Papa John's tanked Tuesday after a report that a plan to sell the company has fallen apart.The Wall Street Journal reported that the asset manager Trian Management Funds is no longer interested in bidding for the company. According to the Journal, others are still considering taking a stake in the company, but not a total purchase.Papa John's (PZZA) stock was down 10% at market close Tuesday.Papa John's declined to comment for this story. Trian did not immediately respond to a request for comment from CNN Business.Rumors have been swirling for weeks about potential buyers for the company. Each report has caused shares of the company to spike. The Journal reported Trian's interest last month.Without a buyer, the struggling pizza company will have to find a way to convince investors that it can solve its problems on its own, and beat out competitors Domino's and Pizza Hut. That's a tall order.The company has been working hard to distance itself from controversial founder John Schnatter, who resigned his role as chairman in July after news broke that he had used the N-word on a conference call.Papa John's said earlier this month that same-store sales in North America fell by 9.8% during the most recent quarter. Total revenue dropped 15.7% from a year earlier to about 4 million.Schnatter also stepped down as CEO at the end of last year after he caused a controversy by blaming the NFL for poor pizza sales. Schnatter said sales were hurt by the way the league handled players' kneeling during the National Anthem in protest of racial injustice.Since then, Papa John's hasn't been able to regain its momentum, and sales have continued to slip.Other pizza sellers have struggled this quarter. Pizza Hut's sales were flat, and though Domino's (DPZ) reported domestic and international same-store growth, the company missed analyst expectations.But Pizza Hut and Domino's are better equipped to win the pizza wars. PALA, Calif. (KGTV) – An Oceanside woman is dead and a man and 11-year-old are hospitalized after a vehicle was found overturned on an embankment near State Route 76. The family of three, a father, mother and son, were traveling from Palomar Mountain back to their home in Oceanside.At about 6:13 a.m. Friday, California Highway Patrol received a call from San Diego Sheriff's Department about a vehicle that had veered off the roadway. The driver, a 30-year-old man from Oceanside, said he was unsure of his location and knocked unconscious in the crash, but that he was somewhere along SR-76 between Palomar Mountain and Oceanside. He also was not sure what time they went over the edge, but said they had been driving around 11 p.m. Thursday night, which means they could have been down there for close to eight hours. Both agencies dispatched crews to find the vehicle and using his cellphone location, were able to find the vehicle just after 6:30 a.m. south of SR-76 near Bodie Blvd. The vehicle, a Subaru carrying, was about 300 feet down a steep embankment near the roadway."He wasn’t even sure when the crash happened. He thought he left somewhere around 11 o’clock last night, heading home from Palomar Mountain to Oceanside, so he may have been out there all night," said CHP Public Information Officer Mark Latulippe.The right-front passenger, a 30-year-old woman, had died from her injuries in the crash. The driver sustained major injuries and was taken to Palomar Medical Center. An 11-year-old male who was in the right rear of the Subaru also received major injuries and was taken to Rady Children's Hospital.The driver and child are expected to recover.A small dog was also in the vehicle at the time of the crash. Animal control helped locate the dog after the crash.Investigators are not sure how long the vehicle had been there. They believe sometime overnight the Subaru was traveling on SR-76 near the Wilderness Gardens Preserve when for unknown reasons it left the roadway and overturned down the embankment. All three victims were ejected during the crash and found either partially or fully outside of the vehicle, CHP says.The names of those involved in the crash were not released. Investigators do not believe impairment was a factor in the crash and everyone is believed to have been wearing a seatbelt. 2342

PARKLAND, Fla. – The death penalty case against Nikolas Cruz in the 2018 massacre at a Florida high school remains in limbo.At a brief hearing Tuesday, no decisions were made on a trial date amid continuing obstacles because of the coronavirus pandemic. Cruz's defense lawyers say they have almost no access to him in jail, nor do defense experts they insist must see him to build a case."We're in a worldwide pandemic. It's just not safe to be doing that right now," said defense attorney Melisa McNeill in the hearing, held remotely. "All of that, unfortunately, is on hold."Broward County State Attorney Michael Satz said his office is ready for trial but added that they must await the filing of various anticipated defense motions. That is one of the issues interrupted by the coronavirus pandemic.Cruz, 21, is charged with killing 17 people and wounding 17 others during a Valentine's Day 2018 rampage with an AR-15 rifle at Marjory Stoneman Douglas High School in Parkland, Florida.Cruz's court-appointed public defenders have repeatedly said in court he would plead guilty in exchange for a life prison sentence. The state attorney's office has rejected that, contending that a jury should decide his fate.Just when a trial may begin is anyone's guess.As time has gone on, things have changed. Satz, the state attorney, is leaving his post after 44 years. There are new candidates to replace Satz, including Democrat Harold Pryor who, if elected in November, would be the first Black state attorney in Broward County history.Pryor has not commented directly on the Cruz case but, in general, has said he personally opposes the death penalty. Pryor has the support of the county mayor, Dale V.C. Holness.His opponent on the Republican side is Gregg Rossman, a veteran former homicide prosector who handled some of Broward County's biggest murder cases. Police in Bismarck, North Dakota, want to put AR-15 rifles in some schools so school resource officers can respond more quickly in the event of an active shooter.Police asked for almost ,000 in their 2019 budget request to buy the rifles, heavy body armor and bleeding control kits for the city's nine high schools and middle schools, Bismarck Police Chief Dave Draovitch told CNN.The money will also be used to buy a safe at each school to keep the equipment away from students, teachers and staff."The SROs (school resource officers) will be the only ones who have access to this equipment," he said.The cost would be split with the school system."Hopefully we never find ourselves in a situation of an active shooter. But if we do, we really want to make sure that our SRO's are equipped with the tools that they need to do their job effectively," Bismarck Public Schools safety coordinator Becky LaBella told CNN affiliate KFYR.Draovitch said Bismarck school resource officers are police officers and are trained to respond immediately to stop an active shooting."Whatever they have to do to stop that threat, that's what we expect our officers to do," Draovitch said.They keep AR-15s and the other emergency equipment in their vehicles, but that's not as useful if there's an active shooting situation inside the building."If something happens they're not going to have time to go running out to their cars," Draovitch said. "All we're trying to do is make it more accessible so they can get to it more quickly."AR-15s are lightweight, rapid-fire rifles. Besides being used by law enforcement, the guns have been used in some of the most notorious and deadly mass killings in recent history.Draovitch says having the bleeding control kit -- which has tourniquets, gauze and other supplies for treating gunshot wounds -- could be the most important part of the plan."If, God forbid, something does happen, getting aid quickly is going to be key," he said.He said city officials began discussing the plan after the February 14 shooting at Marjory Stoneman Douglas High School in Parkland, Florida, that killed 17 students and faculty."After that happened, we really got to talking with our schools about what can we do better, what can we do differently," Draovitch said.The city will vote on the budget next month and Draovitch expects it will pass.
