A lawsuit has been filed against the County of San Diego and the former Assistant Sheriff for sexual harassment and retaliation.The employee began working for the Sheriff’s Department in 2010 at the Vista Detention Facility, according to the lawsuit.Team 10 is not naming her because she said she is a victim of sexual harassment. The female employee claimed that Miller made “inappropriate sexual innuendo” to her, including tickling her hand.She stated in her lawsuit that she confided in two Commanders about Miller’s behavior, but did not raise a formal complaint because she feared retaliation.She applied for a new job within the department with Law Enforcement Services Bureau Administrative Secretary II “in order to avoid Defendant Miller and his continued harassment.”She was not granted the transfer. She alleged “Miller demoted her in retaliation for her rejection of his sexual advances and efforts to avoid further harassment by him.”Team 10 contacted the Sheriff’s Department late Monday. A spokesperson said Miller is no longer with the department, since he retired.She added they cannot comment on pending lawsuits. Team 10 is still waiting to hear back from a county spokesperson.The woman suing the County of San Diego and Miller also believed that “the county had received and/or was aware of several complaints from other employees about inappropriate sexual behavior of the Assistant Sheriff.”The lawsuit stated the county took no appropriate action to protect from Miller’s harassment.Team 10 previously contacted Miller when these allegations first arose in February.He told Team 10 investigator Melissa Mecija he could not comment on an ongoing investigation. He also said he “absolutely” denied allegations of inappropriate conduct.In late February, before the lawsuit was filed, a sheriff's spokesperson told Team 10: "Despite the allegations in the claim, the claimant was not demoted. The claimant was assigned to another Sheriff's Department facility, prior to raising a formal complaint, and currently receives the same pay and benefits as she did in her prior assignment." 2664

A faulty engine part that could cause vehicles to stall has led to a recall of 400,000 worldwide.The recall affects Toyota Motor Corp. and Subaru Corp., MarketWatch reports. About 80,000 of the 400,000 are Toyotas.Subaru is recalling some of its most popular models, such as the Forester sport-utility vehicle and Impreza and BRZ sports car. Toyota is recalling the Subaru-made 86 and Scion FR-S sports car, MarketWatch said.The automakers announced springs in the engine valve could fracture. That would cause the vehicles to stall and possibly lead to an accident.Earlier in October, Toyota recalled approximately 2.4 million vehicles worldwide due to a problem in which the cars may not enter a fail-safe driving mode as intended, which can cause the vehicle to lose power and stall. About 807,000 of those vehicles are in the United States. If this happens while driving at higher speeds, it could cause a crash. The recall affects 2010-2014 model year Toyota Prius and 2012-2014 Prius v vehicles.There was a second recall involving certain 2018-2019 Tundra and Sequoia vehicles and 2019 Avalon vehicles. About 168,000 vehicles sold in the United States are affected by this recall, which is due to a programming problem in the airbag electronic control unit (ECU) that could disable one or more of the sensors used to detect crashes, possibly causing the side and curtain shield airbags and/or front and knee airbags to not deploy as intended.  1502

A high school teacher from San Diego and her students are up for an Academy Award, KABC reports. They’re all taboo subjects in the United States, periods, menstruation and bleeding. But a group of high school students and their teacher, Melissa Berton, are trying to change that. Berton is originally from San Diego and graduated from Patrick Henry High School. Now, she's a producer on “Period. End of Sentence” and an English teacher at Oakwood High School in Los Angeles. “I think it has been a profound experience from start to finish,” Berton said. In 2013, she advised a group of students who were selected as United Nations delegates to advocate for women and girls. That’s when their journey to normalize menstruation began. “Who better to sort of be the voice for that than high school young women who are in that moment,” Berton said. Originally, the short documentary was a marketing tool for their bigger vision. A non-profit they created called Pad Project. Their mission was to get a machine that creates biodegradable pads to a rural village in India. “We never thought it would be an Oscar nominated film but the idea was always, if we could just make an educational film, to raise awareness about this issue, then that would be the jewel in the crown of our non-profit”The students were in charge of fundraising and creating the non-profit as well as bringing the documentary to life. Seven executive producers on the project are either in college or grad school and several associate producers are in high school. They put the documentary through the film festival circuit and received award after award and an Academy Award nomination. The students along with Berton say that their biggest achievement of all was normalizing periods for women around the world. “I think the students have felt different responses from their classmates and have felt a little less shy about something that maybe we don't need to feel so shy about,” Berton said. 1972

A Clarksville teacher was charged with assault after an incident with a student during a field trip to Nashville was reported to police.According to an affidavit from Metro Nashville Police, Robert Neitzke – a teacher at Clarksville Academy – was arrested after he allegedly grabbed a student by his throat and pushed him against a wall.The alleged incident happened on March 3 while a group of students were staying at the Renaissance Hotel in Nashville. The police report said that Neitzke was the only adult on the trip.Around 11 p.m., Neitzke was reportedly trying to give students instructions for the next day and had to stop several times to get their attention. That’s when one of the students asked, “can we hurry this up,” and Neitzke allegedly approached the student and started to grab him. Police said Neitzke then said “it would be funny if your head hit the wall” before backing up and then grabbing the student by the neck before pushing him against the wall.The student told officers that he was able to say "get off me" and push him back. He told police that while he had no visible injuries, the squeezing of his neck caused “some discomfort.”Several other students were interviewed and all gave a very similar account of the incident, according to the report. A federal judge ruled that Detroit police officers cannot use batons, shields, gas or bullets against protesters for at least the next two weeks.U.S. District Court Judge Laurie Michelson issued a ruling Friday night partially granting a temporary restraining order in the lawsuit filed by activist group Detroit Will Breathe against the City of Detroit and Detroit Police Department.In the order, Michelson ruled that the city cannot use "striking weapons, chemical agents, or rubber bullets" against the protesters who do not pose a physical threat to the safety of the public or the police. Officers also cannot use chokeholds against the protesters."The Court recognizes that police officers are often faced with dangerous and rapidly evolving situations while trying to enforce the law and maintain the safety of the public. And it is important that police officers have non-lethal options to use to protect themselves and the public when necessary," Michelson wrote.
