SAN DIEGO — Democratic Congressman Mike Levin appears poised to keep his seat in the House of Representatives, according a scientific poll released Tuesday.The ABC-10News Union-Tribune poll showed Levin ahead of Republican Brian Maryott 49 to 37 in the 49th Congressional District, which stretches from Del Mar into southern Orange County. Levin, a first-term Congressman, defeated Republican Diane Harkey in 2018, flipping the seat longheld by Republican Darrell Issa, who decided not to seek re-election amid changing voter demographics. "We're going to do everything we can to leave no stone unturned for the next 50 days or so to make sure that we keep the 49th this coming November," Levin said. Democrats now outnumber Republicans in the district by about 3 percent. The SurveyUSA poll shows, however, that 13 percent of Republicans surveyed said they planned to vote for Levin. SAN DIEGO (CNS) - A 24-year-old woman who succumbed to some type of medical emergency -- possibly a drug overdose -- and became gravely ill after being arrested in University City last week died in a hospital today, authorities reported.Aleah Jenkins was pronounced dead at UCSD Medical Center nine days after being taken into custody, according to San Diego police.On the afternoon of Nov. 27, Jenkins was riding in a vehicle that was pulled over in the 3700 block of La Jolla Village Drive, Lt. Matt Dobbs said.After determining that she was the subject of an outstanding misdemeanor warrant for possession of methamphetamine, officers arrested Jenkins. While still at the scene of the traffic stop, Jenkins became ill and vomited."The officers called for paramedics, but (Jenkins) said she had only had an upset stomach, so medics were canceled," Dobbs said.Jenkins was then taken to downtown SDPD headquarters, where, while being processed for booking into county jail, she passed out, according to police."Officers immediately began lifesaving efforts and called for medical assistance," the lieutenant said.Paramedics took over the emergency aid and rushed Jenkins in for hospital care."During the course of the medical intervention, controlled substances were found concealed in (Jenkins') clothing," Dobbs said this afternoon."At this point, there is no indication any force was used on (her)."A cause-of-death ruling will remain on hold pending autopsy results.Police, however, believe that Jenkins may have suffered a drug overdose, according to Dobbs.The officers who conducted the traffic stop during which Jenkins was taken into custody have been identified as Nicholas Casciola and Jason Taub. SAN DIEGO (CNS) - A collective of conservation organizations filed lawsuits Thursday against San Diego County and its board of supervisors for approving a controversial housing development in the Otay Ranch community, with the groups claiming that the development endangers wildlife and the development's future residents. The project known as Adara was approved last month with a 3-2 vote and involves construction of more than 1,000 homes and a commercial village core, along with an elementary school, fire station, sheriff's office, trails, electric vehicle charging stations, solar panels and more than 700 acres of open space and parks. Environmental groups contend that its location, between the city of Chula Vista and rural community Jamul, is home to several endangered and protected plant and animal species and is at exceptional risk for wildfires. Plaintiffs include the Center for Biological Diversity, Preserve Wild Santee, the California Chaparral Institute, Endangered Habitats League, California Native Plant Society and the Sierra Club. ``Building houses in this fire-prone place will put people at risk, and it'll wreak havoc on golden eagles and other wildlife,'' said Peter Broderick, an attorney with the Center for Biological Diversity. ``By approving this sprawl project, officials have put both homeowners and wildlife in danger. They've dealt a big setback to sustainable development in San Diego County.'' In their complaint, the plaintiffs referenced county data identifying ``22 special-status plants and 28 special-status wildlife species'' on the project site. They also allege that the area is especially prone to wildfires, which was noted by Supervisor Dianne Jacob in her dissenting vote on the project. The complaint states the area ``has burned at least 17 times in the last 100 years'' and is ``at serious risk for fast-moving, wind-driven fires.'' The site's steep terrain would make suppressing fires difficult, and homeowners would only have one evacuation route available, according to the plaintiffs. Peter Andersen, chair of the Sierra Club's San Diego Chapter, called the project ``a fire trap that endangers all East County residents, contributes to severe traffic jams and destroys multiple species' habitat,'' while Richard Halsey of the California Chaparral Institute said ``History has shown that during a wind-driven wildfire, developments like this one in a known fire corridor can and have been destroyed by embers flying a mile or more ahead of the flame front. SAN DIEGO (CNS) - A former member of the U.S. national wrestling team, who was severely injured during a training camp exercise held at Camp Pendleton, has filed a lawsuit alleging the Marine Corps and USA Wrestling encouraged him and other civilians to take part in a military-style exercise involving weapons that the participants weren't adequately trained to use.Richard Perry and his wife Gina Cimmino filed the lawsuit Tuesday in San Diego federal court against the United States and Armament Systems and Procedures Inc., a company that manufactured and sold a padded baton used in the exercise that resulted in Perry's injury on Aug. 27, 2018.Perry and another civilian attendee of the training camp were provided batons and helmets with facemasks and given "instruction to strike, thrust and jab at the opponent's head and face to score a `kill shot,"' according to the complaint.As Perry's training partner jabbed with the baton, the weapon passed through a gap in Perry's facemask and shattered his eye socket and skull, pushing shattered bone fragments into his brain, the suit alleges.The injury nearly killed him and left him with multiple traumatic brain injuries, skull fractures and "permanent, disfiguring, disabling injuries" which "will require extensive future medical care, vocational rehabilitation, and life care for the rest of his life," according to his court papers.Perry and the other wrestlers were invited to Camp Pendleton as part of a joint event held by USA Wrestling and the Marine Corps that was partly intended as a Marine Corps recruitment initiative, according to the suit.Perry's attorneys allege National Team members were required to attend the camp, as non-attendance resulted in "adverse consequences, including losing a monetary stipend they otherwise earn as National Team members."The lawsuit alleges the Marine Corps and USA Wrestling "placed Richard Perry and other civilian Camp attendees into a `fight club'-style full- speed, full-contact military weapons training exercise," and that Marine Corps and USA Wrestling members "recklessly encouraged head shots and baton jabs by the inexperienced participants" during the exercise in which Perry was injured.The helmets provided to Perry and other wrestlers were "grossly unsuitable for the baton striking drills and posed a clear risk of serious injury," according to the suit. The plaintiff also alleges the Marine Corps and USA Wrestling failed to inspect or maintain the equipment used during the exercise and the batons were "dangerously unprotected," with the padding only held in place by duct tape.Robert J. Francavilla, the lead trial attorney on the case, said his client "suffered a traumatic injury that has affected his life, his livelihood and the lives of those who love him.
