SAN DIEGO (KGTV) -- Police Wednesday released bodycam video following a deadly officer-involved shooting in Oak Park in late January. The graphic video opens with San Diego Police Chief David Nisleit explaining what led up to the shooting. According to Nisleit, officers spotted Toby Diller, 31, on the 2900 block of 54th Street with an open container of alcohol. RELATED: Officers, suspect identified in deadly Oak Park shootingNisleit says officers activated lights on their patrol car and tried to make contact with Diller, but he ran away. Video of the incident shows the officers, later identified as Benjamin Downing and Devion Johnson, running after Diller before catching up to him. At that point, Nisleit says Diller resisted arrest, grappling with police on the ground. "The officers gave him verbal commands to stop resisting, but he refused to cooperate,'' Lt. Matt Dobbs previously said. That’s when Johnson opened fire on the 31-year-old suspect. Diller died at the scene. Johnson has been with the department for two years and Downing for five. SAN DIEGO (KGTV) - Puerto Ricans are living in fear after hundreds of earthquakes rocked the region, according to a San Diegan with family there.Tommy Rosas last lived on the island when he was 14. Though he moved to the mainland, Puerto Rico never left him."It hurts," he said sadly, "every minute of the day, I walk, breathe, sweat, cry Puerto Rico."He's been hurting more for his home since 2017, when Hurricane Maria hit. "My family moved, with the exception of a couple cousins who live in Cabo Rojo." He said it was too much to start over an most of his family moved to the states."The electrical grid is ancient, and it has to be repaired. They started the repairs little by little, then the earthquakes hit," saying in frustration, "whats next? What did Puerto Ricans do to deserve this?"The shaking started December 28th, the biggest quake struck January 7th, registering a magnitude 6.4."There's thousands of people living on the streets, because of their homes being destroyed or they're afraid of their home collapsing on top of them." Rosas said friends described the desperate living conditions through social media.Rosas gave a friend a flash light as a gift before he went to Puerto Rico a few months back. He said it was a joke, but now that friend now using it regularly, "he's in Isla Verde, so they lost power there, and it's periodically, it comes and goes. The food supply, water," he said was dwindling.He said a group caravaned from the north side of the island bringing supplies like diapers, formula and juice to those affected by the earthquakes.The positivity keeps Rosas going, "we don't give up, we won't lay down and say okay."He raised ,000 for supplies for the island and is planning another fundraiser. SAN DIEGO (KGTV) - On Wednesday, ABC10 News interviewed San Diego County Superior Court Presiding Judge Lorna Alksne about this week's first criminal jury trial since all jury trials were halted in March.“We summoned 800 jurors and about 250 or so postponed their service like we told them to do if they felt uncomfortable or had a conflict or co-morbidity or something like that and of the remaining jurors we called in, only 41 showed,” she told ABC10 News and added, “The system doesn't work without jurors.” She went on to say, “I can only anecdotally think that people are unsure of public transportation or coming back Downtown to serve.”Wednesday marked the second day of the trial which was for an elder abuse case.Judge Alksne said that the courts have sufficient safety measures in place for jurors. “When they went back into the courtroom, they had these plexiglass barriers in between them if they're more than six feet apart and everyone wore masks and there was hand sanitizer everywhere. It's as safe as going to Costco,” she told ABC10 News.The courts have maintained that the only way to address the backlog of cases is with cooperation from San Diegans who are called for duty. She added, “What I [asked] the jurors yesterday was if you had a loved one who was incarcerated [and] pending trial and nobody showed up to do jury trial, how would they ever get their chance for their day in court?”Judge Alksne said that another trial is scheduled for next week and two are scheduled for the following week. The numbers of summonses will continue to increase. She explained that there's no plan to penalize people who do not appear for jury duty but that could change if turnout continues to be low. 1721

SAN DIEGO (KGTV) -- Police are investigating after a man was shot in the leg in East Village late Saturday night.Authorities say a 48-year-old man parked his car on 11th and E Street near City College Station around 10:50 p.m. Saturday.The man got out of the car and started walking when he saw two people arguing and heard gunshots.According to police, the man got into his car and began to drive away when he felt a pain in his right leg, looked down and saw that he was bleeding.Police said at this time, they don’t have any description of the suspects.The man drove himself to the hospital with non-life threatening injuries. 642

SAN DIEGO (KGTV) - New plans for a development in the Bay Park neighborhood are aimed at providing "transit-oriented" homes amid the region's housing crunch.Protea Properties has plans for the 3.5-acre lot right off Interstate 5, between Clairemont Drive and Morena Boulevard. The site is located across from the future Blue Line Trolley Station.The development director of the project confirms the development includes 156 apartments and 40,000-square-feet of retail and restaurant spaces. Some community members are concerned with the current plans and tell 10News they hope their concerns will be heard and changes will be made. "We're trying to back the city off from slamming us with density and trying to get a project that meets everybody's needs," local James Lamattery said.Lamattery says the community is fighting for more affordable housing units and lower building heights. Right now, the plans call for two, four-story buildings and 16 apartment units for affordable housing. The city is reviewing plans before they vote on required permits. The development director says the earliest the project could be complete is 2022. 1145
