SAN DIEGO (KGTV) -- A City of San Diego employee says she was sexually harassed by her boss on the job and now the man accused of the harassment is asking the city to pay for his legal defense.The woman says her supervisor groped her and grabbed her arm hard enough to tear open a recent surgical wound, causing it to bleed. The parks and Rec Department employee alleges that her supervisor, Frank Cardenas, sexually harassed her, even touching her inappropriately at work.Josh Gruenberg is representing the city staffer and says she has put up with enough. "He pinned her legs against her desk in her cubicle he wrapped her up in his arms and pulled her close multiple times,” said Gruenberg.The victim says she rejected every overture Cardenas made. At one point, the victim says Cardenas told her "if she wanted to get the support to grow within the city she should only care what Cardenas thinks or wants.""He really tried to get her to put his trust in him and that it would be good for her career,” Gruenberg said.The lawsuit also claims that Cardenas gripped the victim’s arm so hard that he reopened a surgical incision, causing her to bleed at work."And all of this took place in the workspace. This was not something that involved the two of them going away for a weekend. This all took place on the job,” Gruenberg said.Cardenas declined a request for an interview. Monday night, the City of San Diego voted unanimously not to pay for Cardenas’s legal fees with city money and said they have no further comment. 1535

SAN DIEGO (KGTV) - A former Yuma Police officer testified Tuesday in his trial for the rape of a woman in Kensington.Jared Elkins, 34, raped his wife’s cousin after a family gathering at her home on Marlborough Drive last year, prosecutors said. The group had been out to dinner, then watched a movie while drinking beer and wine at home.She testified last week, saying she didn’t yell during the alleged attack because Elkins threatened to kill her. His wife was asleep across the hall at the time.After the encounter, the woman said she ran into her mother’s room for help, and they both escaped out a window.At a hospital, the alleged victim's blood-alcohol level was determined to be .09 percent, according to witness testimony.Police said Elkins told them that the sex was consensual and the rape charges were made out of guilt.Elkins told the jury the alleged victim started flirting with him after everyone else went to sleep.“There was mutual flirtations between the two of us and we were being adults,” said Elkins, who testified the woman was “cuddling, almost snuggling” with him.“She said yeah, it was surprising to me; I was excited a younger attractive woman, you know, it kind of confirmed everything on the couch,” Elkins said.Elkins resigned from the Yuma Police Department in 2017. He is facing nine felony counts including forcible rape and could serve 14 years in prison if convicted.City News Service contributed to this report. 1462

SAN DIEGO (CNS) - The San Diego Unified School District announced plans Thursday to offer voluntary in-person learning sessions for elementary school students identified as experiencing learning loss.While the district is preparing to open its 2020-21 school year Monday for remote, online learning for all students, some children who have faced learning challenges due to the COVID-19 pandemic may be offered appointments to take part in the in-person sessions, which could begin as soon as late September, according to the district.Sessions will be held in spaces "with adequate air exchange, including MERV-13 air filters and/or portable ventilation units," according to the district.Students will be identified by their teachers for participation based on several factors:-- Below standard, represented by an average academic mark of a 1 or 2 in Math or English Language Arts strands on their Spring 2020 report card-- Students who do not have a Spring 2020 report card (incoming TK, K or new students to the district) and do not make progress toward grade-level standards once schools open-- Special education students not meeting their IEP goals-- Special education students with intense support needs-- Students who have been recommended for an initial assessment for an IEP or require a triennial assessment, and require standardized assessment that cannot be completed online for eligibility"We remain committed to following the science in designing our response to the COVID-19 crisis, including all of the recommendations we received from our expert panel of UCSD science and health professionals that included a phased return to in-person instruction," said District Superintendent Cindy Marten."This is Phase One, which provides a measured approach to address the very real problem with learning loss, faced by our most disadvantaged students, while maintaining the strict standards put in place to protect the health and safety of all students, staff and community," Marten said."Online learning has created new challenges for every student. We trust our educators to identify those students most in need of additional supports to overcome those challenges," she said.According to the district, once a student is identified for potential participation, educators will review the student's progress using formative assessments, observations and information gathered from families. Some students will be moved to appointment-based, in-person learning, while others may only need adjustments to