SAN DIEGO (KGTV) -- At 14 stories high, The tower apartments in downtown San Diego have some nice views. But when you're trying to get down without an elevator - it can be a challenge. Carol Clark says she was left with no choice but to take the stairs from her 13th-floor apartment to go the grocery store on Thursday afternoon. "I did it today but trust me I was breathing heavy when I came in," she said. Clark is one of the 200 senior residents living in the high rise building - a building designated for people over the age of 65. The residents say they've lost count on how many times they elevator has gone out. That's why they decided to call 10News for help. Although the second elevator was working when 10News arrived, residents tell us that wasn't the case for most of the day. They say it's something that happens a lot lately. "There are people here with walkers and wheelchairs," Clark said. "I'm scared to death for them."One neighbor in a wheelchair broke down in tears during our interview. "It's people's safety," he said. "Not just mine, but everybody else."The building is undergoing renovations - which residents say they appreciate. But they say the upgrades don't make it ok to shut down one of the two elevators and leave them with an elevator that they describe as unreliable at best. "Everybody is extremely upset," Clark said. "And the thing is we don't seem to be getting many answers."The residents told 10News they've taken their concerns to management many times but have seen no changes. They say they hope something is done soon, before an emergency happens and it's too late. 10News called the on-site manager and the property management company but have not yet received a response. "It's a stressful situation not knowing if something happens are they gonna be able to get downstairs," Clark said. 1901
SAN DIEGO (KGTV) - A former employee of the San Diego Metropolitan Transit System is suing the agency for retaliation after he said he stood up for a co-worker.Ivan Augustino moved to the United States from Sudan and still volunteers with projects for his native country. He started working for MTS in 2015.“It was pretty good,” Augustino said.Augustino worked as a Senior Applications Developer.“I am the main guy that deals with the complicated back end computer codes,” Augustino said.In 2017, he said he made a move that changed everything. It started with a co-worker.“One morning, she walked into my office pretty much in tears,” Augustino said.He said that a co-worker confided to him the Chief Information Officer discriminated against her when she asked about a promotion. The lawsuit filed against MTS claims the CIO told Augustino’s co-worker she was “not qualified for the job because of her age, her marriage and family planning status, and her relationship to an active duty military service member.”“The other question she also asked was, how old are you? You seem like you are at an age where you would be having kids,” Augustino said. It was a shocking conversation.“You know, that is wrong,” Augustino said.After his co-worker told him what happened, he first asked advice from another co-worker who then took it to human resources. Augustino said his co-worker did not want to bring the complaint to HR.“The last thing that anyone within the IT department wants is to take an issue to HR because once you report it to HR, there is going to be retaliation,” Augustino said.And that’s what happened, according to the former MTS employee. Initially, he was concerned how MTS investigated the complaint.“I was expecting someone to at least come and talk to me, but no one spoke to me,” Augustino said.He said retaliation began by the CIO and his direct supervisor.“The way they treated me just changed,” Augustino said.He claimed management suggested they would give him recommendations if he found another job. On another occasion, Augustino said they “mocked [his] English as a second language” in an email. On top of that, he said 98 hours of paid time off promised to him for working overtime on a big project was revoked, along with a promised promotion.“Coming from where I come from, I just felt like I did not even know what to do,” Augustino said.Feeling “degraded” and “intimidated”, he submitted a letter of resignation. However, he said he gave management an option.“If you can address this issue and the executive team and bring what I view as retaliation to a stop, I will pull my resignation,” Augustino said. Instead, he said he was fired and walked out of the building by security. His termination came a little over a month after he voiced his concerns about his female co-worker.A spokesperson for MTS told Team 10: “There is absolutely no validity to any of Mr. Augustino’s claims.”When asked if he would defend his co-worker again, Augustino said “absolutely.”Attorneys Zachary Schumacher and Daniel Goularte represent Augustino."This is absolutely a David versus Goliath situation," Schumacher said.Schumacher said fear is why people don't speak up."I like to compare it to battered wives syndrome, where you essentially have this person or in this case this entity who has this major power and balance who is doing all sorts of awful things and figuratively at least, battering its employees and yet they don't leave. They feel this sense of loyalty," Schumacher said. SAN DIEGO (KGTV) - A chlorine spill that prompted evacuations in University City was contained Monday evening. 30 gallons of chlorine spilled in the pump room of the Lawrence Family Jewish Community Center's Friedenburg Pool about 3:30 p.m. on Executive Drive at Regents Road, according to the San Diego Fire-Rescue Department. Just after 4 p.m., the department said about 40 children were sheltered in place while crews developed a plan to mitigate the situation. The location is near corporate offices and housing, including UC San Diego's Mesa Residential Apartments.No injuries were reported.Chlorine spill contained to 30 gallons at the JCC pool. No injuries. About 400 kids evacuated already. SAN DIEGO (KGTV) — A 19-year-old Arizona student has been arrested and now faces animal cruelty charges after police say he abused his emotional support dog.Netzer Villagomez, a student at Grand Canyon University, was arrested Sept. 22 after an Arizona Humane Society Animal Cruelty Investigator responded to reports of animal abuse involving a pug named Miso, an emotional support dog.Miso was examined by an AHS veterinarian, who said she found two fractured ribs, a fractured pelvis, and fractured tooth. Blood work also revealed elevated liver values indicating acute injuries.Police said Villagomez admitted to hanging Miso by its collar and leash, with all four legs off the ground, on two occasions for several seconds each time. Police say he also admitted to harming the dog on purpose.Villagomez sent photos of the reported abuse to another person, police added.Villagomez has been charged with Animal Cruelty, which went from a Class 6 to Class 5 Felony in Arizona last August. This means that such crimes cannot be dropped to a misdemeanor and may included jail time or supervised probation or treatment, according to the law. He's the first person to be arrested under the new penalties.Grand Canyon University released a statement to 10News, saying Villagomez had been expelled following his arrest."GCU Public Safety became aware of an incident involving Netzer Villagomez and immediately took possession of his emotional support animal to ensure its safety. The animal was turned over to the Arizona Humane Society and Mr. Villagomez was removed from campus. Mr. Villagomez has since been expelled from the university following his arrest by the Phoenix Police Department. Phoenix PD is handling any further actions associated with this matter."Miso will remain in AHS' care indefinitely, the humane society says. 1837
SAN DIEGO (CNS) - Two community boards that review police practices will hold emergency meetings Wednesday and Thursday regarding the San Diego Police Department's de-escalation-of-force policies.The city's Citizens Advisory Board on Police/Community Relations will meet at 6 p.m. Wednesday, followed by a Thursday evening meeting of the Community Review Board on Police Practices, both of which can be viewed on the city's website and YouTube page.San Diego Mayor Kevin Faulconer said the goal of both meetings is to "take a serious look at de-escalation recommendations that could be implemented by our department" and "increasing and facilitating further dialogue and understanding between our officers, our men and women who are out there protecting us, and the community."Faulconer said public input is welcome regarding what SDPD policies should be updated or changed."Many are crying out to be heard. We are listening," Faulconer said. "Your city is listening.
