SAN DIEGO (KGTV) - A 98-year-old woman is being evicted from her Ocean Beach home after living there for nearly three decades. Betty Morse moved into her tiny Ocean Beach cottage back in the late 1980’s. After her husband died, she needed a place she could afford. “I was by myself, but I managed,” Morse said. “I could walk to work.” Morse said the rent was about 0 when she moved in. “It was a beautiful place to live because you could walk to the beach and watch the sunset,” she said. This little place by the beach that fits her so well was supposed to be her last stop. "See, I figured I'd lived a wonderful life in Ocean Beach, and I want to live and die here, you know, because I feel so comfortable here,” Morse said. “It's my little house, and it's all I know.” Morse said this year she was asked to sign a new rental agreement. Her family had some disagreements with a couple of changes made by the landlord: one was a no-smoking addendum. Morse told 10News after decades of being a smoker at 98-years-old, she quit so she could stay in the home. Despite her efforts, she said after the attorneys went back and forth a few times, she received a 90-day-notice in July terminating her tenancy. Morse doesn't know what to do if she’s forced to leave. “I don’t know who will rent to me because in two months I’ll be 99 and they are not going to be happy to rent an apartment,” she said. During her 30 years at the property, Morse said she never had a problem with the rental. A fixture in the neighborhood, she knows San Diego Mayor Kevin Faulconer and his mother. "She said, 'Kevin, I want a picture of Betty with you' and he said 'OK mom,'” she said. “He came over to the step and she said, 'She's very unsteady on her feet, Kevin, don't let her fall.'" Morse said her rent was always paid on time, a trait she picked up from the one man she ever loved. "Before he died, when he was in the ICU, he had a tube, but he wrote, don't forget to pay the rent.” A model tenant, Morse is using Section 8 housing assistance to help cover her rent. According to the termination notice she showed to 10News, the owner is electing to opt out of the Section 8 program and not renew the lease. It states the owner will be conducting substantial renovations to the unit and following the renovations the owner desires to rent the unit at a higher rental value, being that of the market rate value. The notice states the owner will be opting out of Section 8 entirely."They clearly state on their 90-day notice that their just cause is they don't want to comply with Section 8,” said Pamela Macias with San Diego County Evictions. Macias is working with Morse and her family to try and keep her in the home. "She's willing to pay market rent and just for no reason at all they want her out,” Macias said. Morse does have children, and instead of being out on the street she could move in with one of them. However, nearing the century mark she worries about being a burden.“I don't want to be in a nursing home either,” she said. “I still want to be independent.” The 90-day-notice has expired and Morse is still living in the property. The property owner filed an unlawful detainer, which is basically an eviction lawsuit. Team 10 contacted the owners of the property; they declined to comment due to pending litigation. Housing Assistance in San Diego The San Diego Housing Commission (SDHC) states that more than 6,000 landlords are participating in the rental assistance program. Most landlords don’t usually stop participating in the program, but it does happen, according to the commission. They say the Section 8 Housing Choice Voucher Rental Assistance program includes options to meet the needs of both landlords and tenants. Landlords can increase rents for rental-assistance tenants as they would for market-rate tenants as long as 60 days’ notice is provided to the rental assistance tenants and the new rent is determined to be reasonable.According to SDHC, to evaluate the reasonableness of the rent it compares the requested rent to the rents on other units on the premises with tenants who do not receive rental assistance. Right now, landlords are not required to accept tenants who receive Section 8 rental assistance. However, in August 2019 a new amendment to San Diego’s source of income ordinance will prevent landlords from declining a tenant based only on the household receiving rental assistance. “It opens large opportunities for our clients to receive assistance and utilize their voucher in the City of San Diego,” said Carrie Leverett, director of the SDHC rental assistance department. “It allows our clients to maintain affordable housing and find affordable housing. San Diego’s Mayor and Housing A spokesperson for San Diego Mayor Kevin Faulconer says he and his staff have gotten to know Betty through the years because her home is near the staging area of the Ocean Beach Holiday Parade. SAN DIEGO (KGTV) - As police ramp up their probe, an Otay Mesa dog owner believes his dog may also have been targeted by a pepper spray-wielding mail carrier. The owner of 9-year-old Roscoe didn't want identified, but he tells 10news about two months ago - moments after their mail carrier left - Roscoe started to twitch in pain, which lasted minutes. He say Roscoe was behind a gate and not a threat to the postal carrier. Hours later, the dog's eyes were still red. The dog's owner didn't report it, but says another neighbor complained about a similar occurrence. Both of their homes are just blocks from the Galindo home on Agosto Street."Makes me feel angry and so sad that he's causing so much pain," said Alfonso Galindo.Earlier this week, he spoke to 10news about the strange stains on his patio that prompted him to check his surveillance video. He watched the unbelievable unfold: a postal carrier appearing to hold pepper spray under the mail, as he walked by a metal gate. Behind the gate is his 7-year-old rescue Pupa. At the same time, Pupa begins convulsing for minutes."Sickening. It's scary how nonchalant he is. He's done this before," said Galindo.Galindo says he found nine similar incidents in the recordings on his hard drive, about a month's worth. The Postal Service issued an apology, saying the 'appropriate action' will be taken."That left me with a question. Is this person going to be retrained and put back on my route? That's not going to cut it," said Galindo. There are also more questions about the impact on his two young children, who are constantly touching and hugging Pupa. For months, they've suffered mysterious respiratory issues, requiring frequent trips to the hospital. On Wednesday, both were diagnosed with asthma. Galindo says more tests need to be done, but doctors believe the pepper spray could be the cause, and at the minimum, is an aggravating factor."I'm scared to find out where this could take my children. What he's doing is criminal," said Galindo.Galindo says several police detectives have interviewed him and collected evidence. A SDPD spokesperson tells us they are "actively investigating." 2164

