SAN DIEGO (KGTV) - While San Diego County teeters on the edge of a fall from the state's red to purple tier, local school districts are left scrambling to sort out conflicting directions."It's extremely frustrating. I want to bring kids back on campus more than anyone," said La Mesa-Spring Valley School District Superintendent David Feliciano during an interview with ABC10 News on Friday. His district pushed its reopening date to Nov. 30 but may be forced to stay closed if the San Diego County moves to the purple tier which is the most restrictive tier.If by next Tuesday San Diego County's case rate continues to hit above 7 cases per 100,000 residents, we could be moved into California's purple tier.RELATED: In-Depth: When will San Diego playgrounds reopen?"It puts us in a difficult spot and it especially puts parents in a very difficult spot and we're the ones breaking that news [to them]," added Feliciano.On Friday, officials with the California Department of Public Health wrote to ABC10News, "If a school did not open while the county was in the red tier, and the county subsequently moves to the purple tier, that school will not be able to open for in-person instruction, until the county has returned to the red tier and been in the red tier for two weeks."That goes against what San Diego County officials have been reporting. Its online guidance plan reads in part, "If we are directed by the State to Tier 1, our schools will not be [affected] in their ability to continue in-person education or initiate their in-person education while in Tier 1. An operator who answered a call at 97.3 said the show is now scheduled to air on Monday.But sources tell 10News the Padres are now demanding that 97.3 change their programming to “family friendly” content. SAN DIEGO (KGTV) — With President-elect Joe Biden and Vice President-elect Kamala Harris projected to take the White House, Harris will have to resign her seat in the U.S. Senate.The power to fill that seat would fall to Governor Gavin Newsom, and the political jockeying for his pick is well underway.“This is one of the best jobs in American politics, one of the most prominent jobs in American politics and every California political leader wants it,” said UC San Diego political science chair Thad Kousser.Kousser expects Newsom will want to make history with the diversity of his pick, should he have the opportunity.Others are thinking along the same lines. Groups like Equality California have sent the governor a list of their preferred LGBTQ candidates, which would be a first for California.Assemblywoman Lorena Gonzalez tweeted out her own list Friday of Latino candidates, another potential first for the state.“We are the largest demographic in this state, and growing,” she wrote. “It’s time we have a Latino/a US Senator.”Political analyst Laura Fink says the governor is going to have to balance a lot of competing interests.“First and foremost, what's going to be best for California? And then of course, what's going to be best for Governor Newsom moving forward as he looks toward his political ambitions,” Fink said, referring to the possibility that Newsom could run for president.There have been dozens of names floated as potential picks, including California Secretary of State Alex Padilla and state Attorney General Xavier Becerra.Both are sons of Mexican immigrants who would be the first Latino senators in California history.But don’t pencil either in just yet, according to Fink.“Kamala Harris is leaving one of only 26 women in the Senate. That's one out of four. Last time I checked, [women] are north of 50 percent of the population. So that is something that will need to come into consideration,” she said.Rep. Karen Bass is another top contender. She’s the head of the Congressional Black Caucus.There’s also State Senator Toni Atkins of San Diego, who could also make history as California’s first openly gay senator.“She's been the first a lot of times,” Fink said. “First lesbian Speaker of the State Assembly. First Madam President Pro Tem of the State Senate. This would be another first for her should she ascend to that seat.”Atkins declined to say if she was interested in the job or being vetted.“Right now, my focus is on the work before us, and the path ahead of us," she said in a statement to ABC 10News.Atikins said she was “focused on the outcome of the election and our state Senate races, looking forward to a Biden/Harris administration, and continuing our work here in California.”The power to fill a vacant U.S. Senate seat comes from the 17th Amendment to the U.S. Constitution. States have their own laws that shape the process.Five states require Senate vacancies to be filled by a special election. Nine states allow the governor to appoint a replacement, but require a special election shortly after.The remaining 36 states, including California, allow governors to appoint a replacement to serve out the remainder of the term.Newsom’s pick would serve out the remaining two years on Harris’s term, then go up for reelection in 2022 as an incumbent. Incumbency carries significant advantages in name recognition, fundraising and image, said Kousser.“You are getting that news coverage. Somebody is probably playing you on Saturday Night Live for two years, and that elevates you above all the other contenders,” he said.With California a reliably blue state, experts say Newsom’s pick could hold the job for decades. 3685

  

