SAN DIEGO (KGTV) — A North Park gym owner who defied the governor's health order and moved workouts indoors was served with a violation notice from the county, threatening ,000 daily fines. Owner Frank Kole initially complied with last month's order and moved everything outdoors, but after five days made the decision to go back inside. That's because he says the sidewalks outside his gym were littered with feces, blood stains, and trash. Kole instead instituted strict rules indoors, requiring masks and social distancing. But the county, while acknowledging the tough reality outside, still served him with the violation, saying it was the law. Immediately, he and his staff discovered a syringe on the sidewalk as they were setting up equipment. The city of San Diego power washed the sidewalk on Wednesday, but Kole says it was a quick job without trash pickup. "If we weren't out there cleaning that sidewalk up everyday, that needle would still be there," Kole said. A spokeswoman for the city of San Diego says environmental crews will pick up syringes with biohazard boxes when they encounter them. In the meantime, residents can report the on the city's Get-it-done App. Kole says he will comply with the order and keep the gym outside, even if it means reduced hours and more staff time moving everything in and out everyday. "I'm a proud American and I'm a proud business owner and I will do what it takes to keep my business alive," Kole said. SAN DIEGO (KGTV) -- A Marine killed in a motorcycle crash on I-15 Friday has been identified as 21-year-old Logan Parkhurst.The crash happened in the southbound lanes of Interstate 15 near Miramar Way just after 6:30 a.m.According to the California Highway Patrol, Parkhurst hit the back of a Toyota while attempting to exit onto Miramar Way, causing him to be ejected. SAN DIEGO (KGTV) -- A man suffered serious injuries after a scooter crash on the Mission Beach boardwalk late Tuesday afternoon. According to police, the crash happened around 4:30 p.m. near Ocean Front Walk and San Luis Obispo Place. Authorities say a 55-year-old man on a bicycle and a 27-year-old man on a scooter collided on the boardwalk."His bike was upside and he was just laying there," said Nicole Ryujin, who saw the aftermath. "He wasn’t moving and at first I was like, 'is this guy okay?'" Police say the 55-year-old was taken to the hospital with serious injuries, but not life threatening. According to police, the 27-year-old didn't suffer any injuries. Investigators say the scooter rider was headed north on the boardwalk, and the biker was headed south, when they collided. At this time, it's unclear exactly what led to the crash. Traffic investigators questioned the scooter rider on scene. Investigators say there is no criminal investigation at this time. 987
