(CNN) - Joaquin "El Chapo" Guzman's complaining about lack of outdoor activity may be part of a plan to escape from detention before his sentencing next month, federal officials allege.An attorney for Guzman this month asked a federal judge to intervene over "cruel and unusual" prison conditions for the drug kingpin detained in a federal prison in New York.In the more than two years he's been detained, he's not had access to fresh air or natural sunlight, and is forced to put toilet paper in his ears to mask loud prison noise, his attorney wrote in a letter to the judge.The United States issued a response to the allegations Thursday, saying the only outdoor exercise space at the facility is a rooftop with a wire mesh covering.That facility was the site of a 1981 attempted jail break -- where an inmate's cohorts hijacked a sightseeing helicopter and attempted to cut open the wire mesh covering, the US said."In this case, any outdoor exercise time would be particularly problematic for this defendant," the US said." The defendant has successfully planned and executed elaborate escapes from two high-security penal institutions. As detailed at trial, one of the defendant's escapes involved the construction of a sophisticated, ventilated tunnel that stretched for over a mile. Certainly, an escape via rooftop, using a helicopter, or any related means would be elementary by comparison."He will be sentenced next monthGuzman, once the leader of a murderous drug cartel in Mexico, was convicted in February of running a criminal enterprise and other drug-related charges. He will be sentenced on June 25.He's been in US detention for 27 months, and is in solitary confinement in a 10-by-8-foot windowless cell in Manhattan, according to his defense attorney, Mariel Colon.In the letter to the judge, the attorney described what she called a series of punishments against the drug lord. The light is always on in his cell, leading to a "serious issue of sleep deprivation," she wrote.In addition to the lack of light, the air conditioning in his cell is so loud, he is unable to sleep through the noise, his attorney said. As a result, Guzman has been using toilet paper as earplugs, and he complains of daily headaches and ear pain that makes it impossible for him to use earphones."The reason for the restriction is simple: If there were an emergency, an inmate would not be able to hear the guards alerting the inmates to the problem. Inmates could also use the earplugs as a ruse to ignore, or pretend not to hear, the guards' orders," the government said.The defendant has a week to respond The attorney asked the judge to order the Bureau of Prisons to grant Guzman access to two hours of outdoor exercise a week, earplugs and the same food and drink offerings as other inmates.But the government said he has access to "several different types of exercise equipment, including an exercise bike and elliptical, and a vented window that provides the defendant with access to fresh, outdoor air and sunlight."The US Attorney's Office for the Eastern District of New York and the Bureau of Prisons declined to comment when reached by CNN this month. The judge had ordered the government to respond by May 23 and the defendant a week later.The government has called for Guzman to be placed under restrictive detention conditions to prevent him from running the Sinaloa Cartel from prison, coordinating an escape from prison, or directing attacks on individuals he believes are cooperating with the government, according to the filing. 3560

Tijuana is the most dangerous city in the world, according to a report by the Citizens’ Council for Public Security and Criminal Justice. The Los Angeles Times reports that five cities in Mexico are among the most dangerous in the world. The list includes Acapulco, Victoria, Juarez, Irapuato and Tijuana. The report was published shortly after the U.S. Embassy & Consulates in Mexico issued a warning to people traveling for spring break. The alert warns of dangers including unregulated alcohol, sexual assault, medical emergencies and breaking the law in Mexico. According to Journey Mexico, more than 10 million people visited Mexico during the first quarter of 2018. Cancun is one of the top destinations in Mexico for spring breakers. (KGTV) — A National City woman is heartbroken after she was forced to leave her beloved fish at Denver International Airport. It was supposed to be a happy homecoming for Lanice Powless and her best friend."I've taken him everywhere with me," she said.But Wednesday, the University of Colorado sophomore left Denver without "Cassie," her pink, male beta fish."This lady was just not having it," Powless said. "So the supervisor comes and she said 'Unfortunately, you cannot bring fish onto Southwest Airlines,'" Powless said.Her freshman year in Colorado, Powless admitted she was lonely and wanted a pet. She considered getting a dog or cat. But her mother convinced her that a fish would be a better fit. She got Cassie at the local Petco, but did not realize she would end up falling in love with him. "I put my finger in there, he come up and nibble my finger. He was a cool fish," she said. "I even got him a heater, because it gets so cold in Colorado."According to the TSA website, live fish are allowed on board as a carry on. Powless said she never had any problems bringing Cassie along on her usual Southwest flight. But according to the airline, only small cats and dogs that fit in an under-seat carrier are allowed."I have traveled with it. I had it in my container too. Maybe they just didn't make a big deal out of it at the time?" Powless said.But this time, she said she was utterly humiliated. When she asked Southwest staff if she could leave Cassie on their counter so a friend can come a pick him up in half an hour, they denied her. So she frantically started to look around the airport for a new owner. She eventually found a traveler on another airline that allows fish on board, to care for Cassie on her behalf. But airport staff separated them, so Powless never got her name. "They were not allowing us to converse at all because they were thinking we were going to do some secret exchange throughout the airport," Powless said. "Even after I was no longer in possession of the fish, they still continued to have security around us, and follow us through the airport and escorted onto our plane, as if we brought something bad onto the airport," she added.Powless said airport staff made her feel like a criminal. Now spending winter break back in National City, she is the one who feels like a fish out of water, lost without her little sidekick swimming by her side. "Everyone's laughing at me. Yes, it's a fish. I know. But dang, it was my pet. And just because it wasn't a cat or dog, it wasn't as important?" Powless said.10News reached out to Southwest Airlines. A spokeswoman said airport staff are trained and in this case, followed protocol. She said counter staff offered a later flight so Powless could make arrangements for her fish, but said she did not take the offer. The Southwest spokeswoman did extend apoligies on behalf of the airlines for making Powless feel uncomfortable. 2930