SAN DIEGO (KGTV) - Two women who worked as massage therapists at the Grand Del Mar are suing the resort’s parent company, claiming the spa allowed them to be sexually harassed by male clients. Christina Murphy and Madeline Flores made allegations this week of sexual harassment, failure to prevent harassment, wrongful termination, and retaliation against FHR GDM Hotel Management Company LLC. The women’s claims involve two spa clients, Steve Hodsdon and Juan Pablo Mariscal, who the women say made inappropriate advances during scheduled massage appointments. The Grand allowed clients to disregard protocols for keeping themselves covered and repeatedly exposed themselves to therapists, according to a court document filed by the women’s attorney. The male clients also made sexually suggestive comments and gestures and propositioned their therapists for sexual favors, the document said. The legal complaint also details issues Flores and Murphy said they addressed to the spa’s lead massage therapist, manager, director, and human resources representative. The Grand “ignored the complaints and tried to brush them under the rug to keep these male clients coming to the Spa,” the document reads. Both Flores and Murphy used administrative channels to make complaints in Aug. 2018, filing sexual harassment complaints with the California Department of Fair Employment and Housing. On Feb. 26, 2019, Murphy and Flores amended their complaints to include a claim of construction discharge in violation of FEHA or wrongful termination, respectively, and the DFEH closed their cases. The women say they suffered emotional distress, mental anguish, nervousness, grief, anxiety, worry, shock, humiliation, and shame.In a statement sent to 10News, Murphy said, "From the beginning, the Grand Del Mar makes it clear that as massage therapists, we should feel privileged to work on such high-end clientele. This creates a power differential where the guests have all the power and the therapists are powerless to challenge inappropriate conduct. The sexual intimidation by these male clients caused me so much fear – fear of what these men were capable of and fear of retaliation by the Grand for reporting them. But I had to speak up to protect myself and my coworkers. When it became obvious that the Grand was not going to protect me, I did the only thing I knew would keep this from happening to me again – I quit."Flores said in the same statement, "What happened to me and Christina never should have happened. The Grand should have taken action to stop this harassment the first time it received complaints about these men. But the Grand did nothing and we ultimately paid the price. The Grand made me feel unsafe at work when they were supposed to be the ones to protect me. This was a profession that I went to school for and that I loved, and now, I have lost my passion for it. I was scared to come forward but ultimately, I felt I had to come forward because I do not want what happened to me to happen to other massage therapists."Their attorney, Alreen Haeggquist, with Haeggquist & Eck, LLP said, “The law is simple and straightforward: an employer has a duty to protect its employees from harassment. But in the face of multiple detailed complaints by its female massage therapists over a period of years, the Grand has chosen to instead protect the perpetrators. The Grand has made a clear choice: the tens of thousands of dollars its predatory male clients spend at the Hotel is far more important than the safety of its female employees. For the right amount of money, the Grand will ignore clients who remove all draping, grind on the massage table, expose their erect penises and ask its therapists for prostate massages. Over the past few years, the Grand has refused to accept any responsibility for its systemic failures. They have had multiple opportunities to do the right thing and protect their female massage therapists – and time after time, they’ve failed to do so. Well, time’s up.”The plaintiffs believe no fewer than six massage therapists may have been victimized, the court document says. The hotel responded in a statement of its own, "Fairmont Grand Del Mar acts diligently to investigate employee complaints and is confident that there was no wrongdoing by the hotel in connection with this matter. The safety of our guests and our colleagues is a top priority and providing a healthy work environment remains paramount.
