SAN DIEGO (KGTV) - A Coronado Police officer who was among the first to arrive at the Spreckels Mansion after the death of Rebecca Zahau testified Monday in the wrongful death civil case.Zahau’s death was ruled a suicide in 2011 but her family believes she was killed. They sued Adam Shacknai, the brother of Rebecca’s boyfriend.Adam Shacknai called 911 to report the body hanging from the balcony.TIMELINE: Rebecca Zahau?caseIn testimony Monday, the unidentified officer said his duty was to go through the home and make sure no one was still inside, deeming it safe for investigators to enter. Investigators would later find a single boot print on the balcony where Zahau’s nude body was found bound and hanging. The shoe print would end up being one key piece of evidence. Investigators needed to find out who it belonged to, and if someone else was with Zahau before her body was discovered.SLIDESHOW: Coronado death investigationThe Zahau family lawyer is trying to prove Adam Shacknai was with her and played a role in her death. Shacknai’s lawyers argue there is not a single piece of evidence that ties him to Zahau’s death.  His DNA was never found at the scene, and there were no eyewitness accounts to support the Zahau family’s claim, lawyers say. The officer on the witness stand was questioned about the shoe print by Keith Greer, Zahau’s family lawyer.“Do you know whether or not that footprint on the deck is yours?” Greer asked.“Personally I do not, but I’ve been told that it is,” replied the officer.He said as part of the investigation, his boots were taken in as evidence.Investigators later determined the print was accidentally left behind by the officer during his sweep of the home.The same officer who testified answered questions from Shacknai’s lawyers about a call he responded to at the home days before Zahau’s death.Zahau’s boyfriend’s son, Max Shacknai, had suffered a life-threatening fall inside of the home while in her care.“Once I entered the house I saw a small boy on the ground with some debris on him,” said the officer.He went on to say he remembers seeing Zahau very emotional and crying, but doesn’t remember directly speaking with her.A PERT counselor, a fingerprint expert and a handwriting expert are also expected to testify Monday. 2314

SAN DIEGO (KGTV) — A cruise ship passenger and three crew members who arrived in San Diego on Monday have since tested positive for the novel coronavirus.County spokesperson José álvarez confirmed a passenger on the Celebrity Eclipse, which arrived in San Diego Monday, has tested positive for COVID-19. Tuesday afternoon, county health officials revealed that 3 crew members, who had been self-isolating, also tested positive. County health officials said they were notified before the ship came in that one passenger had a heart ailment and "possible" pneumonia. The passenger was taken to a hospital Monday and later tested positive for COVID-19.RELATED: San Diego issues health orders on cruise ships amid COVID-19Deborah Filgate and her husband were among the 2,500 passengers on board that cruise. "We've been told all the way through that we were absolutely fine, no one sick at all, so it's a bit strange," said Filgate. "We were very relieved to leave the ship, but thinking about what that might have represented to the people you came in contat with, it's not such a great feeling now," said Filgate.A letter from Celebrity Cruises was sent to passengers reading, "because you were a passenger on this same voyage, it is possible you were exposed to someone who was sick with COVID-19."The letter goes on to direct passengers to complete a 14-day isolation. The passenger is not a San Diego County resident. The passenger is in the hospital in serious condition."There is no change in the plan of disembarking the remaining passengers today," álvarez said regarding the ship. "They will be screened prior to departure and only those who are asymptomatic and without fever are allowed to leave and proceed to transportation out of the county."A statement from the cruise line to 10News read:"We received clearance from port authorities and public health officials to disembark our guests and return them safely to their homes. Those individuals will complete their quarantine locally. SAN DIEGO (KGTV) — A class-action lawsuit against the University of San Diego wants the school to refund students some tuition fees following the move to virtual learning.The lawsuit, filed by two students, claims the college owes students some of their tuition and fees back due to the switch to virtual learning.The suit says that when the school switched to virtual learning in Spring 2020, students were still charged full tuition even though "USD could no longer provide the promised hours of instruction." The lawsuit claimed that USD also increased its tuition on top of that."Similarly, students paid fees for services and access to facilities and equipment over the full semester. Though USD provided these services and facility/equipment access for only part of the semester, and could not provide them for the full semester, USD demanded that students pay fees for the entire semester," lawsuit documents state.A spokesperson for USD told ABC 10News they have not been notified of or served with the lawsuit.The lawsuit is seeking a "prorated portion of the tuition, fees and other related costs, proportionate to the diminished value of online classes and the amount of time in the Spring 2020 and following semesters when USD ceased in-person classes, campus services and access to campus facilities, continuing through to such time as USD reinstates in-person classes" for the two students who filed the lawsuit and "all others similarly situated." 1470

SAN DIEGO (KGTV) - A City Heights elementary school was placed on lockdown Wednesday morning following reports of gunfire in the area.San Diego Police responded to the call of shots fired near Colina del Sol Park at 5319 Orange Avenue just after 9:30 a.m. Wednesday.Fay Elementary - located across the street from the park - was placed on a precautionary lockdown, according to police. The lockdown was lifted within an hour.Two individuals were detained following the reports, but police did not confirm whether they were associated with the shooting. Police did say they are searching for one more individual.Police recovered shell casings at the scene, but would not say how many were recovered. No injuries have been reported.SDPD officers were on the scene Wednesday afternoon investigating.  840

SAN DIEGO (KGTV) - A Chollas View elementary school was placed on lockdown Wednesday after reports of an armed man nearby.San Diego Police were called to the area of 45th and Market streets at about 9:30 a.m. over the reported suspect. Chollas-Mead Elementary School was placed on lockdown as police searched the area.Officers arrested an armed man at the scene and were searching for a second suspect who fled the scene, believed to possibly be armed as well, police said.Chollas-Mead Elementary's lockdown was lifted as of 11 a.m. while police continued their search.The outstanding suspect is described as a 6-foot-tall black man, in his 20s, last seen wearing a black shirt and light blue pants, SDPD told City News Service. 736
