RAMONA (KGTV) - — The owner of Ramona Fitness Center is trying to rally business owners to stand up for their rights and consider defying San Diego County public health orders that require many businesses to close.“They’re forcing us out of business," Peter San Nicolas told ABC 10News in an interview Tuesday. "They’ll force people to not be able to pay for food and pay for home, for somewhere to live. We’re talking about basic necessities and they’re pushing us to the limit.”Gyms are among the sectors ordered to cease all indoor operations after the county moved into the state's purple, or worst, tier. This comes as the county recorded 1,546 new COVID-19 cases Tuesday, a single-day record.San Nicolas makes the case that gyms can open safely and that forcing them to close will not stop the spread. “We haven’t had any issue with it here in the gym. We’ve had over 25,000 check-ins just since June and we’ve had no cases of covid here at the gym.”According to the latest outbreak numbers on the county website, only 0.4% of all cases recorded between June 5 and November 14 have been tied to gyms. However, many public health experts say there is no question gyms should be closed during this most recent surge. "Gyms are one of the riskiest possible businesses," said Dr. Rebecca Fielding-Miller, an epidemiologist who teaches at UC San Diego, in an email to ABC 10News. "By definition, people are breathing heavily in an indoor space, which is a recipe for spread. And while I haven’t been inside a gym since March, I would hazard a guess that gyms that are threatening to defy county orders are also not gyms that are enforcing masking policies. They should absolutely be closed."During the last COVID-19 surge in August, Ramona Fitness Centers became one of the first and only businesses cited and then charged by the District Attorney for remaining open in violation of public health orders. President Donald Trump told the top White House lawyer in April that he wanted to order federal prosecutions of Hillary Clinton and James Comey, The New York Times reported Tuesday.The Times report, citing two people familiar with the conversation, said recently departed White House counsel Don McGahn told Trump in response that he could not compel the Justice Department to prosecute people and even requesting an investigation could be a step too far. The Times said McGahn went on to have White House lawyers list the consequences of such a demand for Trump.The Times said it was unclear if Trump read the memo about the consequences of a president having the Justice Department investigate his opponents and that it was also unclear what Trump wanted the prosecutions to cover.Trump has long called for legal action against Clinton, his Democratic rival in 2016, over her email practices as secretary of state, and he has alleged that Comey, who he fired as FBI director last year, leaked classified information.Attorney William Burck told CNN that McGahn would not comment on legal advice he had given to the President."Like any client, the President is entitled to confidentiality," Burck said. "Mr. McGahn would point out, though, that the President never, to his knowledge, ordered that anyone prosecute Hillary Clinton or James Comey."McGahn left the White House in October, a long-planned departure that followed a tenure marked in part by friction with the President. Tuesday's report about the April conversation echoed previous reporting about Trump and McGahn, including an order to fire special counsel Robert Mueller, which McGahn was said to have refused. President Donald Trump visited California on Monday to receive an update on the dozens of wildfires that are currently raging across the Western United States.During a visit to McClellan Park, California on Monday, Trump received a briefing from local officials on the status of the fires that have killed 33 people in three states dating back to mid-August.The president then spoke at a ceremony recognizing the California National Guard, which has hundreds of members helping to battle the fires.
