SAN DIEGO (KGTV) - Another woman has come forward with accusations of sexual misconduct against a former San Diego County Sheriff's deputy. Jane Doe, as she's named in a federal lawsuit, claims Richard Fischer sexually assaulted her in September of 2017. The woman claims she was driving home from her shift as a cocktail waitress, lost control of her vehicle, and crashed into two parked cars. Scared she'd been drinking and driving, she left the scene and called a male friend to drive her to her home in Escondido. According to the lawsuit, as she and the man approached her home, they saw Escondido police cars parked outside. Officers detained her, and she admitted that she'd crashed her car and had been drinking and driving. Police handcuffed the woman and told her she had to wait for San Diego County Sheriff's personnel to arrive. The lawsuit says the responding deputy was Richard Fischer. According to the lawsuit, "Defendant Fischer asked Jane Doe if she had been drinking. She admitted that she had. As he drove Jane Doe back to the accident scene, he asked Jane Doe if either of the two males in the car with her were her boyfriend. Jane Doe answered that they were not. Defendant Fischer then responded, "Good, because you could do much better than them" or words to that effect." The lawsuit says once at the accident scene, deputies questioned Doe about the crash. It says after about 20 minutes at the scene, Fischer asked her if she wanted a ride home. The lawsuit says, "Jane Doe was confused when Defendant Fischer offered her a ride home because she told the officers she had been drinking and driving, she crashed into two parked cars, fled the scene of the accident, did not have a valid driver's license, her friend that picked her up got arrested, and there was an outstanding warrant for her arrest. Jane Doe assumed she was going to jail." The woman says she accepted Fischer's offer for a ride home and got into the patrol car with her hands cuffed behind her back.As they drove to her home, Fischer asked her how old she was, according to the lawsuit. "Deputy Fischer asked if she had gotten a birthday kiss. Jane Doe responded, "What?" Then Deputy Fischer asked Jane Doe if she wanted a birthday kiss. Jane Doe did not respond. Jane Doe became more confused. Jane Doe thought to herself, "What the he** is going on?," the lawsuit stated. The lawsuit says once they got to her house, Fischer opened the rear door where she was sitting. It says, "He then said, "Here comes your favorite part," or words to that effect. He leaned across her to unbuckle her seatbelt. Deputy Fischer then started rubbing Jane Doe's legs as she sat handcuffed in the back of Deputy Fischer's patrol car. Jane Doe was wearing very short denim shorts. Therefore, Deputy Fischer was able to rub the skin of Jane Doe's upper thighs on both legs. As Deputy Fischer rubbed Jane Doe's thighs, he looked at her and said, "Your legs are really soft" or words to that effect. Jane Doe was still handcuffed and could not stop Deputy Fischer's advances." The lawsuit claims once out of the vehicle Fischer stood behind her and started "rubbing her butt". It says, "As the handcuffs were still on, Deputy Fischer then reached between Jane Doe's legs and rubbed her genital area." The woman then went into the house. The lawsuit claims by the time Fischer met the woman, he had "sexually assaulted approximately 19 other women while on duty as a San Diego sheriff deputy." The lawsuit challenges the County of San Diego's complaint process saying it allows very serious complaints to go unanswered, "because a proper system of complaint reporting would have resulted in an Internal Affairs investigation into the complaints, arguably as early as May 4, 2016. Deputy Fischer would have either been terminated then, or placed on administrative leave, as he is currently on, which would have saved Jane Doe and other situationally vulnerable women from his abuse of power as a San Diego sheriff deputy." Fischer is currently facing numerous criminal charges, including sexual battery, false imprisonment, forced oral copulation, and assault by a public officer. He has denied the allegations, telling 10News in September of 2018, "I just want to go on the record and say I vigorously deny these allegations. They are false, and I really look forward to my day in court to fight for myself." According to court records, Fischer's criminal trial is set for September. Attorneys for Fischer did not respond to a request for comment on this federal complaint. 4559

