss the case, Sullivan appointed a retired federal judge to argue against the Justice Department’s position and to consider whether Flynn could be held in criminal contempt for perjury. Flynn’s lawyers asked the appeals court to step in and order Sullivan to grant the department’s request. 1894

VISTA, Calif. (KGTV) -- California could become the first state in the nation to use recycled plastic as part of its roads and freeways.The state Senate unanimously passed SB 1238, which directs Caltrans to study the use of plastics in asphalt for construction, or repair of a state highway or road."There's no other state in the nation that has more paved roads in California," said Sen. Ben Hueso, who wrote the bill. "So, imagine if California developed the use for a product that it's abundant in … This would be a game changer. This would be a great way to reuse plastic.”That's especially important now, as China has stopped buying recycled materials from the U.S. Prior to 2018, California sent 2/3 of its recyclable materials to China, which has since banned all plastic trash imports.Now, instead of going into the landfill, it could go into California’s roads."It would help create jobs in our state. It would help a local contractor that we have in our county, it would help improve the sturdiness of our roads and reduce the maintenance of our roads," said Hueso.Hueso said he got the idea from a group of students at Bonita Vista High School in Chula Vista. He met with their Progressive Club and Green Club, challenging them to find solutions.The students introduced Hueso to MacReber Southern California, a Vista company that takes plastic and prepares it to be used in asphalt."It makes too much sense not to do," said MacReber CEO Rebeca Sparks. "With this technology, we can truly offset our footprint, and not only offset it but be do more than that to be plastic positive."MacReber takes plastic out of the recycling and landfill chain, and then processes it. The company then sells the plastic to asphalt companies. They use the plastic mix instead of oil when making asphalt.MacReber said in addition to being more environmentally friendly, it also creates a stronger, sturdier road."It's going to look feel and move the same as a traditional asphalt," said MacReber President Chris Sparks. "But our product lends to a stronger, longer lasting asphalt road."Hueso said finding a use like this for all of the plastic waste produced in California is vital to the environment, especially now that China has stopped buying the state's plastic waste.The bill still has to get approval from the state Assembly, and then it would need the governor’s signature to become law.After that, Caltrans would be responsible for studying and implementing the idea. 2478

WASHINGTON — Retiring U.S. Senator Lamar Alexander, R-Tennessee, gave his farewell address from the Senate floor Wednesday morning, urging for a "change of behavior."Alexander is retiring after more than 40 years in public service. During his farewell remarks, he called for bipartisanship among what has been a deeply divided Senate over the past decade."Divided government offers an opportunity to share the responsibility — or the blame — for hard decisions," Alexander said. "That's why our country needs a United States Senate, to thoughtfully, carefully and intentionally put country before partisanship and personal politics, to force broad agreements on controversial issues that become laws most of us have voted for and that a diverse country will accept."Alexander also offered a defense of the filibuster, the parliamentary rule that allows a minority party to block legislation. He says the rule forces the Senate to work together to solve problems as opposed to allowing one party to dominate the chamber.Some progressive Democrats have floated eliminating the filibuster in the hopes of passing more legislation.Alexander's career began in 1978 when he famously walked more than 1,000 miles across Tennessee to make his case to be governor. He served two terms as the state governor and later took the helm at the University of Tennessee. He also served as President George H.W. Bush's Secretary of Education.Alexander has served as a senator since 2002. WASHINGTON — A member of the White House coronavirus task force says the increase in U.S. cases isn’t just because of more testing.Admiral Brett Giroir of the U.S. Public Health Service Commissioned Corps. says the proof of the increase is the uptick in hospitalizations and deaths nationwide from COVID-19, the disease caused by the coronavirus.Cases of the virus are spiking across the country, particularly across the upper Midwest. Last week, the U.S. recorded two days of record increases of new COVID-19 cases.President Donald Trump has been saying the U.S. is “rounding the turn” on the pandemic. The president also contends the news media are spending too much time focusing on the health crisis.However, a model by the Institute for Health Metrics and Evaluation at the University of Washington — a model routinely cited by the White House — notes that hospital resource use has risen steadily in recent weeks and is projected to spike in the coming days.Giroir, who was put in charge of coronavirus testing by Trump, says the nation is at “another critical point” in the response to the pandemic.He is urging people to keep wearing masks, wash their hands and practice social distancing. Giroir says a safe and effective vaccine is “around the corner.” 1270

  

Video obtained by Fox News shows Speaker Nancy Pelosi inside of a San Francisco salon getting her hair styled amid a citywide restriction on salons from being open during the coronavirus pandemic. While it appears Pelosi and the eSalon may have violated the city’s order on Monday, a spokesperson for Pelosi claimed that the speaker did not violate the city’s mandate.In the video, Pelosi is seen without a mask over her mouth or nose while inside the salon.“The Speaker always wears a mask and complies with local COVID requirements. This business offered for the Speaker to come in on Monday and told her they were allowed by the city to have one customer at a time in the business. The Speaker complied with the rules as presented to her by this establishment," Drew Hammill, deputy chief of staff for Pelosi, told San Francisco’s KTVU.On Tuesday, the city began allowing salons to open for outdoor operations, while continuing to prohibit operations indoors.The salon’s owner Erica Kious told Fox News that she released the video of Pelosi’s visit to show a double standard in California’s plan to reopen amid the pandemic.“It was a slap in the face that she went in, you know, that she feels that she can just go and get her stuff done while no one else can go in, and I can’t work,” Kious told the network. Kious said that the stylists rent a chair at the salon, and work independently. Kious told Fox News that one of the salon's stylists received a message from Pelosi's assistant Sunday to confirm the Monday appointment.The Trump campaign immediately tried to capitalized off of the Fox News report. 1617
