SAN DIEGO (KGTV) -- Del Mar may be the county's smallest city, but it has no shortage of workers commuting in every day to serve its residents and tourists.They're coming from as far away as Oceanside, La mesa, and Rancho Penasquitos. It's because the city - with a median home price of .7 million - has no affordable housing. "If they could live here and walk to work we'd get all kinds of benefits from that," said Del Mar Mayor Dwight Worden. To help make that happen, Del Mar may start charging developers of condos and condo conversions fees by the square foot. That could add to more than a hundred thousand dollars per project for affordable housing. Right now developers of those projects pay a flat fee of ,500, which hasn't been updated since 2007.The city council is considering a per square foot charge for existing construction and per square foot for new construction.The money would either go to expanding Del Mar's rent subsidy program, which currently assists five families in the city.Worden, however, said he prefers physical units because they are there forever. Del Mar currently has no affordable housing units, but the state requires it to have about 70. Worden said two currently proposed developments would include units, but he also would like the city to use the extra money to apply for federal and state grants.He also floated the idea of Del Mar buying an apartment building, converting them to condos, selling a portion of them to recoup its investment, and keeping some for low-income workers. 1571

SAN DIEGO (KGTV) — Despite a concerted effort to repair San Diego's crumbling sidewalks, a new report by city staff details the vast number of areas in desperate need of repair, as well as the skyrocketing cost to get them fixed."We're repairing more now than we ever have, but it continues to be a source of frustration," City Council member Mark Kersey told 10News in an interview Wednesday ahead of a City Council meeting on the matter.The new data shows that crews have repaired or replaced more than 27,000 sidewalks since the last major assessment was completed in 2015. However, more than 81,000 sidewalks still need attention. And while an estimate in 2016 put the costs to complete the work at million, that number has now jumped to to 100 million."The way it's set up right now is the sidewalk is the property owner's responsibility," Kersey explained. "They own it and they're supposed to maintain it. But because it's in the public's right of way, if someone trips and falls and hurts themselves, the city is the first one to get sued."Kersey says the repair process is far more complex and time-consuming than simply seeing a problem area and fixing it. Much of this stems from trying to prod property owners into making the repairs. However, Kersey says the costs of getting the right permits can be prohibitive, even sometimes matching the actual cost of the work. There is a city program which offers to bypass permitting and have the city do the work for half of the cost, though only a few dozen repairs are processed through the program each year.Another concern is mounting legal costs. On top of the cost of the actual repairs, the city has spent millions of dollars settling lawsuits stemming from dangerous sidewalks. SAN DIEGO (KGTV) -- Harbor Police were searching for a vandal Monday who set off a panic at an upscale steak house along the Embarcadero.Customers took cover under tables and ran for the exits at Ruth’s Chris Steak House Sunday night when projectiles smashed through at least two of the restaurant’s bay-facing windows. Someone inside the restaurant shouted “gun,” prompting fears of an active shooter, customers told 10News.“It was one of the craziest things I’ve ever been through,” said Joey Giacalone, a long-time patron and former co-owner of the Venetian Restaurant in Point Loma. “I mean everyone is diving under tables. It was pandemonium.”Two bartenders and a manager jumped into action, Giacalone and his wife said, directing guests to take cover and then evacuate the restaurant.RELATED: Hillcrest restaurant reopens after one week after shooting“There were cooks telling us to come to the back door. They sent us through the kitchen. Because again, no one knew what information was really out there. We thought there was an active shooter,” he said. “I kept envisioning a gunman coming around the corner to shoot us all,” Juli Giacalone added.One of the servers working that night survived the Route 91mass shooting in Las Vegas. Ricca Salazar “reacted quickly and ran out the back door with a couple other staff members,” her husband wrote on Facebook. “She fell and they helped her up,” he said. “Scary night, scary scenario.”Harbor Police determined someone had thrown rocks through the windows. Investigators believe the unidentified vandal may have been a disgruntled customer who left the restaurant without paying earlier that evening, said Lt. Victor Banuelos.Joey Giacalone said the man had been acting strangely.“One guest said he saw him going into the women’s bathroom and said, ‘What the hell are you doing?’ And then he left,” he said.The Giacalones commended staff members for going “above-and-beyond” during the incident.