SAN DIEGO (KGTV) - An elderly woman died while she was with her family waiting to cross the border into San Diego Sunday afternoon, according to our reporting partner Televisa.Televisa reported it is unknown why the woman, who was in her late 80s, passed away. This comes as people on both sides of the border expressed frustration at incredibly long wait times."It's unfortunate because I think the policies that CBP puts in place, protocols, punish border crossers," Pedro Rios said. He said it took four hours to cross in Otay Mesa on Saturday.New protocols went into effect on Friday due to the pandemic. Customs and Border Protection planned on slowing down traffic, closing lanes and adding secondary inspections, aimed at delaying those traveling for non-essential reasons. In addition to San Diego, Tucson, Arizona, El Paso, and Laredo Texas have similar protocols in place. One woman waiting to cross into San Ysidro told Televisa, "Yes it is difficult, but no one wants to be here in Tijuana."Another woman said they were heading to the U.S. to visit friends and go to the beach. When Televisa asked if they thought that was essential travel, they replied in Spanish, "Yes, because we're tired and angry. If you're following the regulations, staying away from people, have your mask and disinfectant ... if you're following the protocol, you can."The restrictions on non-essential travel do not apply to anyone crossing the border for work, school, or medical treatment. The restrictions are set to continue through September 21.ABC 10News reached out to CBP for comment and will update this story when they respond. 1630

SAN DIEGO (KGTV) - A shopping trip in City Heights ended with a flurry of anti-gay slurs and a road rage assault. On Tuesday afternoon, Marco Aguirre spent an hour shopping, before heading back to his truck, parked in the 3700 block on University Avenue."I back out and lightly bump the car behind me," said Aguirre, 49.Aguirre says he saw two men emerge from an older-model, red sedan. Aguirre apologized, offering to show his insurance, but the men were agitated."The driver came on my side and the passenger came on the other side. Both of them were screaming," said Aguirre. With his cellphone, Aguirre, who is openly gay, capturing the profanities, including a string of anti-gay slurs. Aguirre was frozen. "I feel terrible. Panicked," said Aguirre. He says the slurs continued for about 15 minutes, before he decided to get out of the car to assess the damage."I see no damage to my truck and no damage to their vehicle," said Aguirre. Aguirre says when he stepped onto the sidewalk, he was attacked."One of the guys grabbed my phone and smashed it into the sidewalk. The same guy punched me in the face, under my left eye," said Aguirre. Aguirre says the two men got in the car and took off, leaving him with swelling under his left eye. The incident also left him determined to find the two men."It's not right. I need to take a stand. This is my neighborhood, and I don't want to feel threatened in my own neighborhood," said Aguirre.Aguirre says he actually recorded the entire episode up until the phone was damaged, but only a minute or so ended up in the cloud.Anyone with information is asked to call San Diego Police at 619-531-2000. 1654

SAN DIEGO (KGTV) -- A well-known San Diego restaurant plans to close for good this July. Gordon Biersch Brewery Restaurant will close its Mission Valley restaurant on July 16, 2019, according to paperwork filed by the company. Although no reason was given for the closure, 79 employees are expected to lose their jobs. The layoff notice was filed by the company on June 5 and says, in part, that the company will “continue the employment of all employees through the sixtieth day after the date of this notice, and all employees will be paid your regular wages and benefits through that date.”The brewery and restaurant first opened in 1988 in Palo Alto before expanding in 1999. Gordon Biersch currently operates 35 restaurants in the U.S., though it’s unclear if any other locations plan to close. 808

SAN DIEGO (KGTV) — An Ohio man accused of pepper-spraying 11 San Diego Police officers during a demonstration last month has pleaded not guilty.Denzel Draughn, 28, pleaded not guilty on Wednesday to felony counts of unlawful use of tear gas against a peace officer and 11 felony counts of use of force against a peace officer. On Aug. 28, a group of demonstrators protesting the shooting of Jacob Blake in Kenosha, Wisc., marched through downtown San Diego.See Sky10 video of the demonstration below:Police say that as the group neared 9th and E Streets, a vehicle that was following the group failed to stop at red lights. After police stopped the driver, a crowd began to form near the car and officers who pulled the vehicle over.SDPD says that the group ignored demands to back up from the scene, prompting one officer to pull out pepper spray. Police say one person tried to knock the pepper spray out of the officer's hand, forcing the officer to discharge the spray.Several police officers then tried to arrest the person. As the officers were placing the person in custody, a pepper spray canister fell on the ground. Officers say Draughn picked up the canister and sprayed it twice, hitting 11 officers.SDPD says Draughn fled but was later found and arrested. If convicted, Draughn faces probation to 11 years in jail. He was released on 0,000 bail Wednesday evening."Peaceful protest is a time-honored tradition in our country, and now more than ever it’s critical that we protect an individual’s important First Amendment right. The majority of those protesting in our County are doing so peacefully. But when protests turn violent, it is an insult to the rightful expressions of peaceful protesters, and we must act to protect the community," District Attorney Summer Stephan said in a statement. "Protesting is an inalienable right recognized by the U.S. Constitution. Rioting, burning down businesses and assaulting peace officers are crimes that will be prosecuted." 1990
