SAN DIEGO (KGTV) -- Technical problems at the state level impacted the California Department of Public Health's ability to accurately report COVID-19 cases."We are committed to the medium- and long-term to address these foundational data issues so that we can approve our importance and our customer service," California Gov. Gavin Newsom said on Monday.According to the state, the data system they use failed, and that led to inaccurate case numbers and case positivity rates. That failure prevented counties from having some of the data they need to monitor and respond to the virus in local communities, such as contact tracing.The state says that about two weeks ago, a server outage created a delay in lab records coming into the reporting system. At the same time, they realized they weren't getting data from one of the largest commercial reporting labs for about five days."Just thanking all Californians for their patience as we continue to make sure we're sharing this accurate COVID-19 data," said Secretary of California Health and Human Services Dr. Mark Ghaly. "We know how critical it is for planning at the local level for all Californians to feel confident about the trends and where we're heading."Counties across the state felt the impact of the data inaccuracies. Local leaders use numbers and science to guide decision-making.But are counties having any issues with the numbers at the local level?In Kern County, public health officials were asked at the end of July if they're 100% sure no one is getting double-counted for positive COVID-19 tests."That answer would be no…we do get cases that we hear that their addresses are mismatched, they've been counted in another county, they were tested and are in another county, and we are still waiting for that information to flow through so I'm not comfortable saying that we're 100% sure that we aren't duplicating any cases," Kern County Public Health Department Lead Epidemiologist Kim Hernandez said.Public health said less than 18.4 cases were reported inaccurately.Kern County Chief Administrative Officer Ryan Alsop told 23ABC News, "The data and duplication that you are asking about is not a reason we are on the state’s monitoring list."With questions about accuracy at the state level and those raised in Kern County, reporter Adam Racusin asked officials in San Diego and San Luis Obispo counties how confident they are in the daily numbers they report to the public."I'm quite confident our numbers are accurate," said San Diego County Public Health Officer Dr. Wilma Wooten. "We have web CMR, and our tests are not all phoned through CalREDIE system. Our test results are reported directly to the county. The only issue which you already know about is the glitch with Quest."A spokesperson for San Luis Obispo County said they are confident in the number of positive cases reported.A spokesperson for the county said, "When it comes to duplicates, they regularly run data queries on positive case results to search for duplicates. On occasion duplicates have been detected and counts adjusted appropriately."The spokesperson also noted, "With regard to the total number of tests (positive and negative), some individuals may receive multiple tests over time. We do not classify those as duplicates but rather they are counted as distinct testing events. That is to say, if one is tested five times, that will show with five distinct test results. All that said, some locations/labs are not reporting ALL their test results (both negative and positive) through our reporting system. Some are only reporting positive tests. So, there may be some under-reporting of negative tests. Consequently, we are confident that the number of positive case reports is correct, although the number of negative results (and by extension) the number of total tests run, may be somewhat under reported."The California Department of Public Health did not respond to multiple requests for comment about data accuracy and duplicate counting. 4011

SAN DIEGO (KGTV) — The City of San Diego approved a -million contract for a feasibility study and designs for a multi-purpose training facility for first responders.The contract was approved Wednesday by the Active Transportation and Infrastructure Committee. Councilman Chris Cate said he is very excited about the opportunity, "the goal in this endeavor is to have a central location for both our firefighters and our police officers to have a viable long term solution for their training facility."Currently San Diego Police and Fire train at a facility just north of Terminal 2, at Lindbergh Field.Along with asbestos problems, the entire facility will come down to make way for the Pure Water San Diego Project, that will turn wastewater into drinking water."We have to be in construction before that because all of those guys have to be out of there," Cate said the deadline is 2027. He hopes by that time a permanent facility will be open for the first responders.Some of the items on the wish list, "classrooms, virtual simulations and