SAN DIEGO (KGTV) - A man from El Salvador has been granted asylum in the United States after having been sent back to Mexico to await his trial.According to his attorney, Narciso Cruz, the man is only the second person to receive asylum who had been sent back to Mexico due to the Trump administration’s Migrant Protection Protocol (MPP.)“This individual is a bit of a rarity,” said Cruz, referring to his client’s success in court.But his story is not a rarity.Marcos fled violence in El Salvador and did no want to use his full name for this story, still fearing the gang he fled in El Salvador.“They’re a terrorist group,” said Marcos.He became targeted earlier this year after he tried to help his cousin who was being recruited by the gang. After he interfered, he started receiving death threats.“They will kill you and your entire family,” he said.He traveled to the United States, crossing the border on June 25 somewhere near Tecate.He said he wandered in the desert for five days before he was eventually picked up by Border Patrol agents and taken to a holding facility. Within a day he said he was sent back across the border to Mexico where he would wait for his case to be heard.The Trump Administration implemented the MPP in January. Despite some pushback from the courts, the policy, also called “remain in Mexico,” was allowed to go forward.As of September 1, the U.S government has sent 42,000 asylum seekers to Mexico, according to the Department of Homeland Security.As for Marcos, his case is not officially done yet. The government reserved its right to appeal the court’s decision. They have until October 25 to file an appeal. 1659

SAN DIEGO (KGTV) — A San Diego family is living in an empty home and says nearly everything they own is being held hostage by a moving company.They’re part of a growing group of people around the country who say they’re victims of a deceptive bait-and-switch operation. 10News has spoken to a representative of the moving company who denies wrongdoing.Over FaceTime, Brad and Vanessa Angle gave 10News a tour of their house in North Carolina. They recently moved there from their home in Poway. The family is sleeping on mattresses on the floor since their furniture and household items never arrived. The goal of relocating was to live a stress-free life, but the feeling of emptiness is driving them to tears.“It affects a lot it. It affects my daily life. I have to keep going, you know. I try to stand up every day for my kids. I have three kids that I have to be there for,” Vanessa said.What hurts the most is losing the memories. Her husband, Brad, says Titan Moving and Storage has the family’s irreplaceable belongings, like the photos and videos of their kids, and Vanessa’s wedding dress.On Titan Moving and Storage’s paperwork to the Angle family, it shows the company’s address is in Chantilly, Va.The Angles say the company had originally given them a binding estimate of ,300 with ,205 down. Yet after movers loaded everything up during the family’s moving day in July, the Angles say the movers claimed that the family had more items than what they were originally quoted for. The movers doubled the estimate.The Angles say the movers demanded a partial payment.“I think it was ,700-something dollars that we had to write a check for,” says Brad. He says his family was assured that any issues could be worked out with a company associate come Monday.Monday came and went. “[An associate] answered the phone on my first call and then immediately hung up and then wouldn't answer after that,” says Brad of his attempt to resolve the dispute with the company.The Angles stopped payment on the check and the situation went from bad to worse.The Federal Motor Carrier Safety Administration, or FMCSA, is the government agency that oversees interstate moving trucks. The agency reports that the carrier has never been authorized to move household goods. The FMCSA is currently investigating the carrier.This year alone, the FMCSA reports there have been 98 complaints filed against the carrier. Complaints have come in from customers like Chris Baumann in Florida. He says the company pulled a bait-and-switch operation on him.“If I didn't have a headset on, you'd hear this house echoing. It's empty,” he said over video chat about not receiving his belongings from the moving company.He and others say they had checked reviews before hiring the company. Titan Moving and Storage only has one star on Yelp, but there are other companies listed on Yelp with similar names and better reviews, causing confusion for customers. The Angles recently got what they call "hostage” photos from the carrier. They were sent pictures of their items that are being held at an undisclosed storage facility in California. The company tells us it won’t release anything until receiving a storage payment from the family.“They're trying to charge us over a thousand dollars a month for storage which is insane,” says Brad.Titan Moving and Storage’s website has been down for several days. A manager with the company told us they're not taking new customers. He declined a taped interview but acknowledged that the company does not have a license to move household goods.He claimed it was due to a “filing issue” and said the company works with licensed third-party movers. The FMCSA tells 10News that the company is still not authorized to use third-party movers for household goods. The manager also told us that the company tried to resolve the matter with the Angles last month by offering them a reduced moving fee.The Angles call that a lie.“I see it as a crime. They don't have a license,” adds Vanessa.According to the FMCSA, the FMCSA does not have the authority to resolve claims against a moving company. State law enforcement, transportation and consumer affairs agencies are responsible for pursuing suspected incidents of moving fraud and regulating the operations of intrastate moves.According to the California Department of Consumer Affairs, moving companies that operate within California are required to be licensed by the Bureau of Electronic and Appliance Repair, Home Furnishings and Thermal Insulation (BEARHFTI), part of the Department of Consumer Affairs.The BEARHFTI became the new licensing and regulatory home for household movers on July 1, 2018. The BEARHFTI is aware of the consumer complaints against Titan Moving and Storage but cannot comment specifically during the open investigation.A spokesperson tells 10News that the company is not licensed with the BEARHFTI.A sergeant with the San Diego County Sheriff’s Department tells 10News that its detectives are looking into the matter. 5031

