SAN DIEGO (KGTV) — A Superior Court judge gave San Diego County restaurants the green light to serve on-site again, but not all will make use of the opportunity.For Roddy Browning, the pressure to reopen his restaurant is intense.“We lay in bed at 2:30 in the morning, going, 'Okay, what am I going to do? What am I going to do tomorrow? What am I going to do the next day?'” said Browning, who owns Oceanside's Flying Pig Pub and Kitchen.Browning said sales are down 60% and employees have been reduced from 30 to 12. Reopening for outdoor dining under the new court ruling could boost those numbers.“The state's going to appeal it, and what is the point in opening back up again, and then bringing all these people back to work and saying okay guys the ruling changed, now we're going to have to kick you out of the restaurant again,” Browning said. “I don’t want to do that to my employees anymore.”Don't get him wrong. Browning does plan to reopen under the new court order - but he wants to respect the full three weeks intended in this latest shutdown order, set to complete on Dec. 28."This is not about us against them," Browning said. "We said we would give the governor his three weeks, and I'm going to give him his three weeks."But other San Diego restaurants are planning to remain takeout only until health officials advise otherwise.At Spring Valley's Cali-Comfort Barbecue, a gathering place for sports fans, owner Shawn Walchef says he's not offering indoor or outdoor dining.“We believe that the coronavirus is the antithesis of hospitality. Everything we do in our blood is to take care of people,” Walchef said. “Social distancing doesn’t work in our business. We welcome people into our homes.”Walchef cut about half of his staff - a day he calls his toughest as a restaurant owner.But he says Cali Comfort has fully embraced multiple digital ordering systems, helping it to remain profitable amid the pandemic.Still, the recent order impacts many. SAN DIEGO (KGTV) - A San Diego woman who was shot at the Route 91 music festival in Las Vegas is making great strides in her recovery.Tina Frost and her boyfriend were with eight friends when Stephen Paddock opened fire. Frost was the only one of her group who was shot. The bullet went into her eye.Her family says the recovery has been difficult but that she continues to power forward with her therapies.Frost’s mother posted an update on the GoFundMe page indicating Frost has walked without assistance, thrown a ball, baked cookies, and painted an eye patch for herself.Amy Klinger, a close family friend, says Frost's strength and resilience is no surprise."She is not going to let anything get in her way of getting back to her normal, happy, and healthy life," said Klinger.  "It was so amazing, I walked into the room and she was talking with her physical therapist and because her sentences were so clear, I did forget for a minute she had not been speaking."A lifelong soccer player, Frost has even been able to kick a soccer ball to her dad in the hallway."The fact that they did say at the very beginning, let's see what happens in a year, and it's only less than five weeks out and she's walking and she's talking, she's just, the progress has been amazing and is a testament to who she is," said Klinger.Klinger believes the worldwide support and power of positivity has been a factor in the healing, for both Frost and her family."Just knowing there's this enormous community, Team Tina, that's out there behind the family, it keeps their spirits up and keeps them positive because this is a lot to do deal with," said Klinger.Frost has a big surgery in the upcoming weeks where doctors will begin facial reconstruction. 1749

SAN DIEGO (KGTV) — A University City man is hoping to warn others after someone with a BB gun shot him during his daily jog.On Tuesday, 70-year-old Taurone was nearing the end of his daily three-mile jog northbound on University Town Center Drive just after 6 p.m."Very calm, enjoying the evening. Hardly any traffic out in the neighborhood," said Taurone.On the sidewalk near the Renaissance Towne Center, his calm jog was suddenly interrupted by pain."Jogging along and felt a sharp sting in the lower portion or my chin, so I stopped. It felt like an extremely large pimple. I was pushing on it, and something round and hard came out of my skin fell onto the ground," said Taurone.A stunned Taurone, who didn't have his glasses, didn't look for the apparent BB pellet."When I realized I what it was, and that I had been shot, I was very angry," said Taurone.Taurone, who was shot on the right side of his face, believes the shot came from the shopping center area. He briefly scoured the area but didn't see anyone. Bleeding from his chin, he jogged home. He's doing fine now, but he's still upset."If the shot had been 6 to 8 inches higher, it would have hit me in the eye," said Taurone.Taurone has no clue about a motive, but he knows he was the intended target."Makes sense because I was the only moving target in the area," said Taurone.Taurone has been interviewed by police, who told him they haven't received reports of similar incidents in the area. He's now worried about what may happen next, because of the boldness of the attack. SAN DIEGO (KGTV) - An effort is underway to crack down on illegal party boats and other charter vessels operating on San Diego Bay. The Port of San Diego wants to create new charter permit requirements to make it easier for those who want to operate legally to do so. Currently, legal charter vessel operators must obtain a Permit from a marina or sportishing landing where they board passengers, and according to the Port there are more charter vessel operators than there are available slips at the marinas and sportfishing landings on San Diego Bay.To address this problem, the Port proposes to issue all Charter Vessel Operation Permits (Permits) for all Charter Vessel Operations and collect license agreement fees from qualified Charter Vessel Operators who do not have an agreement to operate from a marina or sportfishing landing. “San Diego Bay great place to do charter business because it's almost entirely landlocked, not subject to swells, makes for great party boats, cruising,” says Captain John Valente of San Diego Bay Cruises. Valente spent 15 months and almost 0,000 to get his boat in compliance with federal regulations. The figure does not include the price of insurance. Last year Harbor Police discovered roughly 200 charter vessels operating illegally in San Diego. “It’s very disheartening and it hurts because that's revenue lost. I need to pay the bills, I need to pay my rent,” says Valente. Officers and the Coast Guard are conducting joint patrols to stop the illegal operators. "It's not easy, the enforcement, but this does strengthen the rules and make it pretty clear who can and cannot be charter operators,” said Chief Mark Stainbrook, who added he would consider undercover operations if necessary. Stainbrook said the deadly diving boat fire off Santa Barbara's coast is another reminder at why getting this issue right is so important; they can't risk unsafe charters on the water. Valente says he's glad the Port is amending regulations, but isn't sure the current proposal goes far enough.
