SAN DIEGO (KGTV) — A San Diego hairstylist is suing Governor Gavin Newsom over closures of indoor salons. It comes even after a revised order that allows them to operate outside.Amy Mullins-Boychack doesn’t take just any client.“They might have to pace for 15 minutes before they can regulate their anxiety to get a hair cut,” she said.She’s been cutting hair for children with special needs at her salon “THAIRapy” for eight years. Under restrictions from the state, salons are only allowed to operate outdoors.She says that’s not an option with her clients.“I have clients that don’t have impulse control,” said Mullins-Boychack. “They don’t have the ability to just sit anywhere and get a hair cut.”So she joined a lawsuit filed against the governor in March. The plaintiff, JD Bols, is a landlord to several churches and beauty salons in San Diego.The lawsuit also names Mayor Kevin Faulconer, Sheriff Bill Gore, and the County Board of Supervisors as defendants. It claims the pandemic-related restrictions violate civil rights and have financially crippled businesses deemed non-essential.“This isn’t about vanity," says Mullins-Boychack. “This is a life skill for them, this is routine, this is repetition, this is part of their livelihood, part of their social skills.”In addition to the lawsuit, she’s working to get an exemption from the governor to continue her business indoors. 1398
SAN DIEGO (KGTV) - A North Park woman is wondering what went wrong after she quickly paid off a fine for a parking ticket, and then got hit with a big late fee.On the second Tuesday in November, Stacy parked her car on Meade Avenue near her home in the morning. When she got off work later that day, she found something unexpected on her windshield."I didn't read the sign correctly. Parked in a spot that said 'No Parking' and got a ticket," said Stacy, who asked 10news not to use her last name.For parking in a street sweeping zone, she received a ticket for .50."Wrote the check the next day and sent it in the mail the following day," said Stacy.Stacy says she included the ticket in her payment and put the citation number on the check."At that point, I thought everything was fine," said Stacy.A few weeks later, she got a notice from the city saying the citation hasn't been paid, and she had a few weeks to pay it. Stacy wrote another check for .50 and sent it in the mail. She stopped payment on her initial check. Fast forward to late December, when she got another notice. Her payment had been received, but she now owed a late fee of ."How I felt was frustration. I felt a lot of frustration, because I felt like I had done what I was supposed to do," said Stacy.Stacy ended up paying the late fee online. She's not alone. After posting details of her ordeal on the Nextdoor app, another driver responded with a similar story. He reported that his check wasn't processed until after the late deadline."My concern is other people aren't able to afford late fee," said Stacy.Stacy won't be mailing any more checks when dealing with the city. "If checks aren't the way to do things, and they can't get to the volume ... we just need to know about it," said Stacy.Stacy says her initial payment didn't get lost in the mail, because the city tried to cash it - weeks after the late deadline.A city spokesperson released the following statement:"Check payments are processed by a third party vendor located in Inglewood, Calif. The average processing time in calendar year 2019 was six days for payments mailed to the vendor. Recently, the vendor encountered delays due to the installation of new remittance processing equipment. The new equipment had connectivity issues which created a backlog of payments. Customers who reached out to the Office of the City Treasurer during the backlog were advised not to stop payment on their checks, the postmark date was considered the legal payment date. When the payments were processed, the postmark date would automatically roll back any late fees if assessed. The Office of the City Treasurer generally advises customers to use the online option as the payments are posted in real-time ... (Stacy) put a stop payment on her original check payment. When stop payments are initiated on checks, it triggers an automatic process that rolls back the original payment. When this occurs, the bank will assess a stop payment fee that is added to the balance due. Late fees were automatically assessed. Her original payment was timely. SAN DIEGO (KGTV) - A plan that has the potential to triple Mission Valley's population by 2050 will be voted on by the San Diego City Council Tuesday.The city will vote on the final draft of the proposed Mission Valley Community Plan. It replaces the last plan that was written back in 1985. Supporters say it will help address the region's housing crisis. "One of the biggest problems we've had in the city is our community plans haven't been updated in decades. So, whenever developers come in and want to build housing they have to get conditional use permits and that takes sometimes over years to get accomplished, and that drives the cost of housing up," said councilman Scott Sherman whose district includes Mission Valley.Currently, Mission Valley is zoned mixed-use and residential. The new plan would rezone it to almost all mixed-use. Developers would be able to build up to 145 housing units per acre, instead of 73 units per acre. "Apartments and condos, density around mass transit, that's the whole idea, we need housing so let's make it more dense around transit oriented hubs, cause we have the trolley that runs right through Mission Valley," said Sherman. People who work in Mission Valley are worried that traffic will be a nightmare in an area already known for gridlock. "It's already congested as it is, so to build more, where?" asked Eni O'Donnell. "It depends on how well they plan integrating it all in, if you bring in 50,000 people overnight, then obviously, that's not going to work," said Archie Kordestani who lives in Civita. The plan includes several new bike and pedestrian bridges, connectors to help with traffic, and more transit stops along the trolley's green line. "Busing, biking, trolleys, I think these are the ways to go," said Kordestani.The project also includes 160 acres of park space and two schools. SAN DIEGO (KGTV) — A Pacific Beach woman is appealing for tips after a hit-and-run driver struck the motor scooter she was riding, leaving her with serious injuries.On Saturday afternoon around 1 p.m., yoga teacher Fallon Lev was headed to a yoga studio, riding her motor scooter on Ingraham Street, when she exited onto Sunset Cliffs Boulevard."Just gotten onto the ramp, going a reasonable speed," said Lev.In a one-lane section, she looked to her left and felt a car right next to her."It bumped me, causing the scooter wiggle back and forth. Instantly, I'm like on the floor, and my whole body is tumbleweeding on the cement. I must have gone five or six times," said Lev.She says the driver kept going. Later, at the hospital came the diagnosis and surgery."I broke my pelvis in two different areas and have these two bars sticking out of my hipbone and a bar straight across," said Lev.She also suffered a painful road rash and a broken tooth. Her road to recovery will be a long one. Lev, a yoga teacher whose income was greatly impacted by the pandemic, is trying to stay positive. The actions of the driver make her angry."I'm trying not to affect it my healing. Of course, it's extremely disturbing and disappointing ... There is no way the driver didn’t see me go down. SAN DIEGO (KGTV) - A jury deadlocked Friday on two key charges regarding a drunk driving crash that killed a Lyft driver on SR-94.Steven Quintero was charged with six counts including murder and gross vehicular manslaughter in the Oct. 1 death of 41-year-old Henry Reyes of Escondido.The jury reached verdicts on four counts, finding Quintero guilty of DUI causing injury, DUI, hit and run with death, and driving on a suspended license. The judge declared a mistrial on the murder and gross vehicular manslaughter charges.RELATED: Testimony in Lyft?driver's death continuesReyes was taking three women home from a night downtown when the crash happened. One of the women became ill and Reyes pulled over on the shoulder of SR-94 near 28th St. to give her some water.Minutes later, the Lyft car was hit from behind by Quintero’s car. Reyes, an aspiring dentist and the father of a 2-year-old child, was killed as he walked around the car to get back in."I was hit so hard I didn't know where I was," said passenger Kelly Hoffman, who was on the phone in the backseat when the collision occurred. Hoffman testified that she had a broken bone of the top of her foot, whiplash of the neck, and a concussion.Passenger Sarah Smith, who had cuts to her chin, a neck injury and a bruised spine, said she has no memory of the crash.At Quintero's arraignment, Deputy District Attorney Cally Bright said the murder count was warranted because a previous charge of driving under the influence was filed against the defendant in November 2015, and because he allegedly left the scene of the fatal crash. 1604
