SAN DIEGO (KGTV) -- A .2 million judgment against the San Diego Rock ‘N’ Roll marathon over injuries suffered by an elite wheelchair athlete was recently upheld.Craig Blanchette was born without legs due to a birth defect, but that has not stopped him pursuing his passions. He is a wheelchair racing champion. At 20-years-old, he won a bronze in the 1988 Summer Olympics and over the years, set more than 20 world records. “Wheelchair racing just fit me,” Blanchette said. He eventually took a break to compete in hand cycling, but was preparing to return to wheelchair racing. Court documents said he did everything to prepare for the 2014 Rock ‘N’ Roll marathon, including studying the course map and virtual tour several times. Documents state Competitor Group, which operates the marathon, eliminated a lane on Eleventh Avenue an hour before the race—a move that changed Blanchette’s life. “I wasn’t racing recklessly. I was definitely going to make the corner,” Blanchette said. “When it’s too late to do anything about it, I realized the course had been narrowed by 13 feet. It was significant.” Blanchette was not aware of the change and crashed into a car. He was going more than 20 miles per hour at the time, according to court documents. “It’s the crash that ended my career,” Blanchette said.He filed a civil case against Competitor Group. A jury ruled in his favor and the Court of Appeal recently upheld a judgment of .2 million in his favor. “It’s the best they can offer because they can’t me my racing career back,” he added.It was bittersweet for Blanchette, who had to undergo surgery and several months of recovery. “The doctors basically told me that if I went back to racing and I injured it again, they wouldn’t be able put it back together like I did the first time,” he said.Blanchette now hand cycles, which uses different muscles, and spends time helping other athletes. He has been part of the National Wheelchair Sports Camp for years and this year, Blanchette’s attorney is also helping out. “This case was very eye-opening for me,” said attorney Russel Myrick. “With the proceeds from the case, we intend to make big improvements to the camp and we’re really looking forward to working with the kids.” They hope this ruling will help other athletes with disabilities. “They didn’t accommodate for us in the way that we deserved,” Blanchette said. “[You] want to treat us the same in value, but not the same in function.” Competitor Group did not return Team 10’s request for comment. 2529

Jacob "Jake" Portier faces an Article 32 hearing on suspicion of covering up a string of war crimes allegedly committed by Special Operations Chief Edward "Eddie" Gallagher.The Naval Criminal Investigative Service probe involves the death of a wounded Islamic State fighter near Mosul, Iraq in May 2017, the Navy Times reported.Prosecutors allege Gallagher stabbed and killed the wounded man, posed for a photograph next to the body and opted to complete his re-enlistment ceremony next to the corpse, bringing "discredit upon the armed forces."Gallagher is also accused of shooting two non-combatants in separate incidents near Mosul, the Navy Times reported.An MCAS Miramar spokesman could not immediately be reached for comment.Gallagher was arrested on Sept. 11 and is being detained at the Naval Consolidated Brig Miramar at the Marine Corps Air Station Miramar, under Rules for Court-Martial 305, the Navy Times reported.Portier, who is accused of dereliction of duty, was not present at the time of the alleged killing, the Navy Times reported. SAN DIEGO (KGTV) — A Camp Pendleton Marine was taken into custody this week after border officials say the Marine was trying to smuggle immigrants through a port of entry.The junior-enlisted Marine was taken into custody early Monday morning by U.S. Customs and Border Protection personnel at the San Ysidro Port of Entry, according to the 1st Marine Division at Camp Pendleton. The Marine was reportedly bringing undocumented immigrants into the port.The Marine is being held in civilian custody and CBP and the Naval Criminal Investigative Service were investigating. In July, 23 Marines were detained over human trafficking, drug distribution, and weapons charges, according to the base.Of those 1st Marine Division Marines, six have pleaded guilty at court martial appearances. Thirteen Marines have approved pre-trial agreements requesting separation from the Marines instead of court martials or waiving separation board processes. He was hospitalized for six months and had to re-learn how to walk again."One minute I'm being a Marine, the next I'm in the hospital confused and dazed, I couldn't walk, I had no idea what happened," said Sanders. Today he suffers from memory problems and weakness on his left side, but Sanders is far more accepting of his injury."Life with a brain injury is hard, but it's not impossible."Sanders is dually enrolled at San Diego Miramar College and will complete an Associate in Arts in Kinesiology for Transfer Degree. Gavin Newsom ordered thousands more body bags for distribution to morgues in three counties, including San Diego, state health authorities reported a new high for coronavirus-related deaths and cases.California recorded 53,711 new COVID-19 cases and 293 additional deaths on Wednesday. The state's previous high for deaths was set Saturday with 225.On Tuesday, Newsom ordered 5,000 body bags during a surge in deaths over the past week, averaging over 160 per day."This is a deadly disease, a deadly pandemic, and we're in the middle of it right now," Newsom said Tuesday. "We're near the end, but we're in the middle of the most acute peak as it relates to what we refer to as the third wave -- the third and what we hope is the final wave of this disease."Newsom also said that 60 refrigerated storage units are ready to be mobilized across California should hospitals become overwhelmed with virus fatalities."We just had to order 5,000 additional body bags ... and we just distributed them down to San Diego, Los Angeles, Inyo counties," he said. "That should be sobering. I don't want ... to scare folks, but this is a deadly disease. And we need to be mindful of where we are in this current journey together to the vaccine.