SAN DIEGO (KGTV) - A judge decided Friday to place a sexually violent predator in the East County community of Boulevard. Michael Joseph Martinez, 64 has multiple previous convictions including child molestation and lewd and lascivious acts upon a child under 14, according to County Supervisor Dianne Jacob’s office.The judge added Friday that the sheriff’s department will be extra vigilant and security will be heightened.The judge decided to place Martinez at the Department of State Hospitals recommended location of 2135 McCain Valley Road. The schools closest to the address include Clover Flats Elementary School and Jacumba Elementary School, according to the San Diego County Sheriff's Department.A mother of one of the victims from 25 years ago spoke at the hearing saying, “I know that you can’t change the order and I’m glad that there’s going to be very strict ordering, but I hope this doesn’t happen to another child or family.”RELATED: Dianne Jacob slams proposed placement of predatorJacob said the placement would put public safety at risk. She adds that several sexually violent predators have been placed in East County in recent years and in some cases, the convicts ended up violating the conditions of their placement.In a letter to Judge David M. SAN DIEGO (KGTV) - A San Diego man building his travel brand on Instagram said hackers tried to take it all away.Claudio Copiano Jr. runs the account @globalvagabonds. He posts pictures from his travels all around the world and advises people on how to travel on a budget. He’s traveled around the United States and about 30 other countries so far. Copiano has received partnerships with two countries to post about his travels. Eventually, he hopes to build it into a full-time income.“I want to show everybody what I do,” he said. Recently, Copiano received a notification from Instagram saying his email had been changed. “I clicked on ‘forgot my password,’ even though I know my password,” Copiano said.He still could not log in and started to panic. Then, he started to receive emails from someone who said he had hacked the account. The hacker demanded 0 in Bitcoin for the return of the account. Copiano said he sent dozens of emails to Instagram with no luck. “I got an email the first time from them saying that my account had been deleted and there was nothing that they could do,” Copiano said.Fortunately, he was able to figure out the new name of his account and determined it was still active. He said Instagram sent security codes to access his account but it was sent to the hacker’s email.Copiano is still not sure how he got his account back, but said after dozens of attempts, the security code was sent to his phone and he was able to access his account. He immediately changed his password and emphasized he did not pay the ransom. “You should never send money to a hacker because he’s not going to give you your account back,” Copiano said.Security expert Ted Harrington, executive partner with Independent Security Evaluators, agrees. “The reason you don’t pay the ransom is that [it] just further incentivizes other bad guys to keep doing this,” Harrington said. He also encourages people to contact the FBI if they believe they are a victim of a crime to file a report. Harrington also said two-factor authentication is vital to keeping an account safe. It is something Copiano did not have at the time, but added it right after he got his account back. “Two-factor authentication is essentially an additional way to verify who you are,” Harrington said. “Two-factor authentication is one of the most impactful security features that exist today.” A spokesperson with Instagram said they recently launched a new in-app experience making it easier for people to sign in and reclaim an account if it has been hacked. They sent the following information to Team 10:There are two ways to access this experience: 1) if we detect you are having trouble logging in (for e.g. if you repeatedly enter an incorrect password), or 2) by clicking “Need more help” on the login page.The experience will ask you to enter different types of information specific to your account, for example, the email address or phone number associated with your account, or the email or phone number you used when you signed up to Instagram.From there, we will send a 6 digit code to the contact information you select, which will allow you to regain access to your account. When you re-gain access to your account, we will take additional measures to ensure a hacker cannot use codes sent to your email address of phone number to access your account from a different device.This experience allows you to recover your account even if the account information has been changed by a hacker e.g. if the username and associated contact information is changed.The Instagram spokesperson also said if someone gains access through a compromised email account, people can follow steps detailed on the Help Center. 3709

SAN DIEGO (KGTV) — A man convicted of killing a San Diego Police officer in 1978 in the city's Skyline neighborhood has been granted parole by a review board.Jesus Cecena was convicted of killing SDPD officer Archie Buggs on Nov. 4, 1978, during a traffic stop. He was sentenced to life in prison without the possibility of parole after shooting the 30-year-old officer four times before killing him with a final shot at point-blank range, according to the San Diego District Attorney's office.According to Deputy District Attorney Richard Sachs on Wednesday, the parole board feels Cecena is no longer a risk to society. The San Diego District Attorney's office believes he should remain in prison."He hasn't come to grips with the crime. He doesn't own the causative factors of this offense. He does not accept his true motivation behind committing this crime," Sachs told 10News anchor Lindsey Pena on Tuesday.The former gang member was 17-years-old at the time of the slaying. His prison term was later modified to seven years-to-life due to his age, making him eligible for Youth Offender Parole.Since then, Cecena has been denied parole at least 14 times, the latest being 2019, 2017, 2016, and 2014. Each time, the seriousness of his crime was cited. The DA's office told 10News last year that Cecena has had an unstable social history in prison, receiving more than 10 violation reports for misconduct.Last year, Gov. Gavin Newsom denied Cecena parole.Tuesday, Pena spoke with Buggs' former partner, Jesse Navarro. Navarro was there the day he and his partner made the traffic stop and remembers the day vividly."It was a planned execution by gang members in the area. They'd been talking about killing a police officer in the area for a number of months," Navarro recalls.Buggs died right in Navarro's arms. Buggs was laid to rest just a month before he was supposed to get married."Not only we became partners but Archie and I became very good friends," said Navarro. 1985
