Two Miami (Ohio) University students filed a federal lawsuit on Monday claiming the university relied on "erroneous" information when it suspended them for violating Miami's student code of conduct related to COVID-19. Miami suspended the students, identified as Jane Roe and Jane Doe, based on an Oxford police investigation. The party was held Aug. 22 at the off-campus home Doe and Roe shared with eight other students, according to the lawsuit. An Oxford police officer cited Roe and Doe, both juniors, for violating city ordinances that limited noise and mass gatherings, according to records filed by their attorneys. The Oxford City Council passed the "emergency" mass gatherings ordinance in response to concerns about COVID-19. The ordinance limits social events to 10 individuals at the same time. Court records show Miami's administrative hearing officer determined that Roe and Doe violated the university's code of conduct and may have placed students at risk of contracting COVID-19. "I was not found responsible for hosting, planning, inviting, nor even being outside when the “mass gathering” was occurring," wrote Roe in her appeal letter. "I only came outside pursuant to a request from an Oxford police officer to speak with a resident regarding noise."Roe wrote that she took a leadership position by "stepping up" to comply with the officer's request."Now I am the one suspended from my school," she wrote. Doe echoed Roe's comments in her appeal letter."Perhaps most importantly, the timing of this incident is paramount to the case, as the date in question was Aug. 22, 2020, the first week of classes at Miami," Doe wrote. "Students were receiving limited clarifying information as to the exact expectations of the university."Clarifying guidance for Miami's policy on mass gatherings was provided five days after the Aug. 22 party, according to the lawsuit.Roe and Doe both lost their appeals, according to Miami records filed in the lawsuit.The Appeals Board agreed with the hearing officer's finding that there was "reasonable fear" that the party during a pandemic "may have endangered many people," according to Gerald Granderson, chair of the appeals board. The suspensions violated Miami's "contractual obligations and promises" to the students, according to the lawsuit. "I made a lot of bad decisions, including lying to the FBI; I lied to my family, lied to my lawyers,” he says.Now, he's a self-described prison coach, teaching criminals the ropes of prison life. His expertise includes everything from how to get the best job in prison to living "under the radar," and doing it all safely.His clients usually include white collar defendants, doctors, lawyers, executives, he says. However, his new client is one of the major players in the college admission scandal. Paperny starts his work early in the legal process. "What we helped them do is obtain the shorter sentence, in the most favorable prison, and we do that by telling the judge who they are through their own efforts,” Paperny says. “Lawyers are great, but they aren’t paid to say great things about their clients.” Paperny does something some find more valuable later. He helps those about to walk the halls of prison have an easier time while serving time."There's a social order you have to understand that includes not speaking too loudly on the phone. Whenever you change clothes, you go into a shower stall because [they] don't want to see you naked. Not cutting the line to go to the chow hall. Every time you use the restroom, you wash your hands because you may go touch the handle to the TV room, and if you don't, you're going to get reprimanded and embarrassed in 40-50-60 people,” Paperny says. Another thing Paperny suggests is not having to associate with prison staff more than you need to. “Why? Something happened. You go complain to a guard. Twenty minutes later, that guard is searching someone's locker and another prisoner may say, ‘wasn't that the new prisoner talking to that guard?’” Paperny says.Most of Paperny’s clients have cash to pay the cost, which can be anywhere from ,000 to ,000. But some spend much less to learn the inside track of things like what type of food will be served and what are the showers like. Brian Cisco hired Paperny for ,000. Cisco turns himself in on April 16 for a two- year sentence after growing weed in Tennessee, where it’s not legal even at the state level. To critics who say Paperny is helping the rich essentially avoid the full punishment of prison, Paperny argues that isn’t the case. "We're not trying to buy them out of jail early,” he explains. “Let me tell you what we're trying to do. We're trying to show the judge that they are more than some bad decisions they made." Paperny says prison is neither as bad nor as good as some people think, but it is survivable. He says assaults don't happen like in the movies. Prison should be a time to think about making victims whole, taking responsibility and preparing for life after barbed wire, he says. "I hope that anyone who may be embroiled in the criminal justice system recognizes just because you go to prison, doesn't mean your life stops,” Paperny says. “Doesn't mean that it has to end. There's a whole lot that you can do there, and I want people to know that growth and better opportunities are possible." 3174

Lending a helping hand is what Stephen Peth loves to do. Peth spends a lot of his time in the rehabilitation unit at Walter Reed National Military Medical Center in Bethesda, Maryland, helping wounded warriors get back on their feet. "The job is basically to do whatever we can to help the therapist," Peth explains. At 72 years old, Peth couldn't imagine any other way to spend his time. “I could be out on a golf course doing something for me, but to be here and be working for these wonderful service people that are here for a variety of reasons, to me, that’s inspirational,” he says. Peth says he’s inspired by all the patients he sees, because, he too, was once a warrior wounded in combat. "This is the boot that I was wearing the day that I got shot," he says. In 1967, 11 months into his tour during the Vietnam War, Peth, an army rescue helicopter pilot, was attacked by gunfire. "We took 39 hits on the aircraft,” he recalls. “I took a round through my boot and took a round though my arm." That dangerous mission earned him one of the highest awards of valor. "Gen. Craton Abrams came out and pinned a Silver Star on me," he says.His award and scars serve as reminders that he was once where these war heroes are now, compelling him find a way to serve his country once more. 1305

  

“Happened nine times in a five year period,” said Dawnie McNamee, a former hiring manager. Stood up. “We got to the point where we were actually surprised that someone would actually show up on their first day [because] it got to be so frequent,” said Craig Cummings, a former restaurant manager. She says she sees this all the time. “What I found, especially since the stock market has recovered, and jobs now aren’t as rare as they used to be, is there’s a lot of people out there that’ll come in, nail it on the interview. You’ll go through the hiring process, all the paperwork and then their first day they will not show up.” She’s right. Unemployment is at 3.5 percent, the lowest it’s been since in 50 years. That means some employers can’t find someone to take a job. Searching for a new hire can be a little bit like dating, you never know exactly what you’re going to get, it’s expensive, and they may not even show up. I went to a job fair and asked people looking for work if they’d ever consider doing this to a potential employer. “If I had a job offer in hand that I’d accepted," said Julie Ziobro who's looking for a job. “Absolutely not,” said Nathaniel Diamond, a job seeker. I come from a generation, and I grew up, making phone calls, don’t text,” said Cummings. “I definitely wouldn’t do it without communicating; that’s not fair,” said Ziobro. “Just let them know, like, 'Hey, I got a job that better suits my skill set, and I’m going to take that one instead,'” said Joshua Curry, a job seeker.No one was ready to admit they’d leave an employer hanging out to dry. But it doesn’t mean there are no other signs. “We really want to take a look at their job history to look at, are they a job hopper? Are they moving around every three months or every six months with different companies. To me that would signal someone is always looking for that next best thing,” says Keely Teynor, who runs her own hiring firm. Teynor says there are a few things employers can do, including looking at someone’s job history. “Even in this really tight labor market, the unemployment rate is so low, we kind of have to find this nice balance of having multiple steps in the process to show they’re really invested and interested in this opportunity,” she says.She says that process helps her avoid the dreaded no show on an employee’s first day. McNamee can still remember the sting of being stood up. “People are excited to have new hires come in and be a part of your team," she says. "And so when you have people not show up, leaves a little mud on your face.“I’ve stayed awake quite a few nights wondering about that what could I have done better.” 3127