testing/tactical obstacle courses, life-size training buildings, home simulations simulating burn scenarios, and many other necessary components required for a safe city."Cate said another important part of the process is weighing the opinions of neighbors, both in households, and businesses. One woman who works nearby said she's worried how much traffic a facility like that could bring.Cate is most concerned about police, fire and SWAT personnel, "it's incumbent upon us as policy makers to make sure that they have all the tools that they need to do their jobs very well for the public."The study is set to be completed by Summer 2020. SAN DIEGO (KGTV) — The future of Horton Plaza was teased in a new set of renderings released by the firm that purchased the aging mall.Stockdale Capital Partners purchased Horton Plaza in June 2018 with the aim of revitalizing the center into a mixed-use high-tech office and retail space. Wednesday, the firm gave a glimpse at The Campus at Horton, showing a completely transformed Nordstrom building from a concrete facade into a glass-covered office space. SAN DIEGO (KGTV) — The City of San Diego will consider making a significant change to the way voting is done, best known as "ranked choice voting."It would allow voters to list up to four candidates in order of preference, rather than just cast a traditional ballot for one candidate."It's a very interesting system that hopefully decreases some of the negative campaigning that we ordinarily see," Councilmember Mark Kersey, who supports ranked choice, told 10News Friday.In the proposed version of ranked choice that San Diego is considering, the top four candidates in each primary race would advance to the general election, rather than the top two. In November, voters would then rank the candidates by preference. If one candidate has more than 50 percent of the vote on first count, that candidate would win. If no candidate reaches 50 percent, the last place finisher would be thrown out. That person's votes would then be reallocated according to the voters' second choice. The field would continue winnowing until a candidate tops 50 percent.UC San Diego political science professor Thad Kousser says ranked choice allows voters to feel like they are not wasting their vote on a long shot, and helps avoid the idea of voting for the lesser of two evils. "It allows voters to take a sincere vote without throwing away the weight that their vote would have," Kousser said.Kousser also says ranked choice helps keep races from getting as negative. "It could give candidates incentive to play nice with each other, to be less negative in their advertising beceause they would love to be second place on every voter's dance card," he added.Kersey says the City Council will consider placing ranked choice on the November ballot, with the goal of making the change in 2022. If the council elects not to put ranked choice on the ballot, supporters say they will launch a signature drive to get the measure on the ballot that way.Other cities in California have already adopted ranked choice, including San Francisco, Oakland, and Palm Desert. SAN DIEGO (KGTV) - The federal watchdog agency that aims to protect consumers from unfair, deceptive, or abusive practices is suing a San Diego-based company.On Tuesday, the Consumer Financial Protection Bureau (CFPB) sued Encore Capital Group and its subsidiaries, claiming they violated the terms of a 2015 legal agreement.The CFPB claims, “Since September 2015, Encore and its subsidiaries violated the consent order by suing consumers without possessing required documentation, using law firms and an internal legal department to engage in collection efforts without providing required disclosures, and failing to provide consumers with required loan documentation after consumers requested it.”The lawsuit says after the effective date of the consent order, “Encore filed more than 100 lawsuits to collect consumer debts after the applicable statutes of limitations had expired."The lawsuit also claims Encore failed to disclose that consumers might incur international-transaction fees.In response to the lawsuit, the company's Executive Vice President, General Counsel, and Chief Administrative Officer Greg Call said Encore is built on a foundation of treating their consumers fairly and respectfully."We are disappointed that the CFPB has chosen to file this lawsuit on outdated issues, but we will continue to engage with the CFPB and work to ensure that we maintain policies and practices that fully comply with all applicable legal requirements. We believe that there will be no material operational impact as a result of the suit," said Call. "We fully corrected the issues underlying the allegations in this lawsuit years ago and are unaware of any unresolved consumer impact."DEBT COLLECTION LAWSUITSPart of the complaint talked about debt-collection lawsuits.In July Team 10 discovered a 157% increase in the number of rule 3.740 collections lawsuits filed in San Diego County court from 2015 to 2019.
