SAN DIEGO (KGTV) — The downtown building at 101 Ash Street has been sitting vacant for most of the last four years and as it continues to sit empty, taxpayers are footing the ,000 per day bill.City Council leaders voted 5-4 — with Council members Vivian Moreno, Monica Montgomery, Barbara Bry, and Georgette Gómezto voting in opposition — to request monthly updates on the building's status and costs for several options presented by Mayor Kevin Faulconer's office.The mayor's options included putting millions of dollars more into the building for the needed repairs, buying out the lease, pursue a new landlord, trying to renegotiate its lease, or walking away entirely, the last of which could risk litigation and credit damage.The coronavirus pandemic has cleared out office buildings across downtown San Diego. But emptiness is business as usual for the old Sempra building at 101 Ash.In 2016, the city approved a lease-to-own agreement for the building, valued at million. The idea was to move upwards of 1,100 city employees into the facility.But officials quickly discovered a series of problems requiring major renovations to the site's 19 floors.In December 2019, the city finally began moving workers into the building, only to vacate them a month later when the county found traces of asbestos.So how did the city get into this mess? A new investigation shows it really never did its homework for such a big purchase from the start.The law firm Hugo Parker found that, "at no time, however, did the city formally inspect 101 Ash before closing escrow."In January, councilmember Barbara Bry showed ABC 10News a document that the city accepted the property as is."That is stupid to do when you are doing a long-term lease purchase on a building that was built in the 1960s," Bry said.An additional new report from Kitchell says the building needs 5 million of repairs, which is well more than what the city paid for it. 1947

SAN DIEGO (KGTV) — The COVID-19 pandemic has been tough on kids, as they have been stuck at home for school and for play. However, a second-grader from the College Area is putting his time to good use. Seven-year-old Max Kelley came up with an idea to help feed those in need. Max and his younger sister Lucy were playing out in the backyard when he approached his mom with an idea of wanting to start a business."He wanted to do a water recycling business," says his mom Lauren. "So we went around collecting water bottles and cans. We went around to high schools, the bay, and the beach. Every week, we would return it to the recycling center, and we would get the money."And while some kids might take the money to buy something for themselves, Max wanted to do something completely different, and completely unselfish. His first thought was to think of others, and how the money might benefit somebody else."I realized that there are people in need," says Max. "And need food and water." His mother wasn't surprised at all, describing her son as very caring."He came up with the idea himself, and that was to donate the money to a local food bank," Lauren said.So the day before Thanksgiving, Max, Lucy, and the family donated their collection of 8.43 to the Special Delivery Food Bank in Mission Hills. "My family and the kids all got a standing ovation from all the patrons that were there," says Lauren.One check has been delivered, but Max is definitely not finished giving to those in need. As he and Lucy have plans to raise even more money for the food bank. "It made me feel happy," Max said. 1616

SAN DIEGO (KGTV) -- The battle over the Crossroads of the West Gun Show continued Tuesday in Del Mar.The Board that oversees the fairgrounds is reviewing the show that has been hosted at the fairgrounds for the last 28 years.A pro-gun, second-amendment political action committee collected more than 3,100 letters in support of continuing the show in Del Mar.The letters were given to the board for review and consideration. Michael Schwartz, Executive Director of the San Diego County Gun Owners is pushing is pushing for the board to renew the shows contract with no restrictions or limitations."It took us less than a week to collect all these signatures, we could have gotten more. Some are written by entire families who come to the show every year. It is a family event with almost a 30 year history with Del Mar," said Schwartz. Protesters also made an appearance at the board meeting dressed in orange and asking the board to cancel the shows current contract.The Del Mar, Solanna Beach and Encinitas city councils have approved resolutions calling for a ban on the gun shows at the fairgrounds.Guns can be purchased at the show, but California law requires extensive background checks and a waiting period.The board will make a decision to cancel or continue the gun show at it's board meeting in September. 1329

SAN DIEGO (KGTV) — The California Center for the Arts, Escondido will host drive-in live concerts and a movie series this month.The concerts and movie screenings will be held at the former Nordstrom parking lot at Westfield North County at 8 p.m. Spaces for more than 250 vehicles will be made available and spaced apart to keep listeners distanced.The scheduled shows start on Aug. 14 with a showing of the classic musical Grease and continue on Aug. 15 and 16 with a performance by Jersey Boys stars Christian Hoff and Travis Cloer. Hoff, a Tony Award-winning actor, is best known for his portrayal of the role Tommy Devito from the Four Season’s and Cloer is the longest-running actor to play the role Frankie Valli in Jersey Boys.Tickets to the general public will go on sale on Aug. 1 at 1 p.m. here or by calling 800-988-4253. SAN DIEGO (KGTV) -- The brother-in-law of a woman killed in a murder-suicide in Paradise Hills spoke to 10News about her relationship with the father of her young sons.On the morning of Nov. 16, 29-year-old Sabrina Rosario and her four sons were shot by the boys' father in a home on Flintridge Drive, according to San Diego police.Rosario and three of her sons died, and the boys' father -- identified as 31-year-old Jose Valdivia -- shot himself to death after killing the family members.As of Sunday afternoon, Rosario's 9-year-old son, Ezequiel, was in an induced coma at Rady Children's Hospital.RELATED: Parents, 3 children killed in Paradise Hills murder-suicideKarl Albright, Rosario's brother-in-law, told 10News, "No one thinks it's going to happen until it's happened."Albright said he has so many questions about what led Valdivia to gun down his wife and children. According to Albright, Valdivia's infidelity broke Rosario's heart a year ago, and she decided to end things."She had made her mind up that it's over, and he didn't want to accept that," Albright said. "He wanted it back. And he tried to, the love way, and then he tried the fear way, and he tried every way in between to try to break through, but she stood her ground."Albright said Valdivia's threatening texts and stalker behavior escalated six months ago when he bragged about purchasing a gun.Albright explained Valdivia would tell Rosario, "I'm going to come over and kill myself in front of you guys. I'm going to kill you guys, then kill myself."Rosario told him that he sounded like the boy who cried wolf, according to Albright.A records search shows two cases of domestic violence in 2019. On Nov. 15, police said Rosario spent the whole day at court obtaining a restraining order against her husband.When he called that night, she told him she had no other choice. He never called back.Albright said she told him that their problems would be solved, and her children would be safe."Even what they were living in, and what she was going through in the house, she had an umbrella over the kids, and it never fazed them," Albright said.Instead, the next morning, police said the children's father came into the granny flat on Flintridge Drive and shot his wife and four children in the head before shooting himself.Rosario and 3-year-old Enzi died at the home. Five-year-old Zuriel, 9-year-old Ezequiel, and 11-year-old Zeth were rushed to the hospital. Zuriel and Zeth did not make it.Life will never be the same for relatives who live next door."Now that Thanksgiving is coming up and Christmas. We've already got Christmas gifts for the kids and for her," Albright said.Those gifts will remain under the tree in their honor."They were fun-loving. They were well-raised.
