SAN DIEGO (KGTV) — A new political party is accused of tricking some San Diego voters into joining them.San Diego Registrar of Voters' Michael Vu told 10News he has referred the matter to the District Attorney and the Secretary of State's Fraud Investigation Unit.The Common Sense Party was founded by former Republicans and is currently attempting to get the 67,000 signatures needed to appear on future ballots as an state-recognized political party. A co-founder told 10News the party hired a third-party company in San Diego to help gather the signatures.RELATED: Early voting begins in California Primary as San Diego County sends out mail ballotsHowever, as first uncovered in an investigation by 10News media partner KPBS, dozens of San Diego voters who are registered for the Common Sense Party say they did not remember signing up and, in fact, had not even heard of the party.Some said the signature gatherer told them they were signing a housing petition. Others said they were given a voter registration form that did not include a place to indicate party preference. When KPBS obtained the form that had been filed by the signature party gatherer for one of the voters, she said she hadn't made any changes. "Oh, no. This is not something I recognize. That is not my handwriting. I don't remember signing this form out," SDSU student Kameron Dollinger said.Julie Meier Wright, a well known civic and political leader who helped found the Common Sense Party, told 10News they are shocked by the accusations and are working to get to the bottom of what happened. 10News left a voice mail for the signature gathering company, but has not heard back.Vu urges all San Diegans to check their registration online before going to vote, in order to ensure that they will get the proper ballot. 1805

SAN DIEGO (KGTV) -- A La Jolla store in an upscale mall is facing scrutiny from customers who told Team 10 they were misled after buying hundreds—even thousands—of dollars worth of skin care products.Team 10 spoke to at least two customers who had similar complaints. When they tried to return unopened products, they said they were sold lies.Christianna Ortiz regrets walking into Gold Elements at the UTC mall on La Jolla Village Drive.“I’m honestly very embarrassed I fell for it,” Ortiz said.Last summer, she said Gold Elements employees encouraged her to purchase products, including a skin care regiment.“He wanted me to buy it for 0. I said yeah, that's not going to work. He said I'll tell you what, I'll throw in a facial and I was like, now that sounds interesting, but I don't want to come here alone. I'll throw in two facials,” Ortiz said the employee told her.When she went to her appointment, she said employees would not give her the facials she paid for.“I said, I want to return the stuff then and he said no return.I said I paid for something that was an outright lie,” Ortiz said.Ortiz said they never told her there was a no refund policy.She disputed the charge with her credit card and could not believe what happened next.“They sent me back the copy of my receipt along with another sheet of paper that listed the refund policy. I had never seen that sheet of paper, didn't exist!” Ortiz said.“You’re hustled,” said Sharon Garrow, another Gold Elements customer.Garrow spent nearly ,500 on products in September. She admits spending more than she should. When she tried to return the products the following morning—less than 24 hours later—she said she was not allowed to.She went to the store Saturday, where she said an employee told her there was nobody who could help her. She went again on Monday. “He [said] there’s no return on [these] products,” Garrow said.It was on her receipt, but like Ortiz, she signed on a computer and said the policy was not visible on the screen. She said nobody told her anything in person and there were no signs in the store that customers could see.A Team 10 investigative photojournalist also visited the store. He also did not see any return policies in the store.On the California Attorney General’s website, it says: “Stores that do not accept returns must clearly display their policy.”The California Civil code states that retail sellers shall display their policy “either on signs posted at each cash register and sales counter, at each public entrance, on tags attached to each item sold under that policy, or on the retail seller’s order form, if any.”Goods that cannot be resold due to “health considerations” are an exception. Both women said they never opened the Gold Elements boxes before trying to return the items.When Team 10 visited the store to get answers, there were no managers available to talk to us. An independent esthetician told Team 10 to contact a Gold Elements promoter. That person did not call back.Less than an hour later, a man who claimed he was the owner called Team 10 and said they always give the best help to customers and have not had problems with refunds. The man would not agree to an in-person interview, saying that he was not in town.He told Team 10 all future communication would be with his lawyer, but would not give his lawyer’s name.It was a different story on the Better Business Bureau website, where the store has an F rating. A 2017 class action lawsuit filed in Northern California against Gold Elements products and affiliated companies.Part of the complaint was that “complimentary facials” were not honored when customers tried to use them.““If I got taken, so many other people are probably getting taken. Somebody has to stop it,” Ortiz said.Team 10 discovered the La Jolla store could also be violating different state code.On Gold Elements’ wall is a price list for facials. The Board of Barbering and Cosmetology, under the California State Department of Consumer Affairs, said a business that charges for facials should have an establishment license.The store has no record of that license.The women have a warning for others.“It’s not like I’m a dummy,” Ortiz said. “Do what I usually do. Check reviews ahead of time.”The Attorney General’s office said if any customers have concerns about a return policy, or lack of one, you can file a complaint with their office. 4419

