SAN DIEGO (KGTV and CNS) - Trial started Monday for the Yuma, Arizona police officer accused of raping a woman during a visit to San Diego.Jared Elkins, 34, is charged with eight felony counts of rape for the alleged incident in September 2017.The 23-year-old woman’s mother called 911 to report a crime at a home on Marlborough Street in Kensington. Elkins, who is related to the alleged victim by marriage, was staying at her home.Elkins, the alleged victim, and two other family members went to dinner then watched a movie while drinking beer and wine at the home before the alleged assault occurred, according to prior court testimony.RELATED: Arizona police officer charged with raping San Diego womanThe alleged victim testified during a preliminary hearing in April that Elkins physically forced her to participate in sex acts despite her pleas for him to stop. The two other family members were asleep in the house so small "you can hear someone breathing in the next room," the woman testified.During the alleged assault, the woman said she asked Elkins what would happen if she cried out for help. "He said, ‘I would kill you,"' the woman testified. After the incident, the woman said she found another family member in the house and they called police.At a hospital, the alleged victim's blood-alcohol level was determined to be .09 percent, according to witness testimony.Besides forcible rape, Elkins is charged with rape of an intoxicated person, forcible digital penetration, two counts each of forcible oral copulation and oral copulation of an intoxicated person, forcible sexual penetration and sexual penetration of an intoxicated person.Elkins -- a seven-year veteran of the Yuma Police Department who later resigned -- faces 14 years in prison if convicted, according to Deputy District Attorney Lisa Fox. 1834

SAN DIEGO (KGTV) --  At 14 stories high, The tower apartments in downtown San Diego have some nice views. But when you're trying to get down without an elevator - it can be a challenge. Carol Clark says she was left with no choice but to take the stairs from her 13th-floor apartment to go the grocery store on Thursday afternoon. "I did it today but trust me I was breathing heavy when I came in," she said. Clark is one of the 200 senior residents living in the high rise building - a building designated for people over the age of 65. The residents say they've lost count on how many times they elevator has gone out. That's why they decided to call 10News for help. Although the second elevator was working when 10News arrived, residents tell us that wasn't the case for most of the day. They say it's something that happens a lot lately. "There are people here with walkers and wheelchairs," Clark said. "I'm scared to death for them."One neighbor in a wheelchair broke down in tears during our interview. "It's people's safety," he said. "Not just mine, but everybody else."The building is undergoing renovations - which residents say they appreciate. But they say the upgrades don't make it ok to shut down one of the two elevators and leave them with an elevator that they describe as unreliable at best. "Everybody is extremely upset," Clark said. "And the thing is we don't seem to be getting many answers."The residents told 10News they've taken their concerns to management many times but have seen no changes. They say they hope something is done soon, before an emergency happens and it's too late. 10News called the on-site manager and the property management company but have not yet received a response. "It's a stressful situation not knowing if something happens are they gonna be able to get downstairs," Clark said.   1901

SAN DIEGO (KGTV) -- A family’s trip to the pumpkin patch goes sour when thieves went picking through their car while they were picking out their pumpkins.Fay Feltman, her daughter, her granddaughter and great grandson went to the pumpkin patch located off Mission Gorge in Grantville.Because of how busy the lot was, they struggled to find an open space. Once inside, the granddaughter got a call from her dad asking about a recent Walmart charge of 00.RELATED: Intruder raids Del Cerro bedroom while woman sleepsFeltman still frustrated Tuesday, “Who would think this would happen at a pumpkin patch”. She tells 10 News her daughter ran to the car to find the window smashed and the purse stolen right from the trunk of the car.Feltman says her and her family were only in the patch for about 30 minutes. SAN DIEGO (KGTV) - A Chula Vista World War II veteran celebrated the 100th birthday of a lifetime, with help from hundreds of strangers.The celebration was made possible through Arthur Brook, a 9-year-old dedicated to preserving the stories of WWII veterans. He's been interviewing veterans living at the Veterans Home of California, Chula Vista"Since they were at least in their 90's, to be registered in the military during WWII, they wouldn't be here for much longer," said Arthur.When Arthur learned Army veteran Edwin Schwimmer was turning 100 in September, he wanted to give him a special gift. "We quickly made a decision to make it the most special birthday in a long time!" the 9-year-old added.Arthur put out a call requesting birthday cards and received hundreds from around the country. "So many people thought to send him cards, I just wanted to thank them all, who sent cards to Edwin Schwimmer to thank him for his service to our country," said Arthur. Schwimmer was stunned at the number of people who took the time to write him a letter. "There's no words I can express how I feel," said Schwimmer, "I'm the luckiest guy in the world, the luckiest guy in the world."Arthur says he'll continue his mission to interview as many WWII veterans as possible. 1277
