SAN DIEGO (CNS) - The San Diego City Council voted unanimously Monday to amend an agreement between former Mayor Bob Filner and the developer Carmel Partners over the development of an apartment complex that drew criticism.The development's current owner, Trea Blvd63, LLC, sought to nullify the agreement, which required the development's owner to rent apartments to tenants by the room rather than by the bed. When it was being built in 2013, opponents of the apartment complex argued that it more closely resembled a dormitory rather than the luxury units it was billed as.``I applaud my council colleagues for correcting these corrupt mistakes of the past, and moving forward from Filner's blatant misuse of power,'' Sherman said. ``This is a good reminder that big problems happen when elected officials abuse the power of their office.''Carmel Partners began work on the CentrePoint apartment complex, located in Rolando, in 2013. The city ordered the stoppage of construction of the complex, citing the need for additional construction permits. According to City Councilman Scott Sherman's office, Filner also ordered San Diego's Development Services Department to not conduct inspections on the development's completed phases, keeping construction workers from continuing with the project.At the same time, the Rolando Community Council demanded that the CentrePoint project, and the developers of any other new projects in the area, pay for improvements to the neighborhood. The CentrePoint development offered to pay 0,000 for improvements.Then-City Councilwoman Marti Emerald, representing the area, suggested that the project needed additional changes regardless of the funding. CentrePoint subsequently sued the city in U.S. federal court, arguing that Filner, Emerald and the rest of the city government had illegally stanched the development. The city and CentrePoint eventually reached a settlement, in which the development's backers.Sherman framed the dispute as an overreach by Filner and called it a victory for property rights. SAN DIEGO (CNS) - Police Friday identified a 44-year-old man who was found fatally wounded inside a vehicle in the Encanto area of San Diego.The man was identified as Gilbert Lee Johnson, of San Diego, the San Diego Police Department reported.Officers found Johnson about 7:40 p.m. Wednesday in the area of Varney and Theodore drives, said Officer Robert Heims of the San Diego Police Department.After police received multiple calls of gunshots heard in the area, officers reported finding him slumped over in the vehicle suffering from at least one apparent gunshot wound. "This joint effort is a great example of how our Consumer Protection Unit works to protect people from unfair business practices in the marketplace and ensure that California's consumer protection laws are followed."The judgment requires Jdate, Christian Mingle, and all of Spark's other dating sites to have full transparency with consumers about automatically renewing memberships.The company now must:-- clearly and conspicuously disclose the renewal terms;-- get consumers' consent, through a separate check box (or similar mechanism) that does not include other terms and conditions;-- send a clear summary of the renewal terms after consumers pay; and-- allow consumers to cancel easily.Spark Networks cooperated with the task force to reach the resolution.According to prosecutors, online "subscriptions" and other automatically recurring charges have proliferated in the United States in recent years. Some renewals come after "free trials," where consumers need to cancel in time to avoid the charges.Federal and state law requires businesses to make auto-renewals clear to consumers, and to get their "express, affirmative consent" before collecting any money. SAN DIEGO (CNS) - The San Diego Humane Society will make a group of animals displaced by the Camp Fire available for adoption Friday.Earlier this month, the organization's Emergency Response Team deployed to Butte County for 10 days to offer aid to hundreds of animals displaced or otherwise affected by the fire.The team returned to San Diego Dec. 19 with eight dogs and three cats, some of whom received treatment for burns caused by the fire.The owners of the 11 animals surrendered them to the Humane Society because they could no longer care for them. As a result, they will not have an owner seeking to find them once conditions improve in the areas affected by the fire.The Humane Society will put a group of the displaced animals up for adoption at 10 a.m. at its main campus, located at 5500 Gaines St. Available animals include a bonded pair of 6-year old miniature pinscher mixes named Pikachu and Panchie and a 3-year old cat names Sunshine.One of the dogs, 11-year-old Cinnamon, was adopted on Friday. Two of the cats have also found forever homes. Residents can view the Humane Society's adoptable animals at sdhumane.org/pet. Adoptions will be on a first-come, first-served basis. 1203

  

SAN DIEGO (CNS) - Researchers at the UC San Diego School of Medicine released a study Friday looking into loneliness in elderly adults, and found it can be overcome in a variety of ways.The researchers noticed what appeared to be an epidemic of loneliness among adults in senior living or retirement communities, and sought to identify why. According to the study, 85% of the interviewed residents reported moderate to severe levels of loneliness.Dr. Dilip V. Jeste, senior author of the study and senior associate dean for the Center of Healthy Aging and professor of psychiatry and neurosciences at UC San Diego School of Medicine, said loneliness can be deadly.``Loneliness rivals smoking and obesity in its impact on shortening longevity,'' Jeste said. ``It is a growing public health concern, and it's important that we identify the underlying causes of loneliness from the seniors' own perspectives so we can help resolve it and improve the overall health, well-being and longevity of our aging population.''RELATED: Resource guide: keeping seniors protected from abuseJeste said he found few published, qualitative studies about loneliness among older adults, particularly in the independent living section of senior housing communities.He said several personal and environmental factors impacted the study subjects, all 100 of whom lived in an independent housing section of senior- living centers in San Diego.``Loneliness is subjective,'' Jeste said. ``Different people feel lonely for different reasons despite having opportunities and resources for socialization. This is not a one-size-fits-all topic.''One seemingly common factor for most older adults was loss. Losing spouses, siblings and friends can be difficult at any age, but as contacts from younger years dwindle, Jeste said he found that many residents found making new friends difficult and not as fulfilling as those with whom they grew up. Another common thread was loss of purpose.``We heard powerful comments like, 'It's kind of gray and incarcerating,'' Jeste said. ``Others expressed a sense of 'not being attached, not having very much meaning and not feeling very hopeful' or 'being lost and not having control.'''RELATED: Making It in San Diego: Taking care of aging parentsSome older adults found ways to cope effectively with loneliness, the study -- published in the Jan. 10 issue of Aging and Mental Health -- found. Performing a good act for someone else or coming to terms with aging are broad but effective techniques to cope with loneliness, the study found.``One resident told us, 'I've accepted the aging process. I'm not afraid of it. I used to climb mountains. I want to keep moving, even if I have to crawl. I have to be realistic about getting older, but I consider and accept life as a transition,''' Jeste said. ``Another resident responded, 'I may feel alone, but that doesn't mean I'm lonely. I'm proud I can live by myself.'''According to the National Center for Health Statistics, by 2029, more than 20% of the U.S. population will be over the age of 65. Jeste said the study would help develop strategies to deal with an aging population. 3150