Gavin Newsom is facing a possible recall election as the nation's most populous state struggles to emerge from the coronavirus crisis.Organizers for "Recall Gavin 2020" say they have collected around 800,000 signatures so far. That's more than half of the nearly 1.5 million petition signatures needed to place the recall on the ballot.But state records show just under 500,000 have been turned in so far; of those, 46,756 are from San Diego County.Recall adviser Randy Economy says interest is higher since it was revealed Newsom dined with friends at an opulent restaurant while telling state residents to stay home and not socialize."He's done this to himself," Economy says, pointing out that many business owners are upset at how Newsom has handled the coronavirus pandemic and ensuing shutdowns."More people have suffered who are the heart and soul of California and the backbone of our economy, and we basically have had it."Economy says his group does not plan to hire professional signature gatherers. Instead, they're relying on a network of 30,000 volunteers across the state. They plan to use social media and their website to gain momentum."People have paying attention," he says, "They're at home, they don't have much to do, they're always on social media..."You can download the petition. You can sign it in your home. You can have your family member sign it. You can have your neighbor sign it. It's just just real simple."But a grassroots movement may not be enough. Newsom still has high approval ratings, and won his recent election by the largest margin in California history.UC San Diego Political Science Department Chair Thad Kousser says the 2003 recall of Gov. Gray Davis provides a good comparison.In that recall, the only successful recall of a governor in California history, supports got a huge financial boost from Darrell Issa and also had a big-name challenger in Republican Arnold Schwarzenegger.Kousser says this recall effort has neither."Without the money that it takes to set in place the machinery of direct democracy in California, we're not going to see a recall come to fruition," he says.Newsom hasn't spoken publicly about the recall, but his office released a statement in June. It was identical to a statement he released in 2019 when facing a different recall election.In it, Newsom says the people behind the recall want to "bring Washington's broken government to California.""The last thing California needs is another wasteful special election, supported by those who demonize California's people and attack California's values," it says.When 10News presented that statement to Economy, he scoffed, adding "This man has the audacity to be able to lecture us on on politics and, and how he has been able to conduct himself behind closed doors. How dare he."Recall organizers have until mid-March to gather signatures. SAN DIEGO (KGTV) — Border Patrol agents arrested five people in connection with a human smuggling incident, including one man convicted of being a sexual predator.A vehicle traveling through a temporary immigration checkpoint in Potrero failed to stop at about 6:30 a.m. Wednesday, according to U.S. Customs and Border Protection, before agents stopped the vehicle several yards past the checkpoint.Agents say five males in the vehicle were questioned. Three passengers in the vehicle's backseat said they were from Mexico but had no U.S. documentation, according to CBP. The driver and front seat passenger claimed to be from the U.S.The driver and front passenger were arrested on suspicion of smuggling and the three other passengers were arrested for being in the U.S. illegally, CBP said. During a records check at a nearby station, agents learned one passenger, a 39-year-old Mexican national, was convicted in 2012 of kidnapping and rape of a minor in San Diego. He was sentenced to a seven-year prison term and removed from the U.S.“I am proud of the great work agents demonstrated in arresting this known child predator,” said Chief Patrol Agent Douglas Harrison. “Their actions help keep our communities safer.”Both U.S. citizens face human smuggling charges and the previously deported Mexican man faces federal charges. SAN DIEGO (KGTV) - As the temperature rises and more businesses, like movie theaters, are reopening San Diegans and people from neighboring counties are flocking to get a dose of normalcy."We sold out today which is great news for everyone, we sold out today very quickly." General Manager of Theater Box Donnie Eversole said.He said it was wonderful 'being home' back in the theater, "we haven't been in the theater for 90 to 120 days so it's like a new adventure."He said it helps that the week they opened, two blockbusters, Christopher Nolan's Tenet and Bill and Ted Face the Music, are screening.While they're capped at 25% Eversole said you can make sure you claim your seat by reserving online. They are working to add more showtimes while abiding by the new guidelines.Last time San Diego had sweeping reopenings, there was a huge spike in coronavirus cases. Eversole said they are doing everything they cna to prevent another spike, "every cdc guideline is followed to the letter, we do not bend, we do not break. We follow the rules because not only is our business affected, everyone else is and we want to make sure everyone is getting a fair shake and able to recoup some of the summer that's been lost."San Diego is the only lower tier county in Southern California with the ability to have so many re-openings, drawing attention from our neighbors.Supervisor Nathan Fletcher spoke at Wednesday's press conference, urging everyone to do their part to prevent another spike, "One of the most dangerous settings is indoor gatherings, it is house parties, it is people gathering together in an indoor setting and there really is no way for us to enforce that or prevent that other than the public's help and cooperation."He said if there are gatherings and another spike in cases, businesses, like Theater Box, could shut down once again. 1857

  

SAN DIEGO (KGTV) -- Authorities in California have identified the sailor who died after being struck by a spinning helicopter blade as 32-year-old Lt. James Mazzuchelli.Mazzuchelli was a flight surgeon assigned to Marine Light Attack Helicopter Squadron 267, Marine Aircraft Group 39 and was stationed at MCAS Camp Pendleton.Mazzuchelli is from Orange Park, Florida and was previously deployed to Japan.“Lt. James Mazzuchelli was an incredibly talented physician and Sailor,” said Col. Matthew Mowery, commanding officer of MAG-39. “His contagious enthusiasm, motivation, and love for the Marines and Sailors of HMLA-267 and MAG-39 has been evident in the outpouring of grief at his loss and the support being shown to his family and close friends. His willingness to join the Navy and elect to serve faithfully with the Marines should give a sense of pride to all of us who serve our country that we are surrounded by heroes every day. James and his contribution to our Corps will be sorely missed."The sailor died Saturday morning after being hit by the spinning tail rotor blade of a UH-01Y Venom Marine helicopter.The incident is currently under investigation. 1182
