(KGTV) — Defense attorneys for 15 Marines accused of human smuggling said they hope the judge dismisses the case.The attorneys argued that the Commander illegally used his power to discipline the Marines publicly, and therefore influenced the outcome of the case.It was a very public display of discipline.Fifteen Camp Pendleton Marines were cuffed and taken away by NCIS agents in front of an 800-person battalion formation in July. They were accused of human smuggling and conspiracy.But now, attorneys representing a few of the accused Marines said the public arrests violated their rights. Now, they are filing what's called an "undue command influence" motion against the Battalion Commander who led the formation."Anytime you have a Commander who is in a position of leadership who potentially affects a subordinate's rights to a fair trial, that can be viewed as potential 'undue command influence,'" military attorney Gary Barthel explained. "This motion for 'undue command influence' was made against the Battalion Commander for making comments and parading the 15 individuals out for what was supposed to be a recognition, and they were ultimately arrested." Barthel is a former legal advisor to Camp Pendleton's Commanding General. He said a Commanding Officer's job is to maintain good order and discipline their command. But in military law, they also wear the prosecutor and jury selector hats."Those two hats can clash," Barthel said. "That's why it's important for Commanding Officers to be careful what they say with regard to their views of the military justice system, or their views of a particular individual who has been accused of an offense."The defense team said the Commander used his power to influence the outcome of the case unfairly. But Barthel said in his experience with 'undue command influence' cases, he believes the military has likely already taken the Commander in question off the case."You can take the individual that allegedly made the statements involved out of the process, and that keeps the process fair and impartial," Barthel said. Ohio State University placed its head football coach, Urban Meyer, on paid administrative leave on Wednesday as it investigates whether he was aware of domestic violence allegations against fired assistant coach Zach Smith."The university is conducting an investigation into these allegations," Ohio State said. Ryan Day, who has been the team's offensive coordinator, will be acting head football coach while Meyer is on leave."We are focused on supporting our players and on getting to the truth as expeditiously as possible," the university said.Meyer said in a statement that he and Gene Smith, Ohio State's athletic director, "agree that being on leave during this inquiry will facilitate its completion. On Friday afternoon, the US Centers for Disease Control and Prevention expanded it's warning to consumers to cover all types of romaine lettuce, now including whole heads and hearts of romaine lettuce, in addition to chopped romaine and salads and salad mixes containing romaine.Romaine lettuce has been linked to the growing number of people hospitalized due to a multistate E. coli outbreak. 53 people have been infected with the outbreak strain of E. coli in 16 states since March 13, the CDC said. Thirty-one of those ill have been hospitalized. The petition suggests Disney should re-theme the ride around "Princess and the Frog." Tiana, the main character in the film, is recognized for being Disney's first African-American princess.The petition had more than 8,000 signatures as of Thursday morning. The petition's current goal is set at 10,000 signatures.The call for change comes as the country continues to hold discussions surrounding racial injustice in the wake of George Floyd's death in Minneapolis police custody.Floyd's death caught the nation's attention after bystander video showed the 46-year-old man struggling to breathe while in police custody in late May. The video showed a white police officer, later identified as Derek Chauvin, kneeling on Floyd's neck for more than eight minutes.Chauvin was initially charged with third-degree murder before charges were upgraded to second-degree murder. He's also charged with manslaughter.The three other officers involved in Floyd's arrest — Tou Thao, J.