SAN DIEGO (KGTV) - A Father’s Day boat trip off the San Diego coast led to a rare wakeboarding encounter with dozens of dolphins for a Pacific Beach boy and his family. “It was a quick little boat ride and we saw paradise up there,” said Emiliano Gallego of Crown Point. Gallego and his three children decided to take a boat ride about 7:30 a.m. on a gloomy Sunday. They were about a mile off Pacific Beach when they realized their 24-foot Yamaha ski boat was surrounded by dolphins. “It was impressive,” said Gallego, who believes there were thousands of dolphins swimming with the pod. Gallego’s 9-year-old son Demi, an avid wakeboarder, grabbed his gear and jumped in the water. Gallego recorded the incredible scene. “At first, he was scared. He eventually just started enjoying the ride with the dolphins,” Gallego said. Gallego’s younger son and daughter didn’t want to jump in. “Too many dolphins,” said Gallego. After the spectacular ride, the family went out to breakfast, amazed at what they saw. “That was the best gift ever,” said Gallego. 1059

SAN DIEGO (KGTV) – A Clairemont man is recovering after he said he was accidentally shot by his next-door neighbor.Walter Lam said he was at his dining room table inside his home on Sunday when he heard a gunshot.“As soon as I heard that shot, I felt something was really cold on the inside of my arm. And I was bleeding; I knew immediately I was shot and I called 911,” Lam said.Once at the hospital, Lam underwent surgery to remove the bullet.“If it had moved towards my heart, I would have been dead,” Lam told ABC 10News.San Diego police said the bullet was fired by his neighbor who lives right next door. The neighbor said he was cleaning his gun and did not even know it was loaded.Investigators took the neighbor’s gun into evidence, and while he was not arrested, investigators said the neighbor could face a misdemeanor gun-related charge.Lam is recovering and in a little bit of paint, but he said he’s ready to return to work as head of his nonprofit organization Alliance for African Assistance.Lam said this is a reminder that life is too short.“Life can end any time. Just a little more to the right and I would be dead. Right now, people would be planning my funeral,” Lam said.ABC 10News learned the case has been forwarded to the San Diego City Attorney's Office. They will ultimately decide if Lam’s neighbor will be charged with a crime. 1365

SAN DIEGO (KGTV) - A 0 million 3rd baseman doesn’t automatically turn the Padres into a World Series contender, but it does buy a lot of Opening Day excitement at Petco Park. The 2019 Major League Baseball season is underway, and for once, Padres fans have reason to hope for something better than a last place finish in the National League West.Manny Machado’s arrival at the start of Spring Training, along with his 9-figure free agent deal (a North American sports record since eclipsed by Bryce Harper and the Phillies) marked a turning point for the San Diego Padres, an end of irrelevancy and the cornerstone of a potentially bright future.RELATED: Stubhub report: Manny Machado signing a home run for Padres ticket and merchandise salesOf course, it takes 9 to play baseball, and Machado cannot carry the entire franchise by himself. Eric Hosmer is back for his second season with the Padres, hoping to put up better offensive numbers than he did last year. Wil Myers also returns, along with catcher Austin Hedges, but much of the excitement at Petco Park is being generated by the team’s rookies.Considered the top prospect in all of baseball by ESPN, 20-year old Fernando Tatis, Jr. is a potential superstar in the making, forcing his way onto the Opening Day roster thanks to his raw talent and baseball instincts. On the mound, the story is a similar one for rookie pitcher Chris Paddack, who was too good in Spring Training to leave out of the starting rotation. Fellow rookie Nick Margevicius also makes the squad, despite never pitching above A ball in the minor leagues. They’ll be joined by second-year lefties Eric Lauer and Joey Lucchesi, as well as converted reliever Matt Strahm, another left-handed who also is coming off a stellar spring in Arizona.RELATED: San Diego Padres grace Sports Illustrated cover for MLB preview issueKirby Yates returns at closer to anchor a bullpen that was considered one of the best in baseball last season, loaded with flamethrowers touching 100 mph on the radar gun. Could the Padres shock the world and make the playoffs? Most baseball experts don’t think so, predicting the team to finish somewhere around .500 for the season. Still, most are pegging the Padres as a team on the rise and one to keep a close eye on in 2019. 2290
