SAN DIEGO (KGTV) - A final report from the National Transportation Safety Board points to the probable cause of a 2016 crash into the Navy Pier and dock in downtown San Diego.The Adventure Hornblower collided with the seawall sending people on shore scrambling for safety.According to the August 2017 report, the probable cause is listed as “failure of the port transmission to disengage from the forward propulsion position due to the operating company’s lack of adherence to the transmission manufacturer’s recommended periodic maintenance schedule and the lack of routine maintenance and upkeep of the propulsion system’s equipment.”It also says that the lack of instrumentation to provide a positive indication of thrust direction or an alarm to indicate the propulsion control system was not responding properly to the captain's commands."it was shocking,” said passenger Susan Pendergast. “I mean it was just shocking.”Pendergast says when the vessel hit the dock she was thrown to the ground, re-injuring an already bad back.She eventually had surgery in two different places.“It’s left me certainly not with the life I once had,” she said.Following the collision, an official with Hornblower told 10News it could be related to a possible mechanical failure.A few months later court documents pointed toward an unforeseeable and unpreventable mechanical failure despite proper maintenance, the fault was caused by the neglect of others.The NTSB report disputes that finding.When talking about the collision, the report states,  “As the Adventure Hornblower approached the pier on the accident date, the port transmission failed to respond to the captain’s helm orders. Investigators believe that the fault occurred between the servo-actuator, the mechanical linkage, and the control unit, most likely due to neglected maintenance to the port transmission and control system.”In a statement, a spokesperson for the Hornblower disputes the NTSB’s findings writing, “Hornblower Cruises & Events continues with safe, daily operations, following the allision of Adventure Hornblower back in 2016. On that day, the initial response of our captain and crew to address all immediate safety concerns and ensure the well-being of all guests aboard, was exceptional. Hornblower has noted several inaccuracies in the NTSB report on this matter, and therefore disagrees with its determinations as to the probable cause of the allision.  Due to ongoing product defect litigation, Hornblower cannot comment further at this time. Hornblower, deeply appreciates the amazing loyalty of our customers and guests over the years, and we continue to work with care and diligence, every day, to deliver on that trust.” 2739

SAN DIEGO (KGTV) -- A driver was arrested after Border Patrol agents discovered nearly million in cash hidden in his SUV’s gas tank.On Aug. 5, at around 10:30 a.m., Border Patrol officials said agents spotted a suspicious Volkswagen Touareg on southbound Interstate 15 in Escondido and pulled the vehicle over.After a K-9 alerted agents to something in the SUV, agents questioned the 26-year-old driver. During a search of the vehicle, agents found 65 plastic-wrapped bundles of cash in the gas tank.According to officials, there was 7,460 in cash stuffed in the tank.The driver, a Mexican national, was arrested and turned over to Homeland Security “with pending criminal proceedings,” officials said.Agents seized the cash and SUV.In a news release, Chief Patrol Agent Aaron Heitke said, “The U.S. Border Patrol works tirelessly to protect the Homeland from transnational criminal organizations - the same criminal enterprises that poison our communities with narcotics and smuggle human beings like cargo. SAN DIEGO (KGTV) -- A 23-year-old man was arrested in connection with a death at a Rancho Pe?asquitos home stemming from a reported fight at the residence.San Diego police said officers were called to a home in the 12500 block of Darkwood Rd. in Rancho Penasquitos just before 4:15 p.m. Wednesday in response to a reported fight at the house.According to police, a man called 911 to report his 23-year-old son, Wyatt Austin Lane, had been in a fight with a guest at their home earlier in the day.Regarding the fight, the father reported that his son told him “the guest had lost and never regained consciousness,” according to police.Officers arrived to find a deceased male inside a bedroom with “apparent trauma to his body,” police said. The victim was not immediately identified.Lane was arrested and booked into County Jail on suspicion of murder.SDPD Homicide Unit detectives are investigating the incident. 921

SAN DIEGO (KGTV) -- A 12-year-old girl riding a skateboard down a City Heights hill was seriously injured Wednesday when she crashed into the back of a minivan, San Diego police said.According to police, the crash happened just before 5:30 pm. at the intersection of Estrella and Polk avenues.Police said a Toyota Sienna was traveling northbound in the 4000 block of Estrella Avenue when it entered the intersection. The skateboarder going downhill on eastbound Polk Avenue “failed to stop” at the intersection and collided with the minivan’s left rear bumper cover.The girl sustained major injuries, including a fractured skull and brain bleed, according to police. She was rushed to Rady Children’s Hospital for treatment; her condition is unknown. 758

SAN DIEGO (KGTV) - A bizarre series of events led to a woman visiting San Diego with her family, getting attacked in a Hyatt Hotel lobby by a stranger running from a crash scene. Construction workers tell 10News they witnessed a man drive recklessly through a Mission Bay construction zone around 5 a.m., almost striking vehicles.The workers say they jumped in their truck and followed the driver down Quivira Road hoping to get his license plate information.Instead, they say the driver made a U-turn and crashed into their truck and a parked car. The driver’s car immediately burst into flames, but he wasn’t done just yet.According to the construction workers, the man then ran from the scene toward the Hyatt Hotel in Mission Bay.They say they chased him on foot, and held him down in the hotel lobby, waiting for police to arrive.Witnesses tell 10News that’s when the man got away and attacked a woman who was in the lobby checking out of the hotel.The woman’s husband told 10News the man tackled her then put her in the choke hold. The victim’s mother said she believes the suspect was trying to kill her daughter.The victim, her husband and parents were visiting San Diego from Minnesota. They were scheduled to continue their vacation by flying out to Hawaii this morning.They have to reschedule the trip because the victim was taken to the hospital.Police arrested the suspect. They say his motive is unclear.Investigators have not yet determined if the driver was under the influence of drugs or alcohol at the time of the crash. 1547
