SAN DIEGO (KGTV) — New details are emerging about the death of a man in San Diego Sheriff’s deputies’ custody. A recently released Medical Examiner’s report says an arrestee’s death last year was a "homicide." The District Attorney's office said last year that none of the deputies involved in the in custody death will face any criminal charges. Oscar Leal died last February 28 after deputies responded to his apartment in Vista and detained him. The Medical Examiner’s homicide classification is not a legal term, but a medical assessment. The DA's office wrote in part of a nine-page summary and statement in December last year: "... His level of methamphetamine intoxication combined with his active resistance combativeness in the duration of the struggle, all contributed to his death ... The deputies involved in his detention acted reasonably under the circumstances in bear no state criminal liability for their actions."The Sheriff Bill Gore wrote in a statement:"I am aware of the Medical Examiner's conclusion regarding the manner of death of Mr. Leal. I respectfully disagree with the classification of the manner of death in this case as a homicide.The pathologist wrote that his death was due to acute methamphetamine toxicity in the setting of agitation, physical altercation, and prone restraint. It was purely due to Mr. Leal's agitation that he was restrained. Peace officers have a duty to restrain those who are agitated and under arrest, as Mr. Leal was. Were it not for Mr. Leal's abuse of methamphetamine he would be alive today. The deputies and nurses on scene rendered immediate aid to Mr. Leal.Mr. Leal brought upon his own death with his choice to use methamphetamine. SAN DIEGO (KGTV) — Poway Unified School District officials say they are going fully online for the fall school year after originally planning to give students the option for in-person instruction.In a letter to parents on Wednesday, the school district said that "stringent" standards that need to be met for in-person classes "have made it impossible for any San Diego County school district to physically reopen schools for in-person instruction before mid-September."PUSD said it planned for the possibility to resume classes in-person after the county was off the state's monitoring list for 14 consecutive days. But the requirement now requires that the county is off the watch list for 28 consecutive days, and if at any point the county exceeds the threshold for three days, it would be back on the state list and have to go through another 28-day cycle."In late Fall, we will reevaluate our plans taking into full consideration then-current public health conditions, and guidelines and restrictions from the Governor and public health department," the district said in a release. "While this information is likely to disappoint the majority of our staff and families who indicated a desire to return to on-campus learning as soon as possible, everyone should know that -- due to our extensive planning thus far -- PUSD will be ready for a prompt and safe return to in-person instruction if permitted to do so come January."The school district says its 2020-21 school year will start virtually on Sept. 2, and remain fully virtual through the December break from Dec. 21 to Jan. 1, 2021.The district adds that teachers and instructional assistants will receive additional training in virtual teaching platforms and tools in August and that the district will provide all the necessary technology for teachers and students. SAN DIEGO (KGTV) -- Police are investigating after a man was shot several times at a party in Paradise Hills early Sunday morning. According to police, the incident happened on the 2400 block of Hopkins Street just after 2 a.m. Police say the 30-year-old was attending a party at a nearby home when an unknown suspect or suspects shot him several times. Party guests reportedly took the man to the hospital where he underwent surgery. Police say the man is expected to survive his injuries. SAN DIEGO (KGTV) — Nine people were taken into custody Friday after border officials say a panga-style boat was stopped off the coast of Carlsbad.The boat was spotted at about 10:20 p.m. on Thursday by San Diego Air and Marine Branch crews. Officials say the crews used blue lights, sirens, and a spotlight to try and stop the boat, but it would not stop.Crews then used disabling rounds on the boat's engine, bringing the vessel to a stop about 12 miles west of Carlsbad.The nine people on the boat were taken into custody onshore by Border Patrol agents. 564
