SAN DIEGO (KGTV) -- While the San Diego Padres lost to the Los Angeles Dodgers Tuesday night in Game 1 of the National League Division Series, fans were thankful to be able to participate in the action alongside other San Diegans. While much of the Friar Faithful couldn’t make it to Texas to cheer on the Padres, the playoff excitement was still felt downtown, and for some, that was enough.“Unfortunately, you can’t watch it live, but to be surrounded with a group of people that are all watching it and all really excited, it’s pretty magical,” said Andrea Durkee, a resident of downtown and Padres fan. “I think we all needed something just happy and exciting and to look forward to, and this is absolutely the best thing we could have downtown.”Some fans watched the first game in the best-of-five series from Petco Park’s Tailgate Lot, which was transformed into a drive-in style viewing party.“I have season tickets actually, and we weren’t able to go this year, which is a huge bummer, but we’ve made the best out of it,” said Catie Vance. “We’re excited that we got to do this, at least.”Spectators on the other side were just as excited.“Grew up in LA, my grandfather had season tickets, I’ve probably seen 100 Dodger games at Dodger stadium I haven’t seen them win the world series yet, I’d love to see that, but I guess if someone has to go and the Padres do go, there’s worse things that can happen in life,” said Michael Martin, a Dodger’s fan.Facial coverings were required for all fans outside of their vehicles, and vehicles were spaced 20 feet apart to encourage social distancing. 1606

SAN DIEGO (KGTV) — Video posted to Facebook Wednesday showing a violent encounter between a Pacific Beach worker and homeless man has already gained hundreds of shares and comments. You can see someone come out of B-Mo's Sandwich Shop on Garnet Avenue and push a table into a shirtless man's head, then begin throwing his belongings into the street. 10News reached out to the owner of B-Mo's but were told he wasn't available for an interview Thursday. But Pacific Beach locals who saw the video told 10News the video shows San Diego's homelessness issue has reached a boiling point locally."If you look at the video you can tell it's at the point of escalation," said Mike Bremer, who owns a nearby tattoo shop.Bremer says while he might not agree with how things played out, he understands how it could happen. "I don't condone using that kind of violence I'm here to support because something needs to be done," Bremer said.Bremer and other locals said they deal with issues related to the homeless on a near daily basis and it can make doing business difficult. Thursday, two San Diego Police officers arrived at B-Mo's, but wouldn't comment. A spokesperson for SDPD said officers were initially called out when the confrontation happened but the homeless man wasn't cooperative and the other man didn't want any further action taken. Police said Thursday in light of the video evidence they've now opened up a criminal investigation into the incident. It's unclear if anyone will be charged. 1502

SAN DIEGO (KGTV) -- With a shortened and fanless baseball season underway, there is still confusion and legal challenges over refunds for tickets.Sydnie Gallegos lives in San Diego, but she is a loyal Dodgers fan. Every year, she and moe than a dozen of her family members see a game live at Dodgers Stadium. “We do it once a year, every year, for the last six years,” Gallegos said.Gallegos, like so many others, were left in the dark wondering what to do about tickets they bought. Her family bought tickets to a July 4th game back in March. “It was for 15 of me and my family members. That’s over ,400 just in tickets,” Gallegos said.Although Major League Baseball announced refund policies in April, Gallegos said they didn’t hear anything until July. They received an email from the Dodgers, offering ticketholders “with an account credit for all 2020 tickets and parking (plus applicable fees).”The team also added a 10 percent bonus credit, which could be applied for the 2021 season. A spokesperson for the Padres also said they’re also offering fans a refund or use their credit towards the 2021 season.Despite refunds now being issued to fans, a class action lawsuit over the issue continues. Several ticket buyers sued Major League Baseball, the teams, as well as StubHub, Ticketmaster, and Live Nation. The attorneys for the plaintiffs said they are still moving forward with the lawsuit because they “continue to pursue their claims so that each ticket purchaser for the MLB 2020 season will receive a full refund as soon as possible.”“As the season will have no fan attendance, Defendants have no reason to keep any of the ticket purchasers’ money,” attorney Blake Yagman wrote to Team 10. 1712