SAN DIEGO (KGTV) - A local woman says a water meter device in the Midway District has been leaking gallons of water for at least two years, but no one will fix it. She emailed Team 10 investigative reporter Jennifer Kastner after contacting multiple government agencies to report the wasted water. The backflow device sits just off of Sports Arena Boulevard. When 10News visited it last week, it was dripping steady streams of water.“It’s a problem,” says Diane Ang, who works nearby. She says there's so much leaking water, that the surrounding transient population uses the water to fills up their bottles. Containers of shampoo and soap wrappers are scattered around. Ang tells 10News that people bathe in the water. At one point, she says, people grew a garden next to the device because the ground was so saturated with water. “[They had] tomatoes and some other vegetables,” she adds.There's no property tag on the device, so Ang called the City of San Diego at least three times but couldn’t get any help. She filled out multiple requests for assistance on the City’s "Get it Done” website, but there was no resolution. She was told the backflow device might belong to the Navy. She tells us that she made several attempts to get in touch with someone at the Navy. She says she spent at least two or three years trying to get the issue fixed. “No one cares. No one cares,” she adds.10News wanted to know how much water was leaking, so we timed one of the flowing streams using a measuring bucket. What we discovered was that thousands of gallons of water may have been wasted in the last few years. We took our information to Mathnasium of Point Loma. The math tutoring company found that 21,000 gallons would have be lost in one year alone, assuming the water had been leaking at the same rate, continuously. “It’s such a huge waste,” says Ang. 10News contacted the City of San Diego. A spokesperson directed us to the Navy. A weeks ago, we reached out Naval Base Point Loma. This Tuesday, a media spokesperson for Naval Base Point Loma sent us an email which reads, “We appreciate everyone who took the time to bring this leak to our attention. Our Naval Base Point Loma Public Works team is taking action to fix the leak today. Conserving our natural resources is a high priority and is very important to all of us at Naval Base Point Loma. We encourage active participation by contacting us directly at nbpl_pao@navy.mil or use the “Get-It-Done San Diego” app for the City of San Diego. [It] is a quick way for anyone in the community to report service issues (street lights, traffic signals, trash recycling, sidewalks, street flooding, etc.)” 10News verified that the leak has been addressed. SAN DIEGO (KGTV) - A Harley-Davidson owner is hoping for leads after his motorcycle disappeared from a mall parking lot in Mission Valley.Sebastian Rudi, who works at Westfield Mission Valley, was expecting to see his newly purchased 2002 Harley after his shift ended around 10 p.m. Saturday. Instead the bike that was parked in the underground lot, feet from the ramp into the mall, was gone."A little panic ... mixture of anger and pure disappointment," said Rudi.MAP: Track crime happening in your neighborhoodThat may actually an understatement. The ,000 bike he bought in April was his pride and joy."I spent my entire life wanting a Harley. Spent every cent to my name on a Harley. Everything that I had going for me was pretty much relying on that bike and now it's gone," said Rudi.Gone and with few clues. He says the few cameras in the area don't face where his bike was parked. According to Crimemapping.com, it's the second vehicle theft since January.At Fashion Valley mall, there have been 11 vehicle thefts in the immediate area since December. Rudi points out thieves must love one fact about the vehicles of many shoppers and workers."They know it's going to be there for awhile, throughout the day," said Rudi.Rudi regrets not immediately installing all the security he planed, including wheel locks and a GPS locator. SAN DIEGO (KGTV) -- A runaway boat became lodged on rocks after taking off while the owner was trying to dock the vessel Monday afternoon.Captain Tony Olson with TowBoatUS San Diego said a man sailing from Harbor Island was trying to dock at Shelter Island when the boat took off.According to Olson, the man was trying to tie the boat off with the sail partially up and the motor running, causing it to take off without him.The 35-foot vessel became lodged on rocks at the Naval Base.It took a while for the boat to become dislodged. Olson says there doesn’t appear to be any major damage to the vessel.Olson noted that this is one of several boats that ran aground Monday.A 19-foot vessel, pictured below, also smashed into rocks at the foot of Point Loma. The Coast Guard warned people traveling through marine channel 16 of the boat that ran aground.  872