their online learning.Student identification for the onsite learning plan will include decisions regarding transportation and meal plans.The number of students who will be admitted to the onsite sessions is contingent upon available site staff and resources. Students who take part in the onsite sessions will still receive online learning as well, according to SDUSD.District Board President John Lee Evans said, "Our goal continues to be reopening all of our schools for all of our students. It is tremendously encouraging that the virus has receded enough to begin phase one of that effort. SAN DIEGO (KGTV) - A gray whale spotted frolicking in shallow waters attracted dolphins and a crowd of swimmers and surfers in the ocean off Mission Beach Wednesday. Lifeguards got a call about the whale possible tangled in fishing line about noon, an official said. A lifeguard who swam toward the whale to investigate determined it was free.The gray whale was young, possibly a year and a half old, whale watcher and photographer Domenic Biagini told 10News. Gray whales are starting to migrate north from Mexico during the spring. There is a good chance San Diegans will see more mothers and juvenile whales closer to shore, Biagini says, because the shallow waters keep the whales safe from orcas. "It's some of the most exciting times for us as professional whale watchers to see these animals, but it's also when we see the most conflicts with these animals coming in with people," said Biagini.Sky10 was above the whale as a group of surfers and swimmers approached it near Mission Beach, coming close to the giant mammal.Biagini warns that can be extremely dangerous for humans and can also stress the animal."These gray whales, despite not being the largest of the great whales we see out here, they can still get 50 feet long and weigh up to 80,000 pounds, so you're talking very large animals. All it takes is one flick of the tail and you have a catastrophic accident. And moms are naturally protective of their young," said Biagini. Especially from May to September during breeding, nesting and seal pupping seasons.LOOK in all directions before planning your approach or departure from viewing wildlife.SLOW DOWN: reduce speed to less than 7 knots when within 400 yards of the nearest marine mammal and reduce your engine’s noise and vessel’s wake.ALWAYS approach and depart from the side, moving parallel to their direction of the animal’s travel. If the animal(s) are approaching you, cautiously move out of the way and avoid abrupt course changes. DO NOT approach from the front or from behind.IF your vessel is not in compliance with the 100 yards approach guideline (#1), place engine in neutral and allow animals to pass.PAY ATTENTION and move away, slowly and cautiously at the first sign of disturbance or agitation from any animal.STAY on the OFFSHORE side of the whales when traveling close to shore.ALWAYS avoid going through groups of porpoises or dolphins and hold course and reduce speed gradually to discourage bow or stern-riding.LIMIT your viewing time to 30 minutes or less. SAN DIEGO (KGTV) - A dog named Roadrunner was spotted on camera escaping a coyote in an incident that’s happening more than ever before, according to the Helen Woodward Animal Center. The shelter’s veterinarians got a call from neighbors in Vista last month. One of the residents saw a small dog repeatedly on the run from coyotes in the Creekside and Brengle Terrace areas. Neighbors kept in touch through NextDoor as many of them tried to lure the dog to safety. Babs Fry, whose nonprofit “A Way Home For Animals” helps rescue pets, was able to save Roadrunner. She brought the dog to the Helen Woodward Animal Center for a free checkup. “We were concerned that Roadrunner may have been bitten and would require Rabies shots and months of downtime, but he was one of the lucky ones who managed to escape without incident,” said Animal Health Supervisor Madison Hughes. Roadrunner was treated for malnourishment, and skin and flea issues, shelter officials said. Fry took him home for a full recovery and will start interviewing potential adopters next week. Roadrunner’s story is increasingly common, according to Helen Woodward Animal Center officials. The shelter has received more reports of coyote attacks and the deaths of pets than ever before. The increase in coyote encounters may be due to last year’s fires, seasonal drought, heat, and recent housing development, shelter officials said. The Helen Woodward Animal Center has tips to protect your pets from coyotes:Don’t keep pet food or water outside, especially at nightSupervise your pets while outdoors, especially smaller dogsPick up fallen fruit from trees in your yard.Keep your cat indoors, especially between dusk and dawnThoroughly clean your grill and if possible store it in a garageNever leave dogs tied up outsideDo keep your dog on a leash on walks and hikes in order to keep them in close proximityBring a whistle or bear spray along on hikes and walksSix-foot tall fences are most effective in keeping coyotes out. For extra protection “coyote runners,” devices that can be installed on the top perimeter of tall fences and cause a coyote to slip off when trying to hop over are effective.NEVER run away from a coyoteMake loud noises, yell, spray a garden hose in their direction or squirt vinegar, bang pots and pans together, throw sticks, cans, rubber balls or other small objects toward (not at) the coyote.
