McDonald's and KFC have nearly 3,000 outlets all over China and a work force of nearly 200,000, according to a state media report. Zhu Yongping, a Guangzhou lawyer, has begun to move for the rights of employees. He told the paper that the work contracts have 'seriously violated' the legal rights of employees. A Lin, a McDonald's employee in Guangzhou, regarded McDonald's as a respectable foreign-funded enterprise before starting to work there. But the working experience has changed her mind. As discrimination turns rife in China, the draft law contains a clause on anti-discrimination in an effort to provide employment equality in the country. The clause states that discrimination against job seekers with respect to their background, ethnicity, gender, religious beliefs, age, or physical disability, will be prohibited. The government is also taking actions to set up trade unions in foreign-funded enterprises in China. Up to date, about 26 percent of China's 150,000 overseas-funded enterprises have established trade unions, with a total membership of 4.29 million, previous media report said. However, McDonald's and KFC have not set up unions so far.

The Employment Promotion Law is being revised to provide a firmer legal footing for efforts to combat the discrimination that Hepatitis B virus carriers have encountered while looking for work, a senior official said. Many spoke about their experiences of being rejected by employers because they are Hepatitis B virus carriers. They applauded the document released by the Labor and Social Security Ministry and the Ministry of Health in May, which called for the protection of virus carriers' employment rights. Still, some were disappointed that some employers seemed not to have heeded the call. According to the document, except for those industries barred to Hepatitis carriers because of the possibility they might spread the virus, such as food processing, employers are not to make Hepatitis screening a mandatory part of physical checkups. Medical organizations have been asked to protect carriers' privacy. But in many cities checks for theHepatitis B virus are more or less obligatory before securing employment. China's employers have dual problems on the hiring front as they face the biggest salary increases in Asia needed to attract talent and the region's highest turnover, according to a survey.The findings appeared in the Friday edition of the China Youth Daily.Nearly one-third, or 32 percent, of the employers surveyed planned to raise salaries by at least 20 percent to attract badly-need talent, said the survey by human resources company Hudson.The survey covered employers' first-quarter plans and expectations.Year-end bonuses are expected to rise significantly, with 66 percent of the respondents planning to increase year-end bonuses at least 10 percent and almost one-fourth planning raises of more than 20 percent.But despite significant increases in compensation, staffing turnover has been heavy.Across all industries, 47 percent of companies surveyed had turnover rates of more than 10 percent in the past 12 months, and 13 percent said that the rate was more than 20 percent.China's staff turnover rate was highest in Asia, more than twice that of Japan, the Youth Daily report said. Unsatisfactory compensation and limited career progression were blamed for China's high turnover level.Among respondents, 22 percent agreed that limited career progression was a major cause of high turnover, while 18 percent believed it resulted from dissatisfaction over money.The report predicted a persistent increase in salary levels in China because of limited talent resources.