“Everyone is panicking and these guys are saying, ‘Forget about me. SAN DIEGO (KGTV) -- For decades internal documents about officers' use of force were limited to just law enforcement.A new California law changed that, and now some of the most private materials are being released to the public.Documents released by the San Diego Police Department show how incidents are investigated and what type of evidence is collected before use of force cases are submitted to the San Diego County District Attorney's Office.10News asked the department to analyze a case to help the public understand how a report is created. An internal affairs captain also explains how the public getting access to internal documents is helping bridge the gap between the department and the people it serves.2016 Officer-Involved ShootingIn November 2016, Juan Carlos Fernandez shot four people, killing two in the 3800 block of Marlborough Avenue. Police shot and killed Fernandez after officers repeatedly ordered him to lay on the ground, but he refused and continued pointing the handgun at a female, according to police. A 2016 San Diego Police Department press release stated, "An officer, fearing for his life and the safety of the female, fired one round from his service weapon. The round struck the suspect, knocking him to the ground. The suspect was pronounced deceased at the scene by paramedics."The San Diego County District Attorney's Office cleared the officer in the shooting.Under a new California law, Senate Bill 1421, the investigative file and supporting audio and video documents were released to 10News through a public records act request.10News asked the department to talk about what goes into an investigative case file and how the department investigates its own after an officer-Involved shooting.Case Deconstruction"The initial examination is going to be from a criminal standpoint, and the homicide unit is going to roll out there, and they are going to start their investigation," said Internal Affairs Captain Wes Morris.Part of the homicide investigation includes an initial walkthrough at the scene.Using the documents released to Team 10, an initial audio walkthrough of the 2016 shooting identified 15 law enforcement officials, including the officer involved in the shooting, a representative from the San Diego County District Attorney's office, and a member of the Internal Affairs Department."You can get very accurate information right away, and you can start to get a feel for what actually occurred," Morris told 10News.Morris said the homicide team would speak with anyone who was at the location of the shooting, anyone who could have been at the location, and/or anyone who was close to the location and knew anyone involved.All the evidence collected goes into what's called an Officer-Involved Shooting Report.Using the 2016 case as an example, the department report totaled 612 pages. While some of the information was redacted, the report contained sub-reports including: forensic biology report, chain of custody report, firearms lab report, crime scene lab report, vehicle report, witness statement, officer interview, death in custody report, property report, DNA sample report and a report with 586 pages of photos. The San Diego Police Department also released more than 100 audio and video recordings of 911 calls, radio traffic, witness interviews, officer interviews, and body-worn camera."It's not a rubber stamp," Morris said. "There's a lot of work that goes into it. People that really do want to find the truth of what happened in these types of incidents."The report is turned over to the San Diego County District Attorney's Office.According to the DA's website, "The police agency with jurisdiction over the location of the shooting or death conducts the primary investigation of the incident. After the police agency completes their investigation, the District Attorney's Office reviews it, which it does for all officer-involved shootings and in-custody deaths in San Diego County. If the District Attorney wants additional information to supplement the investigation, a request can be made to the jurisdictional agency to obtain the information, or the District Attorney's Office can conduct the additional investigation. The District Attorney's Office does not do a separate, new investigation of the incident." The District Attorney's Office states that when a review is completed, "If the District Attorney's Office determines there is criminal liability, charges will be filed against the officer or deputy. If there is no criminal liability, a letter is written summarizing the facts, evidence, and available statements of those involved. The letter is delivered to the Chief of Police or Sheriff of the jurisdictional agency indicating the actions of the officer or deputy was legally justified. The letter is also posted on the DA's website where any member of the public can read it."If there are no criminal charges pending, internal affairs will take the criminal investigation and do their investigation. Internal Affairs "With an officer-involved shooting, the most important thing we're looking at was if that use of force was within our policy," Morris said.He explained when the case gets to internal affairs, it is assigned to a detective sergeant. The detective sergeant will review the entire case, looking at whether the lethal use of force was within the department's policy and if the officer followed the proper procedures."There are times where we will bring that officer back in again and interview them," Morris said. "We narrowly focus it to what we're looking at, but we may interview them on something that we've seen or some sort of policy and procedure concern, or it could be something outside of that particular use of force."Morris said once the detective sergeant's investigation is complete, it will be put through a review process in-house. The completed investigation will be submitted to the Community Review Board on Police Practices (CRB)."Their main task is to make sure that we haven't left any stone unturned and that we've looked at every aspect of the investigation and that our investigation is thorough, complete, and impartial," Morris said. 6178
