SAN DIEGO (KGTV) - A former Yuma Police officer testified Tuesday in his trial for the rape of a woman in Kensington.Jared Elkins, 34, raped his wife’s cousin after a family gathering at her home on Marlborough Drive last year, prosecutors said. The group had been out to dinner, then watched a movie while drinking beer and wine at home.She testified last week, saying she didn’t yell during the alleged attack because Elkins threatened to kill her. His wife was asleep across the hall at the time.After the encounter, the woman said she ran into her mother’s room for help, and they both escaped out a window.At a hospital, the alleged victim's blood-alcohol level was determined to be .09 percent, according to witness testimony.Police said Elkins told them that the sex was consensual and the rape charges were made out of guilt.Elkins told the jury the alleged victim started flirting with him after everyone else went to sleep.“There was mutual flirtations between the two of us and we were being adults,” said Elkins, who testified the woman was “cuddling, almost snuggling” with him.“She said yeah, it was surprising to me; I was excited a younger attractive woman, you know, it kind of confirmed everything on the couch,” Elkins said.Elkins resigned from the Yuma Police Department in 2017. He is facing nine felony counts including forcible rape and could serve 14 years in prison if convicted.City News Service contributed to this report. 1462

SAN DIEGO (KGTV) - A father whose infant daughter was found dead outside a Los Angeles-area mortuary surrendered Monday at the U.S.-Mexico border. Alexander Echevarria, 22, of Sacramento, turned himself in to authorities at the San Ysidro Port of Entry with his attorney by his side. Echevarria was considered a person of interest in the death of 8-month-old Alexia Rose. The baby’s body was found near a trash container outside a funeral home in Bellflower last week. The infant was partially covered by a blanket and left in a car seat. Police believe the girl died in Sacramento. Her death was not due to natural causes, the Sacramento County Sheriff said Monday. Family members had reported Echeverria missing on Memorial Day. They said he suffers from depression and had made suicidal statements. Echevarria, who also had an arrest warrant on domestic violence-related charges, is being held in San Diego pending transfer to Sacramento.Associated Press contributed to this report. 993

SAN DIEGO (KGTV) -- A fire destroyed an abandoned building in Barrio Logan early Wednesday morning, but no injuries were reported.According to the San Diego Fire-Rescue Department, crews were called to the structure fire in the 3500 block of Dalbergia Street at around 2:50 a.m.By the time firefighters arrived, the flames had already consumed much of the building. It took at least an hour to stop the fire from spreading.A deputy fire chief at the scene told 10News that crews have battled fires at this same address multiple times in the past.10News learned a fire occurred at the same location on April 14, and before that on Dec. 26, 2019.Additionally, on Oct. 25, 2019, a fire erupted inside of the same building; a trash can fire was reported on the property six days earlier.The cause of Wednesday’s fire is under investigation, and there is no immediate word on whether the fire is somehow connected to any of the previous incidents. SAN DIEGO (KGTV) -- A developer is going back to the drawing board after a downtown agency blasted its affordable housing proposal Wednesday. Pinnacle planned to build a 58-unit low-income apartment complex at the corner of 11th and B. It would be attached to a 32-story market rate residential tower. While the buildings would be attached, they would have separate doors, no interior connections, and few shared amenities.Civic San Diego's board of directors rebuked the developer Wednesday. "You want to put us somewhere else," board member Robert Robinson said. "Are we not good enough to get on the top floor and look out at the ocean? That's what the message is here."David Dick, an attorney representing Pinnacle, said that was a misrepresentation of the intent. "It has to do with the realities of construction, cost financing, management and ownership," he said. Dick added that Pinnacle should be lauded for its willingness to fund much-needed affordable housing downtown, as opposed to paying an in-lieu fee that could take years to yield any units. SAN DIEGO (KGTV and ABC) - Fishermen had a close encounter with killer whales off the San Diego coast that was caught on camera. The group was on a 21-foot boat looking for yellowtail when they came across the orcas. "Out of nowhere, one of them popped up right next to the boat 3 or 4 feet away from me…landed, splashed me, and splashed the whole side of the boat. I screamed,” witness Nathan Benge told Good Morning America. One of the killer whales had a playful interaction, performing a belly roll beneath the surface of the boat’s wake, GMA reported.
