SAN DIEGO (CNS) - A Utah man who robbed a Carlsbad Motel 6 at gunpoint, then was arrested attempting to re-enter the United States, was convicted of federal robbery and firearm-related charges, the U.S. Attorney's Office announced Wednesday.Lance Lamont Lavert of Salt Lake City, 37, was convicted Tuesday by a San Diego federal court jury for the July 9, 2018, morning robbery of the motel on Paseo Del Norte.Prosecutors said Lavert and his girlfriend asked for a room, but were denied due to a lack of ID.Lavert then pointed a gun at the motel clerk and her manager, demanding money. When the clerk and manager ran, Lavert leapt over the counter, kicked in the door of the bathroom where the clerk was hiding, dragged her back to the cash register by her hair and pistol-whipped her in the head, court documents state.Along with 5 in cash, Lavert and his girlfriend made off with the clerk's car keys and stole the clerk's car, prosecutors said.Lavert was arrested two days later trying to cross the border back into the United States. The revolver he used in the robbery was found in his waistband.In addition to committing the robbery, Lavert was convicted for possession of a gun while having several prior felony convictions, including for arson in Utah and assault with a deadly weapon out of Imperial County, the U.S. Attorney's Office said.Lavert's girlfriend pleaded guilty prior to the trial, according to prosecutors. 1440

SAN DIEGO (CNS) - An ex-con accused of sexually assaulting a 24-year-old woman in broad daylight on a Mission Beach street pleaded not guilty Thursday to a charge of assault with intent to commit a sex crime. Philemon Shark, 40, who has two prior convictions from Washington state for residential burglary from 2014 and 2015, faces life in prison if convicted, said San Diego County Deputy District Attorney Trisha Amador. Judge Joseph Brannigan set Shark's bail at million and ordered the defendant to have no contact with the alleged victim. Amador said all sexual assaults -- no matter what level -- are ``serious'' and taken ``exceptionally serious'' by the District Attorney's Office. ``I think part of the concern is that when an individual is attacked in broad daylight in an area where they felt safe or did not feel a threat, of course that's added concern, but our office takes all sexual assaults equally as serious,'' the prosecutor said outside court. The attack happened about 8:40 a.m. last Sunday on Bayside Lane near San Jose Lane, just off Mission Boulevard, according to San Diego Police Lt. Jason Weeden. Weeden said the victim was walking south when Shark allegedly approached her from behind, threw her to the ground and held her down while he assaulted her. The woman screamed for help, and several residents forced the man off her, the lieutenant said. When Shark tried to leave, some of the residents followed him but lost track of him, Weeden said. Then, about 45 minutes after the attack, one of the neighbors found Shark hiding in a breezeway. Shark allegedly fled but was apprehended by patrol officers and booked into jail. Weeden said Shark is from the Seattle area and was believed to have been living in San Diego for the last few months. SAN DIEGO (CNS) - A man who struck a popular local surfer in the head with a carbon fiber paddle in the water at Sunset Cliffs was sentenced Thursday to five years in state prison.Paul Taylor Konen, 34, was convicted last month of assault, with a great bodily injury allegation, for the June 26, 2018, assault on Kevin Eslinger, 56.Eslinger sustained a gash to the back of his head that fractured his skull and caused brain damage, rendering him unable to speak until days after the injury, Deputy District Attorney Matthew Greco said. An emergency room physician said the injury looked "like a hammer blow," the prosecutor said.RELATED: Sunset Cliffs paddle boarder breaks man's skull in waterEslinger, who testified during the trial in somewhat stilted speech, said he tried to explain his condition and the situation to hospital staff and police, but it was "as if someone had their hand over my mouth from the inside."Addressing the court at Konen's sentencing hearing, he said the attack continues to affect his daily life, how he communicates with his wife and swim students at El Cajon Valley High School, and has led to around 0,000 in medical bills. Eslinger said he wishes he could ease the pain and stress of his wife Janae, but "she's reminded of it every time I speak."According to the prosecution, after Konen nearly ran into Eslinger on the water -- forcing him to duck his head in order to avoid being struck by Konen's paddle board -- Eslinger objected to Konen's flouting of proper surfing etiquette.The victim said Konen remarked, "If I can catch a wave, it's mine," then ran into Eslinger's wife and regular surfing partner elsewhere among the waves, knocking her off her board.Eslinger testified that when he paddled out toward the defendant to ask him why he did that, he was struck in the head by an unknown object, which he later came to believe was an intentional blow from Konen's paddle.Konen was arrested the next day when police tracked him down to his father's van. Inside the van was the paddle used to assault Eslinger, still with a strand of hair stuck to a portion of the paddle that appeared damaged, according to Greco. The prosecutor said efforts to match that strand of hair to Eslinger through DNA testing were unsuccessful, because there was no root attached to the stray hair.Defense attorney Brian McCarthy, who maintained during the trial that Konen was simply trying to get away from Eslinger and may have accidentally struck him with the paddle, sought probation for his client.San Diego County Superior Court Judge Robert J. SAN DIEGO (CNS) - A new indictment unsealed Thursday against the owner/operators of San Diego-based pornographic website GirlsDoPorn.com alleges that co-owner Michael James Pratt -- who remains on the lam on federal sex trafficking charges -- also produced pornographic content involving a 16-year- old girl. Pratt was charged in a complaint last month along with three others with sex trafficking by force, fraud and coercion for allegedly filming victims under the guise of distributing the videos only to private clients, then disseminating the videos online without the victims' knowledge or consent. The new indictment adds two additional defendants and charges of production of child pornography and sex trafficking of a minor against Pratt alone, with the incidents allegedly occurring in September 2012. To help convince the women to participate, reference women like Nored were allegedly hired to lie to the women and claim they had also filmed pornographic videos for the defendants, which were never posted on the internet. The defendants are also currently involved in a San Diego civil trial involving a lawsuit filed by 22 women who appeared in videos on the site. SAN DIEGO (CNS) - An outbreak of leptospirosis, a contagious bacterial disease, has been reported in dogs in the region, the San Diego County Health and Human Services Agency announced Thursday.Since October, 34 confirmed and probable cases of leptospirosis have been documented among local dogs, primarily in the Hillcrest and Mission Hills areas. Several dogs required hospitalization and at least one was euthanized.Boarding at kennels that allow dog-to-dog interaction is a major risk factor, though some ill dogs only had contact with other dogs at dog parks. The kennels that were linked to cases notified the owners of all potential contacts of diagnosed cases and closed for at least two weeks for cleaning and disinfection.Signs of leptospirosis in dogs are varied and can include fever, muscle weakness, vomiting, diarrhea, loss of appetite, low energy and frequent urination, which may be bloody.No human cases have been linked to this outbreak in dogs, but anyone who develops fever, headache, muscle aches -- especially in the back and calves -- or other illness after contact with a sick dog should see their health care provider.This week, the county sent a health advisory to local physicians and veterinarians about the outbreak.Leptospirosis is a disease caused by various species of spirochete bacteria called leptospira. These bacteria can infect multiple species of mammals, including humans, dogs, rats, mice, raccoons, skunks and opossums. The bacteria are shed in the urine of infected animals and may contaminate food, water, soil or bedding. Dogs and people can get infected through direct contact with skin abrasions, mucous membranes or by drinking contaminated water."When dogs visit kennels and parks and play, lick and sniff each other, they are at risk of getting these bacteria," said Dr. Wilma Wooten, the county public health officer. "If your dog shows any signs, you should take it to your vet immediately."A vaccine is available to prevent leptospirosis in dogs, especially for those boarding in kennels and frequenting dog parks. 2076
