SAN DIEGO (KGTV) - A security guard at a Clairemont strip mall narrowly avoided a devastating crash Friday.An elderly female driver hit two parked cars, then drove off an elevated parking lot and crashed through a rail. She landed on the street outside the Garfield Shopping Center at 4220 Balboa Avenue and Clairemont Drive.Robert Malone is the security guard for the Goodwill at the mall and was doing rounds of the property.On its way down, the van flew just six feet over Malone’s head.“I look up, I got a van coming at me,” said Malone.The van hit a telephone pole, bringing the pole and the lines down.Malone said up to a dozen men jumped down from the parking lot to pull the driver from the van. The group called 911 and paramedics took the woman to the hospital. No one else was hurt.San Diego Police are investigating the cause of the crash. 869

"Then we had that tax increase on top of it and all the sudden 24 cents later, we’re where we are now. We’re paying higher prices right now than we have been in over two years.”Montgomery says they are hoping prices go down and level out again by the New Year at the very latest.  1032

SAN DIEGO (KGTV) - An elderly woman died while she was with her family waiting to cross the border into San Diego Sunday afternoon, according to our reporting partner Televisa.Televisa reported it is unknown why the woman, who was in her late 80s, passed away.This comes as people on both sides of the border expressed frustration at incredibly long wait times."It's unfortunate because I think the policies that CBP puts in place, protocols, punish border crossers," Pedro Rios said. He said it took four hours to cross in Otay Mesa on Saturday.New protocols went into effect on Friday due to the pandemic. Customs and Border Protection planned on slowing down traffic, closing lanes and adding secondary inspections, aimed at delaying those traveling for non-essential reasons.In addition to San Diego, Tucson, Arizona, El Paso, and Laredo Texas have similar protocols in place.One woman waiting to cross into San Ysidro told Televisa, "Yes it is difficult, but no one wants to be here in Tijuana."Another woman said they were heading to the U.S. to visit friends and go to the beach. When Televisa asked if they thought that was essential travel, they replied in Spanish, "Yes, because we're tired and angry. If you're following the regulations, staying away from people, have your mask and disinfectant ... if you're following the protocol, you can."The restrictions on non-essential travel do not apply to anyone crossing the border for work, school, or medical treatment.The restrictions are set to continue through September 21.ABC 10News reached out to CBP for comment and will update this story when they respond. 1630

SAN DIEGO (KGTV) - A similar Observation Wheel to those in England and Paris could come to Balboa Park for a short term stay.The Cohn Restaurant Group and Sky Views of America presented the idea of the Balboa Park Star to the Balboa Park Committee Meeting on October 1.They hope the wheel would attract more visitors and re-energize the park."We have operated these observation wheels during the pandemic," Vice President of Sky Views of America Ben Pickett said.The gondolas are enclosed and climate controlled. According to the presentation, they are sanitized after each ride and safety protocols comply with state, local and CDC guidelines. Masks would be required for passengers and staff. The presentation was met with excitement by the committee."I love the fact it is innovative and outside the box," Committee Member Victoria Curran said. "This is a terrific idea, I love it!" Committee Member Johanna Schiavoni added."Sometimes it's the craziest ideas that are the best ones," Committee Member Micah Parzen said. He cautioned there were concerns that needed to be worked out, like where and how much room the wheel would take up, if the wheel would take income away from competing museums and the juxtaposition of historic versus modern aesthetics.Pickett said they are working on promotions with the museums as well as discounts for families and military members.David Cohn compared the Balboa Park Star to the London Eye, La Grande Roue in Paris, or the Belfast Eye in Ireland.Most visitors at Balboa Park who spoke with ABC 10News like the idea."I think it would be super super cool, I would totally ride it," Visitor Erin Medina from Reno said excitedly."At first I thought, huh, seems more like a carnival than beautiful historic Balboa Park, but as you mentioned the Ferris wheel came here in 1915, so it might be kind of cool to bring it back, especially during the pandemic," San Diegan Clare Siragusa said.The R-50 is a modern wheel with gondolas that can seat eight people. The cost is estimated - per rider and tickets would be sold online and at the attraction.The proposed location is in the Plaza de Panama, near the Museum of Art."Anything that's for the kids, anything that's kind of easy, accessible entertainment, I support," San Diegan Samantha Pearson said.Entertainment at 148 feet in the air, just 52 feet short of the California Tower.The next presentation will be for the Balboa Park Cultural Partnership Board October 28. SAN DIEGO (KGTV) - An inmate at R.J. Donovan State Prison has filed a lawsuit against the California Department of Corrections and Rehabilitation.Anand Jon Alexander filed the complaint on Monday, alleging prison officials failed to keep him safe and to provide adequate medical care after he was assaulted behind bars.In the complaint, Alexander claims he was attacked by another inmate while waiting to make a phone call on May 18, 2019. He was allegedly stabbed multiple times in the face and kicked on the ground.After the attack he sustained “five facial fractures, a lower orbital floor blowout, sinus and nasal fractures, a deviated septum, a 50% abrasion to the right cornea, long term impairment of his vision and respiration, serious nerve damage, PTSD” according to the complaint.Alexander is 12 years in to a 59 year sentence after he was convicted of rape in 2008.An up and coming fashion designer, Alexander had been featured on “America’s Next Top Model” and was listed in Newsweek’s “Who’s Next in 2007.”But his career was put on hold after being accused by multiple women of sexual assault.Many of the charges were dropped, but he was convicted on one count of rape and 15 other counts following a trial in Los Angeles. The jury found him not guilty or were hung on several other counts.Alexander has maintained his innocence. In the complaint, his lawyer writes he “has acknowledged the existence of blurred lines between his personal and professional relationships…Nevertheless, he holds steadfast to his innocence.”The American Justice Alliance, a group which seeks to free prisoners who have been wrongfully convicted, submitted an amicus brief to the Federal Central District Court.In it, they wrote Alexander “was targeted by a collusion of disgruntled business associates and some former girlfriends, who have admitted they were out to “bring him down,” and “get revenge,” seeking notoriety and monetary benefits. He was then subject to a prosecution and trial riddled with extraordinary police misconduct.”The lawsuit names CDCR as well as Marcus Pollard, the Warden of R.J. Donovan Correctional Facility and Daniel Paramo, the former Warden.It alleges prison officials failed to protect Alexander from harm and after he was injured gave “deliberate indifference to Mr. Alexander’s medical condition.”They are seeking unspecified monetary damages and a jury trial.So far, no criminal charges have been filed against the assailant. 10News reached out to CDCR for comment but had not heard back before the story was published. 2557
