SAN DIEGO (CNS) - A San Diego federal judge largely upheld California's private prison ban in a ruling stemming from dual lawsuits filed against the state by the Trump administration and a private prison firm.U.S. District Judge Janis Sammartino issued a preliminary injunction Thursday upholding in most respects Assembly Bill 32, which took effect Jan. 1 and prohibits the operation of private detention facilities statewide.By 2028, the law would bar all inmates from being held at privately owned facilities. The law also prohibits agencies from entering into new contracts for privately owned detention facilities or renewing existing contracts at currently operating facilities.The federal government and private prison firm The GEO Group argued that the law is unconstitutional because it encroaches on the government's operations to house federal inmates by unlawfully allowing a state government to regulate federal operations.Additionally, the government has argued that private facility closures will force the relocation of thousands of inmates at high cost to taxpayers, with inmates also forced to be incarcerated at greater distances from their families, especially if they are relocated out of state.The GEO group alleges that it will lose around 0 million per year in revenue if forced to close down its California facilities and could lose more billion in capital investment and revenue over the next 15 years.Sammartino ruled that AB 32 is a regulation of private detention contractors rather than the federal government and its operations and disagreed with plaintiffs' arguments that AB 32 interfered with congressional objectives to house detainees in private facilities, except in respect to United States Marshals' detainees.Sammartino wrote, "Congress clearly authorized USMS to use private detention facilities in limited circumstances, such as where the number of USMS detainees in a given district exceeds the available capacity of federal, state and local facilities."As AB 32 would prevent the use of private facilities when no available space exists in other facilities, she preliminarily enjoined enforcement of the ban in regards to USMS detainees, but it remains in effect for the U.S. Bureau of Prisons and ICE.According to court papers, 1,100 USMS inmates in California are housed in private detention facilities, representing about 22% of USMS statewide.Among those inmates, many are housed at San Diego facilities that include the Metropolitan Correction Center, Western Region Detention Facility, and Otay Mesa Detention Center.The United States and the GEO Group can file amended complaints within the next three weeks, according to Sammartino's order. 2706
SAN DIEGO (CNS) - Federal officials in San Diego Wednesday announced the arrests of hundreds of suspects and the seizure of more than a ton and a half of narcotics as part of a crackdown on a Mexican criminal gang considered responsible for much of the flow of illicit drugs into the United States.During a late-morning briefing at the U.S. Drug Enforcement Administration's Kearny Mesa offices, DEA and Justice Department officials detailed the results of the multi-agency operation targeting the Cartel de Jalisco Nueva Generacion."Project Python is the single-largest strike by U.S. authorities against CJNG, and this is just the beginning," DEA Acting Administrator Uttam Dhillon said.The six-month enforcement campaign has resulted in the capture of more than 600 gang associates and 350 indictments, including one against the alleged head of the criminal organization, fugitive Nemesio Ruben Oseguera Cervantes, also known as "El Mencho."The Department of State has issued one of the largest narcotics crimes- related rewards ever -- million -- for information leading to the arrest of Cervantes.In San Diego and Imperial counties, the operation has led to the arrests of about 130 CJNG associates and seizure of 3,282 pounds of methamphetamine, 198 kilograms of cocaine, 59 kilograms of heroin, 44 kilograms of fentanyl, two kilograms of opium, in excess of 27,000 fentanyl pills and 18 guns, according to the DEA.The Jalisco-based cartel is one of the fastest-growing transnational criminal organizations in Mexico and among the most prolific methamphetamine producers in the world, and is the source of a large amount of drugs entering the United States and elevated levels of violence in Mexico, according to federal officials.Last month, Cervantes' son and second-in-command, Ruben Oseguera "Menchito" Gonzalez, was extradited from Mexico to the United States on drug- trafficking charges. SAN DIEGO (CNS) - A San Marcos man was behind bars Monday for allegedly driving under the influence of alcohol and causing a crash that killed a woman in his car.Ramos Santos, 37, lost control of his 2002 Honda Civic at the intersection of Aviara Parkway and Cobblestone Road in Carlsbad around 6 p.m. Sunday, sending it smashing into a light pole, according to police.Santos' 41-year-old passenger died at the scene, Lt. Christie Calderwood said. SAN DIEGO (CNS) - Authorities Monday publicly identified a 39-year-old firefighter killed over the weekend in a suspected DUI motorcycle crash near Lakeside.Ryan Ferrara, an engineer with the San Diego Fire-Rescue Department, was riding on the back of a westbound 2018 Harley-Davidson that crashed into a parked vehicle in the 13000 block of Piping Rock Lane about 9:30 p.m. Saturday, according to the county Medical Examiner's Office and California Highway Patrol.Ferrara died at a trauma center about an hour later, and the 36-year-old El Cajon resident who had been piloting the two-wheeler was hospitalized for treatment of severe injuries, CHP public-affairs Officer Jeff Christy said.Neither man -- the driver was not publicly identified -- was wearing a helmet at the time of the wreck, according to the Highway Patrol."Alcohol and/or drug impairment is suspected as a factor in the collision, and (it) is still under investigation with possible charges pending," Christy said.In a prepared statement, San Diego Fire Chief Colin Stowell said his and his employees' "hearts are broken by the news" of the death of Ferrara, who had been with the city emergency-services agency for 13 years. 1203
SAN DIEGO (CNS) - An international team of scientists, led by biologists at the University of California San Diego, has synthetically engineered mosquitoes that halt the transmission of the dengue virus, the university announced Thursday.Scientists at UC San Diego Associate Professor Omar Akbari's lab worked with Vanderbilt University Medical Center to identify a human antibody for dengue suppression. The broad-spectrum antibody stops the transmission of all four known types of the fever, compared to previous experiments, which have been able to limit single strains.The team then designed the antibody "cargo" to be synthetically expressed in the dengue-spreading Aedes aegypti mosquitoes.RELATED: UC San Diego study finds solutions for loneliness"Once the female mosquito takes in blood, the antibody is activated and expressed -- that's the trigger," Akbari said. "The antibody is able to hinder the replication of the virus and prevent its dissemination throughout the mosquito, which then prevents its transmission to humans. It's a powerful approach."Akbari works in the Division of Biological Sciences and is a member of the Tata Institute for Genetics and Society.These lab-engineers mosquitoes could be paired with a dissemination system, making it capable of spreading the antibody throughout wild disease- transmitting mosquitoes, Akbari said.Dengue fever is a virus that poses a severe risk to children and older adults in tropical regions in Asia and Latin America. No specific treatment exists and thus, prevention and control depend on measures that stop the spread of the virus.This development could go a long way toward limiting the disease's transmission."It is fascinating that we now can transfer genes from the human immune system to confer immunity to mosquitoes," said coauthor of the paper, Dr. James Crowe, Jr., director of the Vanderbilt Vaccine Center at Vanderbilt University Medical Center in Nashville, Tenn. "This work opens up a whole new field of biotechnology possibilities to interrupt mosquito-borne diseases of man."Akbari's lab is now in the early stages of testing methods to simultaneously neutralize mosquitoes against dengue and a suite of other viruses such as Zika, yellow fever and chikungunya. 2789
