A conservative legal group has filed a lawsuit against Maricopa County claiming that votes were disqualified because some people were given a Sharpie to fill out their ballots. The legal group, Public Interest Legal Foundation, says that the ink from the Sharpies bled through the ballots causing them not to be counted. The Maricopa County Recorder’s Office and the Secretary of State, however, both say concerns that surfaced Wednesday over the use of Sharpies are unfounded. Officials spoke out Wednesday morning, saying the use of a Sharpie to fill out a ballot is perfectly fine and no votes would be discarded for that reason. Did you know we use Sharpies in the Vote Centers so the ink doesn’t smudge as ballots are counted onsite? New offset columns on the ballots means bleed through won’t impact your vote! She claims she was told to submit the ballot anyway, and that it was denied. Neither the Secretary of State's Office nor County Recorder's Office have given any information on whether or not there was a separate issue that caused Aguilera's ballot to not be accepted. The questions over Sharpie use on ballots came as ABC News reported Wednesday that Gov. Doug Ducey told the White House he “sees something” that could get Arizona and its 11 electoral votes in the win column for the President. FULL RESULTS: Track election results in ArizonaArizona Secretary of State Katie Hobbs is on the record defending the Sharpie ballots, though a ballpoint pen is the recommended method for filling out a ballot.Sharpie is the trademarked name of a permanent felt tip marker. Its use on Arizona ballots became a prominent conversation point on Twitter overnight. The Maricopa County Elections Department says even if marks made by Sharpies or any felt tip marker on a ballot bleed through the paper, it won't impact their tabulator's ability to read contests. Maricopa County's tabulators are designed only to read the ovals for each contest, according to county election officials. Even if ink bleeds through to the other side of the ballot, the ink won't mark another contest, since ballots are printed in an "off-set" pattern, meaning contests on the back side of the ballot don't align with those on the front.Republicans and the Trump campaign were shocked when Fox News declared Democrat Joe Biden the Arizona winner at about 9:30 p.m. on Election Day. Ducey Tweeted his displeasure as Fox News election analysts defended the decision. Arizona remains too close to call in most media projections, but AP called Biden as the winner early Wednesday. ABC15 data analyst Garrett Archer says as votes are counted, the President will likely pick up more votes than Biden and the Democrat’s lead will shrink. It’s unclear if the President can overtake Biden, who is riding the wave of record early voting that favors Democrats. Tabulation continues throughout the state, focusing on ballots that were dropped off on Election Day and those that arrived by mail and were not part of the early counting process that began October 20. NASHVILLE, Tenn. – After tornadoes ripped through parts of Nashville, Tennessee, a strong group of black men is taking steps to rebuild a community. “Nashville strong,” said Demetrius Short, captain of the Nashville chapter of Black Men Run – a brotherhood inspired through health and wellness that has thousands of members and dozens of chapters across the country. “Two days a week we come out and put all our stress and anxiety under our feet,” Short said. This group of African American men is helping their community from ground zero. “We want you to be to be encouraged about your educational success but also as men of color and men in general we want you to know about your health,” Short said. Short and other members of BMR go to local elementary schools to help inspire students. It's part of the group’s Black Men Run, Brown Boys Read program. The most recent lesson was all about helping these children deal with their emotions following the destruction the deadly tornadoes left behind. “Some people just don’t have anything,” said third grader Tyler Hanserd. “They don’t have electricity a roof over their heads they don’t even have a house.” Judging from the support, these sessions seem to be working well. “I love what black me run do with our boys their excited,” said Myra Taylor, the executive principal at Buena Vista Elementary School in north Nashville. Taylor says BMR gives her students strong black men to look up to. “It helps our kids release some of the anxiety,” she said. “A lot of them lost homes, they lost items, they lost clothes, but they come back and we’re all here and that matters to our kids.” That includes kids like Hanserd, whose family lost power for a week following the tornado. “People lost their lives and people don’t have shelter, they don’t have food and they don’t have water,” he said. “So, that’s not cool.” BMR leaders say mentoring youth is directly connected to fostering community awareness. “Our motto here is, ‘We don’t run through our community, we run with it,’” short said. Short added that it’s important to teach children that they don’t have to wait until they’re older to make a difference, but that they can make an impact on their communities today. “We’re teaching them about perseverance, determination, overcoming obstacles so they don’t quit on mile one they don’t quit on mile two or mile three,” he said. “They come across the finish line.”For BMR, there’s no quitting physically, emotionally or spiritually. Members are helping historic black churches by donating supplies and cleaning up the damage. “This is the devastation of the tornado that hit Nashville,” Bishop Marcus Campbell of Mt. Carmel Missionary Baptist church said while pointing out damage and debris. Campbell added that BMR has helped at a higher level. “It touched my heart to see there’s still humanity that still cares for one another,” he said. “I know that we are better together and we are going to be better than what we was before the all this had taken place.”Because BMR is Nashville strong and Tennessee tough, the group is ready to run down that long road of recovery for as long as it takes. 3172

BLOOMINGTON, Indiana — A man said he was almost lynched over the July 4 weekend at Lake Monroe in Bloomington. He said a group of people physically assaulted him and threatened him using racially-charged language. The mayor of Bloomington has condemned what he saw in a series of videos that has now gone viral, being shared thousands of times. The video shows several men holding a black man against a tree, with his arms behind his back, allegedly threatening to lynch him.'Let him go, dude, please let him go. Please let him go.'"To be pinned down at the tree and hear him yell at his friend, 'Get a noose,' not even a rope, to get a noose with so much intent and the connotation that that carries in our society, I knew my life was in danger," Vauhxx Booker said.In disbelief is how Booker said he felt when men were seen holding him against his will — shouting 'white power' and other racial slurs."There was a moment where a white woman that was standing by yelled out not to kill me and as I was underneath these men struggling to breathe. I realized that she was talking about me, not to kill me," Booker said.Booker said he and some friends went to watch the lunar eclipse on the 4th of July at Lake Monroe. A group of men informed them the route they were taking to get to the public access beach was on private property but then things got hostile, leaving Booker with a minor concussion, abrasions and patches of hair ripped out."What went through my mind was I could be the next person like that or I could be the next hashtag," Booker said. What saved his life, Booker said, was his friends along with bystanders that heard the commotion and demanded the attackers let him go, refusing to leave."They stayed. It made a difference," Booker said. "I wasn't going to be a Black person that died and heard my own death narrated in front of me.""Horrified," Shelli Yoder, Democratic candidate for Indiana Senate District 40, said. "I am horrified, not surprised, but disgusted.""My heart is breaking for our town," Nicole Bolden, Bloomington city clerk, said. "This is Bloomington. And I know people love to say this doesn't happen in Bloomington. It does. A lot."Booker called the police and the Indiana Department of Natural Resources came but no arrests were made at the scene."It is not ironic that this would happen the weekend of Independence Day," Yoder said. "We have to do the work in order for all people to truly be free."The Indiana Department of Natural Resources on Monday evening released the following statement: The Indiana Department of Natural Resources, Law Enforcement Division responded to a call for service regarding a battery on July 4, 2020 at approximately 8 p.m. on private property adjacent to Monroe Reservoir property.DNR is investigating after a 911 call was transferred to Indiana Conservation Officer Central Dispatch. Additional investigation and interviews are underway. The Indiana Department of Natural Resources, Law Enforcement Division is working diligently with the Monroe County Prosecutor’s Office to ensure a lawful resolution. This matter remains under investigation and no further information will be released at this time. This article was written by Stephanie Wade for WRTV. 3264
