A Japanese pilot found to be more than nine times over the legal alcohol limit before a scheduled flight from London Heathrow in October has been sentenced to 10 months in prison, police said Thursday.Katsutoshi Jitsukawa, 42, an employee of flag carrier Japan Airlines, was scheduled to fly from Heathrow to Tokyo on October 28 at 6:50 p.m. local time, but failed a breath test shortly before takeoff. The test showed Jitsukawa had 189 mg of alcohol per 100 ml of blood in his body. The legal limit for pilots is 20 mg, while drivers in England, Wales and Northern Ireland are allowed as much as 80 mg.Alarm was raised after a driver of a crew bus smelled alcohol and called the police, who conducted the test, according to Japanese broadcaster NHK.Jitsukawa said he had drunk two bottles of wine and a pitcher of beer the night before the flight, NHK reported. He was remanded in custody and later pleaded guilty to the charge of performing an aviation function when his ability was impaired through alcohol. Jitsukawa had been scheduled to fly a 244-seater Boeing 777 aircraft.Reacting to the sentencing, Inspector of Aviation Policing Iain Goble, condemned the "serious" offense that could have had "catastrophic" consequences."This conviction reflects he displayed not only total disregard for the safety of all the passengers and staff on his flight, but also the wider public," Goble said.Following Jitsukawa's arrest, Japan Airlines apologized for the incident and said "safety remains our utmost priority," adding it will "implement immediate actions to prevent any future occurrence." 1610

A federal judge is demanding answers after the U.S. Education Department rejected 94% of claims for student loan forgiveness it had agreed to process after being sued over delays. U.S. District Judge William Alsup in California scrapped the settlement this week and is considering barring the agency from denying claims until the case is decided. Judge Alsup said the department has been denying claims using template letters that are “alarmingly curt.”He said that although Education Secretary Betsy DeVos blamed the backlog on the hard work that goes into processing claims, she has now “charged out of the gate, issuing perfunctory denial notices utterly devoid of meaningful explanation at a blistering pace.”The dispute stems from a 2019 lawsuit brought by 160,000 borrowers who say the Education Department illegally stalled their claims for loan relief. The students claim they were defrauded by their schools. The Education Department says many claims were submitted for ineligible programs or failed to make a case for loan relief. In a proposed settlement in April, the Education Department agreed to process the backlog of claims within 18 months. But Alsup scrapped the deal, saying it was undermined by the recent spate of rejections. 1254

A Cirque du Soleil performer who fell Saturday night during a performance in Tampa has died, a Tampa General Hospital spokeswoman said. The acrobat who died has been identified as Yann Arnaud, according to a statement released by Cirque de Soleil's Volta."It is with immense sadness that Cirque du Soleil Entertainment Group reports that a tragic accident occurred last night, March 17, during a performance of its show VOLTA, in Tampa, Florida," the statement began. Arnaud, a longtime aerialist, was performing "the aerial straps number" when he fell onto the stage, according to the Cirque du Soleil statement. First responders moved in quickly to administer medical aid. Arnaud was taken to Tampa General Hospital, where he later died of his injuries. "The entire Cirque du Soleil family is in shock and devastated by this tragedy. Yann had been with us for over 15 years and was loved by all who had the chance to know him. Over the coming days and weeks, our focus will be on supporting Yann's family and our employees, especially the VOLTA team, as we go through these difficult times together," said Daniel Lamarre, President and CEO of Cirque du Soleil Entertainment Group.Cirque du Soleil officials are gathering more information the event, the statement said. "We are offering our full and transparent collaboration to the authorities as they look into the circumstances of this accident," the statement added. The last 2 shows of Volta scheduled for Sunday were canceled. All purchases through Cirque du Soleil website or call center will be automatically refunded on the credit card used for the original purchase. For tickets purchased through one of its partners, customers should contact the original point of sale for a refund. For customer's service inquiries, visit www.cirquedusoleil.com/volta or call 1-877-924-7783.Witnesses said that a ribbon dancer who had swung out over the audience slipped as he was swinging back and fell to the stage.  He was unresponsive when medical personnel rushed to attend to him. 2099

A doctor with the Oregon Health Authority is getting attention after she wore clown make-up during a recent video update on the state’s coronavirus cases.Dr. Claire Poché starts out the video update like any other, stating her name, introducing her colleague who joins the video later and then giving an update on Oregon’s COVID-19 numbers.“As of today there have been 38,160 cases in Oregon, with 390 cases being reported today. Sadly, we are also reporting 3 deaths today, bringing the statewide total of COVID related deaths to 608,” Dr. Poché said in an October 14 video, while visually looking like a clown. She is wearing white and red make-up on her face made up to look like a clown, in addition to a polka dot shirt, bright red tie and yellow pants.Dr. Poché does not reference the make-up on her face, or offer an explanation for her look. The video cuts to another doctor with the Oregon Health Authority, also wearing a costume, who talks about safe ways to celebrate Halloween with pandemic safety precautions in mind.At this point, viewers might start making the assumption the costume and Dr. Poché’s make-up are part of a coordinated plan for Halloween.About 10 minutes into the video, the two colleagues reference their costumes and talk about their Halloween plans. 1289

A Democratic lawmaker walked out of a moment of silence for the Texas shooting victims on Monday night to protest a lack of action on gun safety after mass shootings in the United States.Rep. Ted Lieu of California, an outspoken critic of President Donald Trump, said he walked out of the House chamber because he wants to pass a universal background check law, a ban on assault rifles and a ban on bump-fire stocks."My colleagues right now are doing a moment of silence," he said during a Facebook Live from the hallway. "I respect their right to do that and I myself have participated in many of them. But I can't do this again. I've been to too many moments of silences. Just in my short career in Congress, three of the worst mass shootings in US history have occurred. I will not be silent. What we need is we need action, we need to pass gun safety legislation now." 880
