A Cuyahoga County (Ohio) Sheriff's Department employee was on the job when he overdosed in the parking lot of a Brooklyn IHOP in March.Paul Grivas has a badge with the sheriff's department where he works as a process server — someone who serves warrants and subpoenas. He was in his marked sheriff's department vehicle when someone noticed him slumped over at the wheel and dialed 911."It was definitely a different situation dealing with somebody that's in the same line of work we are," Officer Joe Bugaj with the Brooklyn Police Department said.Police officers found several subpoenas he was in the process of serving in the back seat. They also found the badge he was carrying.When Brooklyn first responders arrived at the scene, they immediately recognized he was overdosing and unresponsive.Grivas was given several doses of Naloxone, the antidote for heroin. Police say when he woke up he was extremely combative. "He was flailing his arms, kicking his legs, and one of the medics ended up getting kicked in the head," Bugaj said.He kneed a fireman so hard, the fireman suffered a mild concussion. Officials say he is doing okay.Bugaj said it's not uncommon for people to wake up from an overdose and be aggravated. He said it's something first responders have to keep in mind. "You never know what could happen, whether or not they're going to be upset, because we are basically taking that high away from them," Bugaj said.When asked if there is anything first responders can do to protect themselves, Bugaj said it's just part of the job."It's our job. It's what we signed up to do. A man in Colorado who was sentenced to more than 300 years in prison for child sex crimes in 2015, is now walking free after his conviction was thrown out on a technicality.Michael Tracy McFadden, 46, was convicted for 19 counts of sexual offenses, including a habitual sex offender against children, according to KKCO. McFadden was released from the Arkansas Valley Correctional Facility on Tuesday.In June, the Colorado Court of Appeals found that McFadden's right to a speedy trial was violated when the judge in the case granted a continuance. When the court ruled that his statutes were violated, they threw out his conviction."Frankly I'm completely appalled with the decision," District Attorney Dan Rubenstein told KREX. "I find it offensive that our justice system would allow this to happen."Rubenstein explained to KREX that speedy trials are broken down into two categories: constitutional and statual.Constitutional speedy trials have no timeframe, depending on the case. However, in Colorado, statutory speedy right trials require a time frame of six months.Rubinstein told reporters, “Because the error here was that he shouldn’t have been tried longer than six months from the last time he waived speedy trial, there was no remedy for that, and therefore there is no ability to retry him." "The justice system completely failed in this situation. If you've heard the phrase 'got off on a technicality,' this is the phrase to the most stark sense I've ever seen it," said Rubinstein.Reports state that McFadden has been exonerated from all of his charges and does not have to register as a sex offender. 1661

A bond has been set for a man accused of chasing after and shooting at a Rochester teen seeking directions to school. Jeff Ziegler, a former lieutenant in the Detroit Fire Department, was arraigned on felony charges of being in possession of a firearm and assault with intent to murder. His bond was set at ,000.According to Assistant Prosecutor Kelly Collins, Ziegler has a previous weapons conviction from 2005.  The judge additionally ordered the Rochester man to not have direct contact with the victim or his family, and to surrender all of his weapons to the Oakland County Sheriff's Department. He must also wear a GPS tether and attend mental health counseling two days a week. Because the suspect stays within a 10 mile radius of the victim, the judge ordered that if bond is made, he will be required to find another place to live. When 14-year-old Brennan Walker missed the bus and tried to walk to school Friday morning, he got lost after he couldn't remember the route. That's when Walker attempted to ask for directions at a nearby home.Zeigler allegedly chased after Walker and fired a shot because he and his wife believed the 14-year-old was attempting to break into their home, according to a press release.    1319
