SAN DIEGO (KGTV) - Parents with students in the San Diego Unified School District are concerned after finding out the state medical board subpoenaed doctors who wrote their students medical exemptions for vaccinations.The district’s physician, Dr. Howard Taras, tells 10News, “We have many more medical exemptions over the past two years than we’ve ever had before.”Taras worked with the district for 30 years and says the increase in medical exemptions concerned him, so he brought it to the Committee on Infectious Diseases of the American Academy of Pediatrics.“I gave them loose data, like how many kids in the school district had medical exemptions that any doctor would see as a very worthwhile reason and how many were coming from doctors that were not very sound reasons in common medical practice," Taras said.The committee then took that list to the Medical Board of California. Now, parents in the district are upset knowing their child was included in a list sent to the state.“I’m absolutely appalled at the irresponsibility to have compiled this list in the first place. This is nothing that should have ever been getting out," a mother who did not want to be identified told 10News.10News learned the medical board is now investigating and has already subpoenaed 32 doctors who wrote medical exemptions for students in the district. A parent shared the letter that was sent home with their student with 10News. The letter states the information being subpoenaed includes:1. The unredacted copy of medical vaccination exemption letters 2. The name and date of birth of all children with medical vaccination exemption 3. The name(s) of the parent and/or legal guardian 4. The contact information of the parent and/or legal guardian “This is a violation of FERPA this is 100 percent unethical and I would say illegal based upon what’s taken place," a parent said.The district’s litigation specialist explains all parents have the right to seek protective action to prevent the disclosure of records. “If some of the actions that I and the medical board have taken lead to fewer medical exemptions, I really truly believe we will save people from fatality," said Taras.A representative with the state medical board responded to our request for more information saying, “The Board does not provide information on its complaints and investigations as both are confidential by law.” 2398

SAN DIEGO (KGTV) — One person was killed and another person was in critical condition following a shooting in Shelltown early Saturday.The shooting was reported at about 1:30 a.m. near Epsilon St. and 42nd St., according to San Diego Police. Two men were standing outside when the shooting occurred, but it's unclear what led up to the gunshots.One man in his 50s died and another man in his 60s suffered non-life threatening injuries.Police were not able to immediately give a suspect description, but were interviewing neighbors Saturday morning. 556

SAN DIEGO (KGTV) -- Police are searching for a suspect Tuesday they say threatened a woman with a gun in an hotel bathroom. According to police, the incident happened in a bathroom at the Hilton on the 4200 block of Taylor Street in Old Town.Police say the man threatened the woman with a semi-automatic gun.Initially a man who matched that description was detained after a short foot chase. Police say he ran for unknown reasons but was quickly released when they determined he was not the attacker.Authorities describe the suspect as a black man in his mid-20s who is five feet, eight inches tall, was wearing a gray shirt, tan pants, a light colored backpack and has short hair.The suspect is wanted for brandishing a weapon, battery and assault with the attempt to commit a sexual offense. 806

SAN DIEGO (KGTV) — More rain arrived in San Diego Wednesday, less than a week after a storm swept through the county, leaving some areas flooded and city crews preparing for the wet weather.In Coronado, on First Street, crews worked to clear pipes near the shoreline. This is a large reason for flooding in the area. Public Services Director, Clifford Maurer, says flooding comes after sand and sediment gets into the storm drain from the high tides.“Some of the outfalls, the pipes that go into the bay or into the open waters have flapper valves on them. So they only allow water to go out, not come in,” says Maurer. “But when the water is above those valves there’s nothing you can do. The bags are already filled and can be picked up at four different locations around the island.The City of San Diego is also preparing for the rain. SAN DIEGO (KGTV) - On Monday, San Diego County supervisors met privately to discuss options if the county is moved back into the most restrictive tier.Although the meeting is taking place behind closed doors, it's not stopping them from sharing their frustrations publicly.At a press conference on Monday morning, Supervisor Nathan Fletcher called the actions of two of his fellow board members reckless and irresponsible."Supervisors Jim Desmond and Kristin Gaspar are inciting a fight between government and small business," Fletcher stated. “They are exploiting the pain and suffering the small businesses are going through as a result of the global pandemic as a wedge for political gain."Responding to the statements made at the press conference, Supervisor Kristin Gaspar said that she's never supported an approach to reopening that was not supported by the Public Health Officer and clinical leadership team.In a statement, Gaspar wrote, "Supervisor Fletcher knows this but prefers to continue spreading this false narrative because he is actively running a campaign against me. I measured the distance between our office doors, and it is 7 feet, so he and I can actually have a socially distanced conversation anytime he isn't holding a press conference."The public display of animosity comes as supervisors continue to discuss different options, including taking legal action against the state, to prevent potentially sliding back into the most restrictive risk level.Fletcher is against any potential legal action; Gaspar is for it.A spokesperson from Supervisor Jim Desmond's office said Desmond is weighing the options and waiting to hear any potential ramifications.On Monday, Supervisor Dianne Jacob told 10News, "I will do what is legally possible and where we are on solid legal ground. We do have a good solid legal option here."Jacob said the colleges and universities have a choice whether to allow students back on campus and hold in-person classes. She explained businesses have no choice, and she will fight to keep them open.A spokesperson for Supervisor Greg Cox told ABC 10News they wouldn't comment before the closed-door meeting.Legal actions by citizens and government entities against the state aren't uncommon.ABC 10News has reported on businesses and churches suing Gov. Gavin Newsom.At the end of July, the Orange County Board of Education voted to file a lawsuit against Gov. Newsom and the California Public Health Officer to seek a court order that sets aside the state orders preventing public schools from holding in-person classes and resuming services on campus."There's precedent from before the pandemic and during the pandemic for the county and other local governments to file suit against the state government to try to get the courts to weigh in on who holds the reins," said Lindsay Wiley, Professor of Law at American University Washington College of Law.Wiley said if the county did file a lawsuit, it's likely the courts would defer to the governor based on recent rulings."These cases are unpredictable and there's a fair bit of discretion left to the courts to decide these issues," Wiley said. "It's hard to say much given that we haven't seen what the complaint is that the county might bring but for the most part the general trend has been to uphold reasonable orders of this type." 3346
